1. General Terms

The services provided by Simple Chat are subject to the following terms of service. These terms may be updated periodically by Simple Chat without prior notice, and any changes to the terms of service for Simple Chat (hereinafter referred to as "Terms of Use") will be posted on the website. Once revised user agreements are posted on the website, they replace the original user agreement.

Before using the services provided by Simple Chat, you should carefully read this agreement. If you do not agree with this Terms of Use or any modifications to it, please immediately stop using all services provided by Simple Chat; once you use Simple Chat's services, it is deemed that you have understood and fully agreed to the content of this Terms of Use, including any modifications made by Simple Chat from time to time, and become a user of Simple Chat (hereinafter referred to as "User").

2. Service Description

The content of this service refers to users uploading tagged images through the Simple Chat platform, supporting features such as creating personal circles, posting discussions, and leaving comments. Unless otherwise explicitly stated in these Terms of Use, any new functions or enhancements to existing services, including the launch of new products, are subject to these Terms of Use. You understand and agree that this service is only provided in its current form, and Simple Chat is not responsible for any issues related to user information or personalized settings, including but not limited to timeliness, deletion, transmission errors, inability to store, etc. Simple Chat reserves the right to suspend any part of this service without prior notice for maintenance, upgrades, or other purposes.

3. Compliance with Laws

You agree to comply with all applicable laws and regulations in your country or region and assume full responsibility for any actions and their consequences carried out using your password and account. If your actions violate the laws and regulations of your country or region, it may constitute a crime, and you will bear full criminal responsibility and legal liability. Additionally, if Simple Chat determines that any of your actions, including but not limited to any statements or other actions, violate or may violate any national laws and regulations, Simple Chat may terminate the provision of services to you at any time without prior notice.

4. Your Registration Obligations

To use this service, you agree to the following: please fill in the correct registration email, password, and name according to the registration prompts provided by this service, and ensure the validity and legality of your future login email. If you provide any illegal, immoral, or information that Simple Chat deems unsuitable for display on Simple Chat; or if Simple Chat has reasonable grounds to suspect that your information belongs to a bot or malicious operation, Simple Chat has the right to suspend or terminate your account and refuse your current and future use of all or part of this service.

Simple Chat is not responsible for any user registration information, including but not limited to verifying the authenticity, accuracy, completeness, applicability, and whether the information is up-to-date.

5. User Account, Password, and Security

After completing the registration process for this service and successfully registering, you can log into your Simple Chat account ("Account") using your email and password. You are responsible for protecting the security of your account. You are fully responsible for all activities that occur under your password and account. You agree to:

- 1) Immediately notify Simple Chat if you discover any unauthorized use of your Simple Chat account or any other security issues;

- 2) Simple Chat cannot and will not be responsible for any losses or damages resulting from your failure to ensure the security of your account and password;

- 3) Each user is fully responsible for all actions and events within their account. If you fail to properly protect your account and password, leading to any loss to you, Simple Chat, or a third party, you will bear full responsibility.

6. Simple Chat Privacy Policy

The email address you provide will be used as registration information to send a password reset link via email when you forget your password and request a password reset. Simple Chat does not retain any other personal information.

7. Supplier Liability

In accordance with relevant laws and regulations, Simple Chat hereby solemnly reminds you: any text, information, materials, music, photos, images, videos, information, or other materials (hereinafter collectively referred to as "Content") published or uploaded through this service, the responsibility rests entirely with the provider of the content. Simple Chat only provides storage space and cannot control the content transmitted through this service, therefore it makes no guarantees regarding the accuracy, completeness, or quality of the content. You acknowledge that using this service may expose you to offensive, inappropriate, or controversial content. Under no circumstances will Simple Chat be responsible for any content, but Simple Chat has the right to legally block the transmission of such content and take appropriate measures, including but not limited to suspending the user's use of all or part of the service, saving relevant records, and reporting to the competent authority.

