These Terms of Use ("Terms") constitute a legal agreement between you ("User", "you", or "your") and ShoSharp Point of Sale ("ShoSharp POS", "we", "us", or "our") governing your use of the ShoSharp POS mobile application ("App", "Application", or "Service").
BY INSTALLING, ACCESSING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE APP AND MUST IMMEDIATELY UNINSTALL IT FROM YOUR DEVICE.
You must be at least 18 years of age (the legal age of majority in South Africa) to use this App. By using the App, you represent and warrant that you meet this age requirement.
This App is designed for business and commercial use. You represent that you have the authority to conduct business operations and manage business data.
You represent that you have the legal capacity to enter into this agreement and that your use of the App does not violate any applicable laws or regulations.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for lawful business purposes on devices you own or control.
You may NOT:
Copy, modify, or reverse engineer the App.
Remove any proprietary notices or trademarks.
Use the App for any unlawful purpose.
Extract or harvest data through automated means (scraping).
You are responsible for maintaining the security of your device (e.g., using biometrics or PIN locks). You are solely responsible for all activities conducted through your installation of the App.
You are responsible for the accuracy of all data entered, including product pricing and VAT calculations. You must ensure your business remains compliant with South African tax laws (SARS requirements).
Local Storage: You acknowledge that ShoSharp POS stores data locally on your device.
Your Responsibility: You are solely responsible for backing up your business data. We recommend regular use of the Excel export feature.
No Liability: We are not liable for any data loss, corruption, or hardware failure that results in the loss of your business records.
As the user of this POS system, you are the "Responsible Party" (as defined by the Protection of Personal Information Act) regarding your own customers' data. You agree to handle your customers' information in compliance with POPIA.
Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference. This includes the collection of anonymous analytics to improve service and the use of location services if permission is granted.
All software code, UI designs, and logos are owned exclusively by ShoSharp POS. You retain ownership of your specific business data (products, sales records, and customer lists).
The App is provided "AS IS" without warranties of any kind. We do not guarantee that the App will be error-free or uninterrupted.
ShoSharp POS is a functional tool. It does not provide legal, financial, or tax advice. Please consult with a qualified South African accountant or tax practitioner regarding your business filings.
While we strive for precision, you are responsible for verifying all VAT calculations and financial summaries before submitting them for official or legal purposes.
To the maximum extent permitted by South African law, ShoSharp POS shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.
Our total liability to you for all claims shall not exceed:
The amount you paid for the App (if any), OR
R1,500.00 (One Thousand Five Hundred South African Rand), whichever is greater.
The App displays third-party advertisements. You interact with these ads at your own risk. You may watch reward videos to remove ads temporarily (12 hours); this feature is provided "as-is" and may be modified at any time.
We may modify these Terms at any time. Your continued use constitutes acceptance. You may terminate this agreement by uninstalling the App. We may terminate your access if you violate these Terms or engage in fraudulent activity.
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
You consent to the exclusive jurisdiction of the courts located in South Africa for any legal action arising from these Terms.
