Welcome to Snap AI. Please read this document carefully before using the App. It contains both our Privacy Policy and our Terms and Conditions. By downloading, installing, or using Snap AI ("the App"), you ("the User") agree to be bound by everything stated below. If you do not agree, please do not use the App.

Snap AI is developed and maintained by a single independent developer, not a company. The App is provided on an "AS IS" and "AS AVAILABLE" basis, and by using it you accept full responsibility for your own actions, content, and outcomes as described in this document.

PART 1: PRIVACY POLICY

This Privacy Policy explains how Snap AI collects, uses, stores, and protects information when you use our App. Snap AI allows users to generate and edit stories and images using Google's Gemini AI technology.

2. Information We Collect

Depending on how you use the App, we may collect the following:

• Generated Content: Images and stories created or edited through the Gemini AI integration.

• Usage Data: Basic analytics such as app opens, feature usage, and crash reports, if analytics tools are integrated.

• Optional Account Information: If sign-in is offered (e.g., via Google Sign-In or similar), we may receive your name, email address, and profile picture.

We do not intentionally collect sensitive personal information such as financial data, government IDs, or health information.

3. How We Use Your Information

• Generate and edit stories and images via the Gemini AI API.

4. Third-Party Services (Google Gemini AI)

Snap AI uses Google's Gemini AI to process your prompts and generate or edit stories and images. When you submit content for generation or editing:

• Your input (text prompts, images, or other content) is sent to Google's Gemini AI servers for processing.

• Google's own privacy policy and terms govern how Gemini AI processes, stores, and uses this data. We encourage you to review Google's Privacy Policy and Gemini API terms separately.

• We, as the App developer, have no control over how Google's servers process or retain this data beyond what Google discloses publicly.

• We are not responsible for any data handling practices, outages, content filtering decisions, or outputs generated by Google's Gemini AI systems.

5. Data Storage and Security

• We take reasonable measures to protect any data processed through the App, but as an independent developer, we cannot guarantee absolute security.

• Generated stories and images may be stored locally on your device and/or temporarily processed through third-party AI servers (Gemini AI) as described above.

• You are responsible for backing up any content you wish to keep, as the developer is not liable for any loss of generated content due to app updates, uninstalls, device issues, or server-side changes by Google.

6. Data Sharing

We do not sell your personal information. We may share limited data only:

• With Google Gemini AI, as necessary to provide the App's core functionality.

• If required by law, legal process, or to protect the rights, property, or safety of the developer, users, or others.

7. Children's Privacy

8. Your Rights and Choices

PART 2: TERMS AND CONDITIONS

1. Acceptance of Terms

By using Snap AI, you agree to these Terms and Conditions in full. If you disagree with any part, you must stop using the App immediately.

2. About the Developer

Snap AI is created and maintained by a single independent (indie) developer, not a registered company or corporation. Support, updates, and maintenance are provided on a best-effort basis, without guarantees of continuous availability, updates, or support response times.

3. Description of Service

Snap AI allows users to:

• Generate original stories using AI (powered by Google Gemini AI).

• Edit and modify existing stories.

• Generate images based on text prompts using Gemini AI.

• Edit and modify generated or uploaded images.

The App acts as an interface to Google's Gemini AI. All generation and editing capabilities are dependent on Gemini AI's availability, performance, and content policies.

4. User Responsibility – IMPORTANT

You, the User, are solely and fully responsible for:

• Any content, prompts, text, or images you input into the App.

• Any story or image generated, edited, or exported using the App.

• How you use, share, publish, distribute, or monetize any generated content.

• Ensuring that your use of generated content complies with applicable laws, copyright rules, platform policies, and third-party rights in your country/region.

• Reviewing and verifying that generated content is appropriate, accurate, non-infringing, and lawful before any use, sharing, or publication.

The developer does not review, moderate, or pre-screen content generated through Gemini AI. AI-generated content may occasionally be inaccurate, offensive, biased, infringing, or otherwise inappropriate. You use all generated content entirely at your own risk.

5. Prohibited Use

You agree NOT to use Snap AI to:

• Generate illegal, defamatory, obscene, or harmful content.

• Create content that infringes on the intellectual property or rights of others.

• Generate content involving real individuals without consent, or content that violates any person's privacy or dignity.

• Attempt to reverse-engineer, exploit, or misuse the App or the underlying Gemini AI service.

• Violate any applicable local, national, or international law.

Violation of these terms may result in restricted or terminated access to the App, at the developer's discretion.

6. No Warranty / "AS IS" Disclaimer

Snap AI is provided strictly on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.

• Guarantees of uninterrupted, error-free, or secure operation.

• Guarantees regarding the accuracy, quality, legality, or appropriateness of AI-generated content.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• The developer of Snap AI shall NOT be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the App.

• This includes, without limitation, damages related to loss of data, loss of generated content, reputational harm, copyright disputes, legal claims from third parties, financial loss, or any harm resulting from AI-generated stories or images.

• The developer is not responsible for any outputs, errors, biases, or failures originating from Google's Gemini AI service, as this is a third-party service outside the developer's control.

• All risks associated with using the App and its generated content rest solely with the User.

By using Snap AI, you expressly acknowledge and accept that you are using the App and any generated content at your own risk, and you release the developer from any liability arising from such use.

8. Indemnification

You agree to indemnify, defend, and hold harmless the developer of Snap AI from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

• Your use or misuse of the App.

• Content you generate, edit, share, or distribute using the App.

• Your violation of these Terms or any applicable law.

9. Intellectual Property

• You retain rights to the original prompts you provide, subject to Google Gemini AI's own terms of service regarding generated content.

• The App's design, branding, code, and interface (excluding AI-generated outputs) remain the property of the developer.

• Ownership and usage rights of AI-generated content are subject to Google Gemini AI's terms; users should review Google's policies regarding ownership and permitted use of AI-generated outputs.

10. Third-Party Service Dependency

Snap AI relies on Google Gemini AI to function. The developer:

• Does not control Gemini AI's uptime, pricing, policies, or output quality.

• Is not liable for service interruptions, discontinuation, or changes made by Google that affect the App's functionality.

• Reserves the right to modify, suspend, or discontinue features if Gemini AI's availability or terms change.

11. Termination

The developer reserves the right to suspend or terminate your access to Snap AI at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the App, other users, or third parties.

12. Changes to the App and Terms

The developer may update, modify, or discontinue the App or these Terms at any time without prior notice. Continued use of the App after changes are made constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with applicable local laws, without regard to conflict of law principles. Any disputes shall first be attempted to be resolved informally by contacting the developer directly.
