Please read these Terms of Use ("Terms") carefully before using the e Signature Scanner & Creator mobile application (the "App") operated by Tilak Shakya ("we," "our," or "us").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Use of the App
1.1 License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or business use, subject to these Terms and the Apple Media Services Terms and Conditions.
1.2 Acceptable Use
You agree to use the App only for lawful purposes. You shall not:
- Use the App to forge, fabricate, or falsify signatures for fraudulent or illegal purposes.
- Use the App to sign documents without proper authorization.
- Reproduce, distribute, or create derivative works based on the App.
- Reverse engineer, decompile, or disassemble the App.
- Use the App in any manner that could damage, disable, or impair the App.
1.3 User Responsibility
You are solely responsible for:
- The legality and authenticity of signatures you create and apply using the App.
- Ensuring that you have the legal authority to sign documents using electronic signatures in your jurisdiction.
- The content of any documents you sign, share, or export using the App.
- Maintaining backups of your important documents and signatures.
2. Electronic Signatures Disclaimer
The App is a tool for creating and applying electronic signatures to documents. We make no representations or warranties regarding:
- The legal validity or enforceability of electronic signatures created with the App in any jurisdiction.
- The acceptance of electronic signatures by any third party, government agency, or institution.
- Compliance with specific electronic signature laws such as ESIGN, UETA, eIDAS, or any other local, state, national, or international regulations.
You should consult with a legal professional to determine whether electronic signatures are appropriate and legally binding for your specific use case.
3. Subscriptions and Payments
3.1 Free and Premium Features
The App offers both free and premium features. Some features require an active subscription to access.
3.2 Subscription Terms
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
3.3 Refunds
All purchases are processed by Apple. Refund requests must be submitted through Apple's standard refund process. We do not process refunds directly.
4. Intellectual Property
4.1 App Ownership
The App, including its design, features, code, and content, is owned by Tilak Shakya and is protected by intellectual property laws. All rights not expressly granted in these Terms are reserved.
4.2 Your Content
You retain ownership of all signatures, documents, and other content you create or import using the App. We do not claim any ownership rights over your content.
5. Privacy

6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will meet your specific requirements.
- The App will be uninterrupted, timely, secure, or error-free.
- The results obtained from using the App will be accurate or reliable.
- Any errors in the App will be corrected.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TILAK SHAKYA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Tilak Shakya from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of any third party.
9. Termination
We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the App will immediately cease.
10. Changes to These Terms
We may update these Terms from time to time. Any changes will be reflected by updating the "Last Updated" date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
