Welcome to RAINSOUNDS apps, owned and operated by RAIN SOUNDS. By using the Application, you agree to be bound by these terms of use (the "Terms").

Acceptance of Terms

1. By using the Application, you agree to these Terms. If you do not agree to these Terms, you should not use the Application.

Changes to Terms

2. The Company reserves the right to change these Terms at any time without notice to you. Your continued use of the Application after any changes to the Terms indicates your acceptance of the changes.

Use of the Application

3. You may use the Application only for lawful purposes and in accordance with these Terms. You agree not to use the Application:

• In any way that violates any applicable federal, state, local, or international law or regulation

• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation

• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity

• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Application, or which, as determined by the Company, may harm the Company or users of the Application or expose them to liability

User Content

4. The Application may allow you to upload or submit content, including but not limited to text, images, and videos (collectively, "User Content"). By uploading or submitting User Content, you represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to use and authorize the Company to use the User Content in the manner contemplated by the Application and these Terms

• The User Content does not infringe on any third-party rights, including intellectual property rights, privacy rights, or publicity rights

• The User Content does not violate any applicable law or regulation

You retain all ownership rights in your User Content, but you grant the Company a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, reproduce, modify, distribute, and display your User Content on and through the Application.

The Company has the right, but not the obligation, to monitor, edit, or remove any User Content that it determines in its sole discretion violates these Terms or is otherwise objectionable.

Intellectual Property

5. The Application and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by the Company or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Application without the prior written consent of the Company, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials

• You may store files that are automatically cached by your Web browser for display enhancement purposes

• You may print or download one copy of a reasonable number of pages of the Application for your own personal, non-commercial use and not for further reproduction, publication, or distribution

If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, and not for further reproduction, publication, or distribution.
