It also describes the choices available to you regarding our use of your Personal Information and how you can access and update it.

General provisions
ReqQuest is a mobile application for finding service providers near you, as well as for finding clients for your services.

This Terms is a legally binding agreement between you (“User”, “you” or “your”) and this Mobile Application developers (“Developers”, “we”, “us” or “our”). If you are entering into this Terms on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Terms, in which case the terms “User”, “you” or “your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Terms, you must not accept this Terms and may not access and use the Mobile Application and Services. By accessing and using the Mobile Application and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Terms. This Terms does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

Unless otherwise stated, ReqQuest developers own the intellectual property rights for all material on ReqQuest. All intellectual property rights are reserved. You may access to ReqQuest for your own personal use subjected to restrictions set in these terms and conditions.

You must not: (i) Republish material from ReqQuest; (ii) sell, rent or sub-license material from ReqQuest; (iii) reproduce, duplicate or copy material from ReqQuest; (iv) redistribute content from ReqQuest.

This Agreement shall begin on the date hereof.

Parts of this app offer an opportunity for users to post and exchange messages and information in certain areas of the Mobile Application. ReqQuest does not filter, edit, publish or review messages prior to their presence in the Mobile Application. Messages do not reflect the views and opinions of ReqQuest, its developers. Messages reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, ReqQuest shall not be liable for the messages or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the messages in the Mobile Application.

Requesters and Performers in the Mobile application are not employees of ReqQuest and in no way represent the interests of the developers. The Mobile Application developers are not responsible for any user actions or lack of such actions.

The developers of the Mobile Application are not responsible for the timeliness, quality and good faith of the services provided, just as the developers are not responsible for the level and timeliness of payment for the services rendered.

Users of the mobile application act in accordance with the agreements concluded between themselves at their own risk and taking into account their own responsibility.

The mobile application offers users to leave an honest assessment of cooperation on a 10-point scale.

The mobile application does not collect any money from users for posting standard requests and for answers on such requests. Any third-party links to receive such payments are fraudulent activities of third parties.

ReqQuest reserves the right to monitor all messages and to remove any messages which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.

You warrant and represent that: (i) you are entitled to post the messages in the Mobile Application and have all necessary licenses and consents to do so; (ii) the messages do not invade any intellectual property right, including without limitation copyright, patent or trademark of any third party; (iii) the messages do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material which is an invasion of privacy; (iv) the messages will not be used to solicit or promote unlawful activity.

You hereby grant ReqQuest a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your messages in any and all forms and formats.

Automatic collection of information

When you use the Mobile Application, our servers automatically record information that your device sends. This data may include information such as your device’s location, language preferences, information you search for in the Mobile Application, User registration times and dates, messages times and dates and other statistics.

Information collected automatically is used only to identify potential cases of abuse and establish statistical information regarding the usage of the Mobile Application and Services. This statistical information is not otherwise aggregated in such a way that would identify any particular User of the system.

Collection of personal information

You can access and use the Mobile Application and Services without telling us your real name or revealing any information by which someone could identify you as a specific, identifiable individual. However, you can provide some Personal Information (for example, your name, phone number and e-mail address) to use the features offered in the Mobile Application (for example, e-mail notifications).

We receive and store any information you knowingly provide to us when you create an account, publish content, or fill any forms in the Mobile Application. When required, this information may include the following: (i) account details (such as user name, password, photo etc); (ii) contact information (such as email address, phone number, etc); (iii) geolocation data of your device (such as latitude and longitude).

You can choose not to provide us with your Personal Information, but then you may not be able to take advantage of some of the features in the Mobile Application. Users who are uncertain about what information is mandatory are welcome to contact us.

If you are under the age of 16, please do not submit any Personal Information through the Mobile Application and Services. If you have reason to believe that a child under the age of 16 has provided Personal Information to us through the Mobile Application and Services, please contact us to request that we delete that child’s Personal Information from our Services.

We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Terms by instructing their children never to provide Personal Information through the Mobile Application and Services without their permission. We act as a data controller and a data processor when handling Personal Information.

Our role may also differ depending on the specific situation involving Personal Information. We act in the capacity of a data controller when we ask you to submit your Personal Information that is necessary to ensure your access and use of the Mobile Application and Services. In such instances, we are a data controller because we determine the purposes and means of the processing of Personal Information.

We act in the capacity of a data processor in situations when you submit Personal Information through the Mobile Application and Services. We do not own, control, or make decisions about the submitted Personal Information, and such Personal Information is processed only in accordance with your instructions. In such instances, the User providing Personal Information acts as a data controller.

In order to make the Mobile Application and Services available to you, or to meet a legal obligation, we may need to collect and use certain Personal Information. If you do not provide the information that we request, we may not be able to provide you with the requested services. Any of the information we collect from you may be used for the following purposes: (i) create and manage user accounts; (ii) send administrative information; (iii) send product and service update; (iv) respond to inquiries and offer support; (v) request user feedback; (vi) enforce terms and conditions and policies; (vii) protect from abuse and malicious users; (viii) respond to legal requests and prevent harm; (ix) run and operate the Mobile Application and Services.

Contact information (such as email address and phone number) can be made visible or hidden from other Users of the Mobile Application depending on your preferences. User name and photo will be visible to all Mobile Application Users. User password and geolocation data are not available to other Users of the Mobile Application.

Processing your Personal Information depends on how you interact with the Mobile Application and Services, where you are located in the world and if one of the following applies: (i) you have given your consent for one or more specific purposes; (ii) provision of information is necessary for the performance of this Terms; (iii) processing is necessary for compliance with a legal obligation to which you are subject; (iv) processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in us; (v) processing is necessary for the purposes of the legitimate interests pursued by us or by a third party. We may also combine or aggregate some of your Personal Information in order to better serve you and to improve and update our Mobile Application and Services.

The Mobile Application and Services contain links to other resources that are not owned or controlled by us. Please be aware that we are not responsible for the privacy practices of such other resources or third parties. We encourage you to be aware when you leave the Mobile Application and Services and to read the privacy statements of each and every resource that may collect Personal Information.

Content Liability

We shall not be hold responsible for any content that appears on your App. You agree to protect and defend us against all claims that is rising on our App. No link(s) should appear in the Mobile application that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our App. You approve to immediately remove all links to our App upon request. In the event we become aware that the security of the Mobile Application and Services has been compromised or Users’ Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, we will make reasonable efforts to notify affected individuals if we believe that there is a reasonable risk of harm to the User as a result of the breach or if notice is otherwise required by law. When we do, we will post a notice in the Mobile Application, send you an email.

We reserve the right to modify this Terms or its terms related to the Mobile Application and Services at any time at our discretion. When we do, we will revise the updated date at the bottom of this page, post a notification in the Mobile Application. We may also provide notice to you in other ways at our discretion, such as through the contact information you have provided.

An updated version of this Terms will be effective immediately upon the posting of the revised Terms unless otherwise specified.