8. User Conduct

Users agree not to use this service for any illegal or improper activities, including but not limited to the following behaviors:

- 1) Posting or transmitting information containing any of the following content:

  * Violating the basic principles stipulated by the Constitution of the user's location;

  * Endangering national security, leaking state secrets, undermining the state regime, or disrupting national unity;

  * Damaging the honor and interests of the state;

  * Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;

  * Disrupting religious policies, promoting cults and feudal superstitions;

  * Spreading rumors, disrupting social order, or destabilizing society;

  * Spreading obscene, pornographic, gambling, violent, murder, terroristic, or incitement to commit crimes content;

  * Insulting, defaming others, or infringing on their legitimate rights and interests;

  * Containing false, fraudulent, harmful, coercive, privacy-invasive, harassing, infringing, libelous, vulgar, obscene, or morally offensive content;

  * Containing any content restricted or prohibited by laws, regulations, rules, or regulations with legal effect;

- 2) Engaging in any behavior that damages the legitimate rights and interests of others;

- 3) Posting, sending, or otherwise transmitting any content that you know you have no right to transmit based on any law or contractual or statutory relationship (such as internal, proprietary, and confidential information obtained due to employment or confidentiality agreements);

- 4) Posting or otherwise transmitting any content that infringes on another person's copyright, patent, trademark, trade secret, or other proprietary rights (hereinafter collectively referred to as "Proprietary Rights");

- 5) Posting, sending, or otherwise transmitting any advertising information, promotional material, "spam," "junk mail," "chain letters," "pyramid schemes," or any other form of solicitation;

- 6) Posting, sending, or otherwise transmitting any data containing computer viruses or other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or communication equipment;

- 7) Interfering with or disrupting the "Service" or the servers and networks connected to the "Service," or violating any rules, procedures, policies, or regulations of any network connected to the "Service";

- 8) Harassing, abusing, or otherwise bothering others;

- 9) Intentionally or unintentionally violating any applicable local, national laws, or any regulations with legal effect;

- 10) Intercepting, altering, collecting, storing, or deleting another person's personal information, emails, or other data without legal authorization, or using such information for any illegal or improper purpose.

You acknowledge that Simple Chat cannot fully control how users use this service and agree to use any content at your own risk, including relying on the accuracy, completeness, and usefulness of such content without relying on Simple Chat. However, Simple Chat may, at its sole discretion, refuse and delete any content that violates these terms or is offensive to Simple Chat, or content provided through this service that is offensive to Simple Chat.

You understand and agree that if required by law or regulation, or if Simple Chat sincerely believes it necessary to retain or disclose "Content," Simple Chat may retain or disclose "Content" to:

- a) Comply with legal processes;

- b) Enforce this "Terms of Use";

- c) Respond to any third-party claims;

- d) Protect the rights, property, or personal safety of Simple Chat, its users, and the public;

- e) Other situations where Simple Chat deems it necessary.

9. Special Warning for International Use

You understand the borderless nature of the internet and agree to comply with all laws and regulations regarding online behavior and content in your country or region. In particular, you agree to comply with all applicable laws and regulations regarding the export of information from your country or region.

10. Public Information Posted on Simple Chat

- 1) In these Terms of Use, "Public Areas of This Service" refer to areas open to the public;

- 2) Users must ensure that any content they upload or post on Simple Chat is owned by the copyright holder or has been legally authorized, and that the content does not infringe upon the legitimate rights and interests of any third party.

11. Disclaimer

- 1) Users expressly agree that any text, information, materials, music, photos, graphics, videos, messages, or other personal data they upload to the internet are at risk of being replicated, reprinted, or used for other purposes by other organizations or individuals, and these risks are borne by the users. Simple Chat is not responsible for any consequences arising from the user's use of the service.

- 2) Official accounts such as Weibo, Renren, etc., promoting and publishing any text, information, materials, music, photos, images, videos, information, or other personal data related to users do not constitute an infringement of user rights, and Simple Chat is not responsible for such actions.

- 3) Simple Chat will take measures to remove malicious comments reported by users, but does not guarantee the service will meet user requirements and is not responsible for malicious comments.

12. Indemnification

You agree to indemnify and hold harmless Simple Chat and its subsidiaries, affiliates, officers, agents, brand co-owners, or other partners and employees from any claims or demands, including reasonable attorney fees, made by any third party due to or arising out of content you provide, post, or transmit through the service, your connection with the service, your violation of these Terms of Use, or your infringement of any third party rights.

13. Prohibition of Commercial Activities

You agree not to copy, reproduce, duplicate, sell, resell, or exploit for any commercial purpose any part or use of the service or access to the service.

14. General Measures and Restrictions on Use and Storage

You acknowledge that Simple Chat has the right to establish general measures and limitations on the use of the service, including but not limited to the maximum retention period for posted content or other posted content, and the maximum number of times you may use the service within a certain period (the duration of each use). You agree that Simple Chat is not responsible for the deletion or failure to store any messages, communications, or other content transmitted or posted through the service. You also agree that Simple Chat has the right to change these general terms and conditions at any time at its sole discretion, whether or not it notifies you.

