Both law is at the same level of power. Under the Building Act, is Building Regulation. Under the Building Regulation, is the Australia Standard.
If we design a public building, we must design for people with disability and avoid discrimination.

Infringe Building Regulation? Apply for Report & Consent
Background:
In Australia, the Australian Government governs building safety using the Building Act.
There are six states and two territories in Australia. States such as Victoria, New South Wales, Tasmania... for the full list, Google it.
Each state governs building safety with its Building Regulation. In the State of Victoria where we do most of the design works, the Building Regulation can be found here:

Always refer to the latest building regulation.
What’s Report and Consent:
Building regulation governs different aspects of the building to achieve a safe outcome. For architects, over focus includes Setbacks, Building height, and the like. Refer to the image.
If the design infringes these regulations and if infringement do not impact on the amenity of the subject site AND the neighbour, then we apply with Council for approval.
Report and Consent is the process to seek Council approval.
Checklist of information to submit with Council:
Drawings to show exactly what the infringement is.
Report and Consent report based on Minister Guidelines. Express the reasons why the infringement do not impact on the neighbour’s amenity.
The report MUST base on Minister Guidelines.
Report and consent siting variation application form. (Google from the relevant Council)
Adjoining/Nearby Property Owners Comments.
Payment form with credit card details
Certificate of Tile
Plan of subdivision (Copy of Plan)
Copy of ALL covenant and caveat on the Certificate of Title.
Smoke Alarms
Domestic house requires smoke alarm. It's alarms residence early, allowing early escape if there is a fire.

Swimming Pool Fences
In Australia, all swimming pool requires fence around. This avoids children drowning causing injury or death.
Australia Standard 1926.1 shows the details how to install the fence, and the fence requirements.
Our task is to show the location of the fence. Show the fence clear from trees and other climbable structures around.
