End-User License Agreement (EULA) for Nexus OS

Please read this End-User License Agreement ("EULA") carefully before using the Nexus operating system (the "Software"). By installing or using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not use the Software.

1. Grant of License

Bixler LLC grants you a revocable, non-exclusive, non-transferable, limited license to install and use the Software on a single device owned and controlled by you, and to access and use the Software solely for your personal, non-commercial purposes strictly by the terms of this EULA.

2. No Finality / Beta Software

You agree that the Software is currently under development and may have bugs, errors, or other issues. Nothing in the Software is final, and features, functionalities, and content may be changed, removed, or added at any time without notice. Your use of the Software constitutes your acceptance of its "as-is" nature and its ongoing developmental status.

3. No Warranty / "AS IS" Basis

THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE. You bear the entire risk as to the quality and performance of the Software.

4. Restrictions on Copying and Distribution

You may not copy, reproduce, distribute, publish, display, perform, modify, create derivative works from, transmit, or in any way exploit any part of the Software, except as expressly permitted by this EULA or by applicable law. Unauthorized copying or distribution of the Software is strictly prohibited.

5. EULA Amendments

This EULA may be changed, updated, or modified by Bixler LLC at any time, with or without prior notice to you. Your continued use of the Software after any such changes shows that you accept the new EULA. It is your responsibility to review this EULA periodically for changes.

6. Restrictions on Sale

You may not sell, rent, lease, sublicense, or otherwise transfer the Software to any third party, unless you are a specifically designated and trusted partner of [Your Company Name] with a separate written agreement explicitly permitting such activities.

7. No Reverse Engineering

You are expressly prohibited from, and you agree not to, decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the Software, or any part thereof.

8. Intellectual Property

The Software, including all copyrights, patents, trademarks, trade secrets, and other intellectual property rights associated therewith, is and shall remain the sole and exclusive property of Bixler LLC or its licensors.

9. Termination

This EULA is effective until terminated by you or Bixler LLC. Your rights under this EULA will terminate automatically without notice from Bixler LLC if you fail to comply with any term(s) of this EULA. Upon termination, you shall cease all use of the Software and destroy all copies, full or partial, of the Software.

10. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.

11. Severability

If any provision of this EULA is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

12. Entire Agreement

This EULA constitutes the entire agreement between you and Bixler LLC regarding your use of the Software and supersedes all prior and contemporaneous written or oral agreements between you and Bixler LLC.