15. Modification of Service

Simple Chat has the right to modify or terminate the service (or any part thereof) temporarily or permanently at any time, whether or not it notifies you. You agree that Simple Chat is not responsible to you or any third party for any modification, suspension, or termination of the service.

16. Termination of Service

You agree that Simple Chat may terminate your account or your use of the service (or any part thereof) at any time for any reason, including but not limited to lack of use, or Simple Chat's determination that you have violated the spirit or terms of this Terms of Use. You agree that Simple Chat may, at its sole discretion and without prior notice, stop or terminate your use of the service or close or delete your account and any associated information and files, and you acknowledge that Simple Chat is not responsible to you or any third party for any interruption or termination of your use of the service or closing or deleting your account and any associated information and files.

17. Transactions with Advertisers and Other Third Parties

Any communication or business dealings you engage in with advertisers and other third parties through this site, including payment and delivery of goods and services, and any other terms, conditions, warranties, or representations associated with such transactions, are solely between you and the advertiser or other third party. Simple Chat is not responsible for any loss or damage of any kind arising from any such transaction or from the presence of advertisers or other third parties on the site.

18. Simple Chat's Proprietary Rights

You understand and agree that the service and the software related to the service ("Software") contain proprietary and confidential information protected by relevant intellectual property and other laws. You also understand and agree that the content included in sponsored advertisements or information provided through the service or advertisers is protected by copyrights, trademarks, service marks, patents, or other proprietary rights. Without the express authorization of Simple Chat or the advertiser, you may not modify, rent, lease, lend, sell, distribute any part or all of the Software, or use the Software in unmodified form for unauthorized purposes. Simple Chat grants you a personal, non-transferable, non-exclusive right to use the object code of the Software on a single computer, but you may not (and may not allow any third party to) copy, modify, create derivative works, reverse engineer, decompile, or otherwise discover the source code of the Software, or sell, transfer, sublicense, or encumber any rights to the Software or any rights therein. You agree to use the service through interfaces provided by Simple Chat and not through any other means.

19. Warranties and Guarantees

You expressly understand and agree:

- 1) Nothing in these Terms of Use is intended to exempt Simple Chat from liability for personal injury or property damage caused to you by Simple Chat, whether intentional or due to gross negligence;

- 2) You use the service at your own risk. The service is provided "as is" and "as available," and Simple Chat makes no express or implied warranties or guarantees, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights;

- 3) Simple Chat does not warrant the following:

  * The service will meet your requirements;

  * The service will be uninterrupted, timely, secure, or error-free;

  * The results obtained from using the service will be accurate or reliable;

  * Any product, service, information, or other material purchased or obtained through the service will meet your expectations;

- 4) You are responsible for any mobile device damage or data loss resulting from downloading any information, and you should consider the risks when downloading any information;

- 5) Unless otherwise specified in these Terms of Use, any advice or information obtained by you from Simple Chat or through the service does not constitute any warranty not explicitly stated in these Terms of Use;

- 6) If Simple Chat and/or its partner organizations use your likeness, name, or other legal rights, you agree to authorize Simple Chat and/or its partner organizations to use your likeness, name, and/or other legal rights.

20. Limitation of Liability

You expressly understand and agree that Simple Chat is not responsible for any direct, indirect, incidental, special, consequential, or punitive damages (including but not limited to loss of profit, reputation, applications, data, or other intangible losses) arising from or related to:

- 1) Use or inability to use the service;

- 2) Costs incurred from replacing any goods, data, information, services, received messages, or transactions associated with the service;

- 3) Unauthorized access or alteration of your transmissions or data;

- 4) Any statement or conduct of any third party related to the service;

- 5) Any matter related to the service, unless otherwise explicitly stated in these Terms of Use;

- 6) Economic losses caused to users by fraudulent information or inducements from third parties, for which Simple Chat is not responsible.

21. Simple Chat Trademark Information

Without the prior written consent of Simple Chat, you may not display, use, or otherwise handle Simple Chat trademarks, logos, product or service names, or indicate that you have the right to display, use, or otherwise handle Simple Chat marks.

22. User Proprietary Rights

Simple Chat respects the intellectual property rights of others and encourages users to do the same.

The service and materials provided by Simple Chat are provided "as is," and Simple Chat expressly disclaims any rights to the service, materials, or products. Simple Chat expressly disclaims any express or implied warranties, including but not limited to warranties of merchantability and fitness for a particular purpose. Simple Chat is not responsible for any direct, indirect, incidental, or consequential damages arising from the use of the service, materials, or products.

If you infringe on the intellectual property rights of others, Simple Chat will remove the relevant content or even terminate your account in accordance with national laws, regulations, or service terms and related management provisions.

