1. Acceptance of Terms

By downloading, installing, or using the Rememberly mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Rememberly is a birthday reminder application that helps you remember and celebrate important dates. The App provides:

• Birthday storage and notifications

• Contact and calendar import

• AI-powered birthday wish generation (Premium)

• Photo attachments for birthday entries

• iCloud sync across devices (Premium)

• Instagram sharing (Premium)

• Quick money transfer links to Kaspi.kz and Halyk Bank (Kazakhstan only)

3. Free vs. Premium Features

3.1 Free Features

• Unlimited birthday storage

• Local notifications

• Contact and calendar import

• Photo attachments

• Limited AI wish generation (10 wishes per day)

3.2 Premium Features

Premium subscription unlocks:

• Unlimited AI birthday wish generation

• Instagram Stories sharing

• iCloud backup and sync across devices

• Advanced reminders (1-7 days before)

• Custom app icons

• Priority support

4. Subscriptions and Payments

4.1 Subscription Types

Monthly Premium Subscription:

• Billing: Monthly auto-renewable subscription

• Price: Varies by region (displayed in the App)

• Renewal: Automatically renews each month unless cancelled

• Cancellation: Can be cancelled anytime through App Store Settings

Lifetime Premium:

• Billing: One-time payment

• Price: Varies by region (displayed in the App)

• Access: Permanent access to all Premium features

• No recurring charges

4.2 Payment Processing

• All payments are processed through Apple's In-App Purchase system

• We do not store or have access to your payment information

• Prices are determined by Apple and may vary by region

• Prices include applicable taxes as required by law

4.3 Free Trials

• Free trials (if offered) are available to new subscribers only

• You will be charged when the trial period ends unless you cancel before the trial ends

• Cancel through App Store Settings at least 24 hours before trial ends

4.4 Refunds

• Refund requests are handled by Apple according to their refund policy

• Contact Apple Support for refund requests

• We cannot process refunds directly

4.5 Auto-Renewal

• Monthly subscriptions automatically renew unless cancelled at least 24 hours before the current period ends

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• Manage subscriptions and turn off auto-renewal in App Store Settings

5. AI Wish Generation

5.1 Service Description

• AI wishes are generated using Anthropic's Claude API

• Wishes are personalized based on name, age, and optional custom prompts

• Generation is subject to daily limits for free users

5.2 Content Disclaimer

• AI-generated content is provided "as is"

• We do not guarantee the accuracy, appropriateness, or quality of generated content

• Generated wishes are for personal use only

• You are responsible for reviewing content before sharing

5.3 Data Usage

• Only name, age, and custom prompt are sent to the AI service

• Generated content is not stored or logged

• All AI requests are processed securely over HTTPS

6. Send Gift Feature (Kazakhstan Only)

6.1 Important Disclaimer

Rememberly DOES NOT process payments or handle money transfers.

The "Send Gift" feature:

• Opens Kaspi.kz or Halyk Bank mobile apps using deep links

• Pre-fills recipient phone number only

• Does not access, store, or process any financial information

• Does not charge any fees or commissions

6.2 User Responsibility

• All money transfers are processed entirely by Kaspi.kz or Halyk Bank

• You are responsible for verifying recipient information

• Transaction fees and limits are set by the respective banks

• Rememberly is not responsible for failed, delayed, or incorrect transfers

6.3 Requirements

• Requires Kaspi.kz or Halyk Bank app installed on device

• Only available in Kazakhstan

• Requires active account with the respective bank

7. User Responsibilities

You agree to:

• Provide accurate information when using the App

• Use the App only for lawful purposes

• Not attempt to reverse engineer or hack the App

• Not use the App to spam or harass others

• Comply with all applicable laws and regulations

You agree NOT to:

• Share your account with others

• Use the App for commercial purposes without permission

• Attempt to bypass payment systems

• Use AI-generated content for harmful purposes

• Misuse the "Send Gift" feature for fraud or scams

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy, available at: https://sites.google.com/view/rememberly-ios

Key points:

• All data is stored locally on your device

• iCloud sync (Premium) stores data in your personal iCloud account

• We do not sell or share your personal information

• AI requests are processed securely and not logged

9. Intellectual Property

9.1 App Ownership

• Rememberly and all associated content are owned by Alisher Sattarbek

• The App is licensed to you, not sold

• You may not copy, modify, distribute, or reverse engineer the App

9.2 User Content

• You retain ownership of any photos or content you add to the App

• You grant us permission to store and display your content within the App

• AI-generated wishes become your property upon generation

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose

• Accuracy or reliability of notifications

• Availability or uptime of the service

• Compatibility with all devices or iOS versions

• Accuracy of AI-generated content

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Missed birthday notifications or reminders

• Data loss (you should maintain backups)

• Inaccurate or inappropriate AI-generated content

• Issues with third-party services (Kaspi, Halyk Bank, Instagram, iCloud)

• Indirect, incidental, or consequential damages

12. iCloud Sync

12.1 Premium Feature

• iCloud sync is available to Premium subscribers only

• Requires iCloud account and sufficient storage space

• Data is stored in your personal iCloud, not on our servers

12.2 Sync Disclaimer

• We are not responsible for iCloud service availability

• Sync conflicts are resolved using the most recent data

• You are responsible for maintaining iCloud storage space

13. Third-Party Services

The App integrates with third-party services:

Apple Services:

• iCloud for data sync (Premium)

• In-App Purchases for subscriptions

• Contacts and Calendar for data import

AI Service:

• Anthropic Claude API for wish generation

Banking Apps (Kazakhstan):

• Kaspi.kz

• Halyk Bank

Social Media:

• Instagram (for sharing)

• WhatsApp, Telegram (for sharing)

We are not responsible for the availability, privacy practices, or terms of use of these third-party services.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by:

• Updating the "Last Updated" date

• Posting a notice in the App

• Sending a notification (if applicable)

Your continued use of the App after changes constitutes acceptance of the updated Terms.

15. Termination

15.1 By You

You may stop using the App at any time by:

• Uninstalling the App from your device

• Cancelling your subscription (if applicable)

15.2 By Us

We may terminate or suspend your access if you:

• Violate these Terms

• Use the App for fraudulent purposes

• Abuse or misuse App features

15.3 Effect of Termination

• Your right to use the App immediately ceases

• Paid subscriptions may continue until the end of the billing period

• You may request data export before termination

16. Geographic Restrictions

• The "Send Gift" feature is only available in Kazakhstan

• Banking integrations (Kaspi, Halyk) only work in Kazakhstan

• The App is available worldwide for other features

• Subscription pricing may vary by region

17. Children's Use

The App is not directed to children under 13. If you are under 13, please do not use the App or provide any personal information.

18. Governing Law

These Terms are governed by the laws of Kazakhstan, without regard to conflict of law principles.

19. Dispute Resolution

Any disputes arising from these Terms or use of the App should be resolved through:

23. Apple-Specific Terms

23.1 Acknowledgment

You acknowledge that:

• These Terms are between you and Alisher Sattarbek, not Apple

• Apple is not responsible for the App or its content

• Apple has no obligation to provide support for the App

23.2 Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

23.3 Standard Apple EULA

The App also uses Apple's Standard End User License Agreement (EULA), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

24. Consent

By using Rememberly, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
