RUNGEAR TERMS OF USE

Welcome to RunGear (the "App"). These Terms of Use constitute a legally binding agreement between you and Jeremy Lobo ("Developer"), based in Ontario, Canada. By accessing or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, purchasing a subscription, or using the App in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our accompanying Privacy Policy.
2. Eligibility
You must be at least thirteen (13) years of age to use this App. If you are under the age of majority in Ontario (18 years old), you represent that you have reviewed these Terms with your parent or legal guardian.
3. Subscriptions, In-App Purchases, and Billing
The App offers free features and premium paid features (e.g., customizing temperature ranges in the Outfit Guide). Paid subscriptions are processed via third-party platforms (e.g., Apple App Store). Subscriptions auto-renew unless cancelled at least 24 hours before the end of the billing cycle. All purchases are non-refundable except as required by local consumer protection laws.
4. Weather Data and Accuracy Disclaimer
RunGear sources meteorological data from Open-Meteo and geographic data via OpenStreetMap/Nominatim. Weather forecasting is inherently unpredictable. We do not guarantee the accuracy or timeliness of weather information. You rely on weather data entirely at your own risk.
5. Health, Safety, and Athletic Performance Warning
⚠️ RunGear is an informational tool, not a medical or professional training application. Clothing suggestions are guidelines, not rules. You are solely responsible for monitoring your own body temperature, hydration, and physical limits. You assume all risks associated with outdoor running, including heatstroke, dehydration, hypothermia, frostbite, or sudden illness.
6. Artificial Intelligence and Automated Features
The App utilizes AI deployment mechanisms via the Base44 platform. You acknowledge that automated systems can occasionally experience anomalies, and agree that the Developer is not liable for issues generated via automated AI workflows.
7. Intellectual Property
All rights in and to the App — including code, UI designs, clothing engine algorithms, and branding ("RunGear") — are the exclusive property of Jeremy Lobo. You are granted a limited, non-exclusive, revocable license for personal, non-commercial use.
8. Prohibited Use
You agree not to reverse-engineer the App, bypass paid paywalls, use the App to harass or disrupt services, or use automated bots to harvest data from our platform.
9. Privacy and Account Deletion
We collect minimal location data and local configuration settings to provide accurate clothing recommendations. You may permanently delete your account at any time via Settings > Account > Delete Account.
10. Disclaimers
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND. THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
To the maximum extent permitted by Ontario law, Jeremy Lobo shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App.
12. Indemnification
You agree to defend, indemnify, and hold harmless Jeremy Lobo from any claims, liabilities, or fees arising out of your violation of these Terms or misuse of the App.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Ontario and Canada. Any legal proceedings shall be brought exclusively in Toronto, Ontario, Canada.
14. Changes to the App and Terms
We reserve the right to modify or discontinue any feature of the App at any time. Continued use following updates constitutes acceptance of the modified Terms.
15. Third-Party Services
The App integrates with Apple App Store ecosystems, Open-Meteo API, and the Base44 platform. We do not control or assume responsibility for third-party uptime or privacy practices.
16–17. Severability & Entire Agreement
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms and the Privacy Policy constitute the entire agreement between you and Jeremy Lobo regarding RunGear.