Simple Chat respects the rights of others (including intellectual property rights) and requires our users to respect the rights of others. Simple Chat may, at its sole discretion and as appropriate, terminate the account of a user who infringes or violates the rights of others.

23. Permission Statements

Simple Chat needs certain permissions to function properly. The following permissions, if not granted, will affect the use of the service.

- 1) android.permission.GET_TASKS

  Purpose: Allows the app to retrieve information about currently running tasks.

  Note: Typically used to check if the app is running in the foreground.

- 2) android.permission.WRITE_EXTERNAL_STORAGE

  Purpose: Allows the app to write to external storage (e.g., SD card).

  Note: Used for saving files, images, etc.

- 3) android.permission.READ_MEDIA_IMAGES

  Purpose: Allows the app to read media images.

  Note: Applicable to Android 13 and above.

- 4) android.permission.READ_MEDIA_AUDIO

  Purpose: Allows the app to read media audio.

  Note: Applicable to Android 13 and above.

- 5) android.permission.READ_MEDIA_VIDEO

  Purpose: Allows the app to read media video.

  Note: Applicable to Android 13 and above.

- 6) android.permission.READ_MEDIA_VISUAL_USER_SELECTED

  Purpose: Allows the app to read user-selected visual media content.

  Note: Applicable to Android 14 and above.

- 7) android.permission.INTERNET

  Purpose: Allows the app to access the internet.

  Note: Essential for network communication.

- 8) android.permission.CAMERA

  Purpose: Allows the app to use the camera.

  Note: Used for taking photos, video calls, etc.

- 9) android.permission.VIBRATE

  Purpose: Allows the app to control vibration.

  Note: Used for alerts, notifications, etc.

- 10) android.permission.RESTART_PACKAGES

  Purpose: Allows the app to restart other apps.

  Note: Not commonly used, may require special permissions.

- 11) android.permission.RECORD_AUDIO

  Purpose: Allows the app to record audio.

  Note: Used for voice calls, recording, etc.

- 12) android.permission.WAKE_LOCK

  Purpose: Allows the app to keep the CPU awake.

  Note: Used for background tasks, push notifications, etc.

- 13) android.permission.FOREGROUND_SERVICE

  Purpose: Allows the app to create a foreground service.

  Note: Applicable to Android 9.0 and above.

- 14) android.permission.USE_FULL_SCREEN_INTENT

  Purpose: Allows the app to use full-screen intents in notifications.

  Note: Used for displaying important notifications.

- 15) android.permission.POST_NOTIFICATIONS

  Purpose: Allows the app to send notifications.

  Note: Applicable to Android 13 and above.

- 16) android.permission.FOREGROUND_SERVICE_REMOTE_MESSAGING

  Purpose: Allows the app to create a remote messaging foreground service.

  Note: Applicable to Android 14 and above.

- 17) android.permission.ACCESS_NETWORK_STATE

  Purpose: Allows the app to access network state information.

  Note: Used for checking network connection status.

- 18) android.permission.ACCESS_WIFI_STATE

  Purpose: Allows the app to access Wi-Fi state information.

  Note: Used for detecting Wi-Fi connection status.

- 19) android.permission.BLUETOOTH

  Purpose: Allows the app to use Bluetooth.

  Note: Used for Bluetooth communication.

24. General Terms

- 1) These Terms of Use, Community Guidelines, and Disclaimer constitute the entire agreement between you and Simple Chat and govern your use of the service. You also agree to comply with any additional terms and conditions applicable to your use of services, content, or software provided by third parties;

- 2) These Terms of Use and your relationship with Simple Chat are governed by the laws of the People's Republic of China. Any disputes arising between you and Simple Chat due to the service, these Terms of Use, or other related matters shall first be resolved through friendly negotiations. If negotiations fail, the disputes shall be submitted to arbitration by the China International Economic and Trade Arbitration Commission, whose arbitral award shall be binding on both parties;

- 3) Simple Chat's failure to exercise or enforce any right or provision of these Terms of Use does not constitute a waiver of such right or provision;

- 4) If any provision of these Terms of Use is found invalid due to conflict with the laws of the People's Republic of China, you still agree to endeavor to achieve the intent reflected in such provision to the extent permitted by law, and the remaining provisions of these Terms of Use shall remain fully effective;

- 5) The headings in these Terms of Use are for convenience only and have no legal or contractual effect;

- 6) Logging into Simple Chat indicates that you acknowledge and agree to all the terms set forth above;

- 7) Simple Chat reserves the final interpretation rights of this agreement.
