1. Interpretation and Definitions
Interpretation
The words with the initial letter capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.
Definitions
For the purposes of these Terms and Conditions:
Application means the software program "Say It Loud" provided by the Company downloaded by You on any electronic device.
Application Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) in which the Application has been downloaded.
Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to the developer of the Say It Loud application.
Country refers to: Poland.
Device means any device that can access the Service such as an iPhone or iPad.
In-App Purchase refers to the purchase of a Subscription made through the Application and subject to these Terms and Conditions and/or the Application Store’s own terms and conditions.
Service refers to the Application.
Subscription refers to the access to premium features of the Service offered on a subscription basis by the Company to You.
Terms and Conditions (also referred to as “Terms”) mean these Terms of Use that form the entire agreement between You and the Company regarding the use of the Service.
User-Generated Content refers to any content, such as video or audio recordings, that is created by You through the use of the Application’s features.
You means the individual accessing or using the Service.
2. Acknowledgment
These are the Terms and Conditions governing the use of this Service. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part of these Terms, then You may not access the Service.
You represent that you are over the age of 13. The Company does not permit those under 13 to use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with our Privacy Policy. Please read Our Privacy Policy carefully before using Our Service.
3. Subscriptions and In-App Purchases
Some features of the Service are available only through a paid Subscription. You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the subscription plan you select.
At the end of each period, Your Subscription will automatically renew under the exact same conditions unless You cancel it through Your Application Store account settings or the Company cancels it. All In-App Purchases are processed through the Application Store, and you can manage them through your Application Store account.
4. User-Generated Content and Conduct
The Application allows You to optionally record your gameplay, which includes video from your device's camera and audio from your microphone ("User-Generated Content").
You are solely responsible for the User-Generated Content you create. By using the recording feature, you agree not to create any content that is unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable.
The Company does not monitor or control the User-Generated Content created and saved locally on your device. However, you are responsible for ensuring that your content complies with applicable laws and the terms of any social media platforms where you may choose to share it.
5. Intellectual Property
The Service and its original content (excluding User-Generated Content), features, and functionality are and will remain the exclusive property of the Company and its licensors.
6. Links to Other Websites
Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.
7. Termination
We may terminate or suspend Your access to the Service immediately, without prior notice, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Company be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to your use of or inability to use the Service.
9. Governing Law
The laws of the Country, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service.
10. Disputes Resolution
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.
11. Severability and Waiver
Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver: Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
12. Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms and Conditions within the Application or on our support website.
