Qwellart Technologies ("we", "our", or "us") operates the NTSA Theory Test mobile application (the "App"). This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use our App.
By downloading, installing, or using the NTSA DRIVERS & RIDERS EXAMS App, you agree to the collection and use of information in accordance with this policy. If you do not agree with the terms of this Privacy Policy, please do not use the App.
This policy applies to all users of the App in East Africa and beyond.
When you create an account or use our services, we collect:
Full name (optional)
Email address (required for account creation)
Phone number (required for M-Pesa payments)
M-Pesa transaction details and payment history
When you use the App, we automatically collect:
Device information (device type, operating system version)
App usage data (exam scores, question attempts, session duration)
Log data (access times, app features used)
Internet connection status
For M-Pesa payments, we collect:
Phone number used for payment
M-Pesa transaction reference numbers
Payment amount and subscription plan selected
Transaction timestamps
Note: We do not store your M-Pesa PIN or full financial account details. All payment processing is handled securely by Safaricom's M-Pesa platform.
We use the information we collect to:
Create and manage your user account
Process M-Pesa payments and activate premium subscriptions
Deliver exam questions and track your learning progress
Send important notifications about your account or subscription
Improve our App features and user experience
Respond to your support requests and inquiries
Detect and prevent fraudulent transactions
Comply with legal obligations under Kenyan and East African law
We process your personal data on the following legal bases:
Contract: To fulfil our service obligations when you subscribe or create an account
Legitimate Interests: To improve our services, prevent fraud, and ensure security
Legal Obligation: To comply with applicable laws and regulations
Consent: Where you have explicitly given us permission to process your data
We do not sell, trade, or rent your personal information to third parties. We may share your information only in the following circumstances:
We share data with trusted third-party service providers who assist us in operating our App:
Safaricom M-Pesa: For processing mobile payments
Contabo GmbH: For secure cloud server hosting
Paystack: For alternative payment processing
We may disclose your information if required to do so by law or in response to valid requests by public authorities in Kenya or other East African countries, including to meet national security or law enforcement requirements.
If Qwellart Technologies is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your personal information is transferred and becomes subject to a different privacy policy.
We retain your personal information for as long as your account is active or as needed to provide you with our services. Specifically:
Account data is retained for the duration of your account and up to 2 years after account deletion
Payment records are retained for 7 years as required by Kenyan tax and financial regulations
Exam history and scores are retained for the lifetime of your account
Log data is retained for up to 90 days
You may request deletion of your account and personal data at any time by contacting us at privacy@qwellart.com.
We implement industry-standard security measures to protect your personal information:
All data transmission is encrypted using HTTPS/TLS
Passwords are hashed and never stored in plain text
Authentication tokens are encrypted and stored securely on your device
Our servers are hosted in secure data centres with restricted access
Regular security audits and vulnerability assessments
While we strive to use commercially acceptable means to protect your personal information, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.
As a user of our App, you have the following rights regarding your personal data:
You have the right to request a copy of the personal information we hold about you. We will provide this in a commonly used, machine-readable format.
You have the right to request that we correct any inaccurate or incomplete personal information we hold about you. You can update most information directly through your Profile in the App.
You have the right to request that we delete your personal information, subject to certain exceptions such as legal obligations. To request deletion, contact us at privacy@qwellart.com.
You have the right to object to or request restriction of our processing of your personal data in certain circumstances.
Where we rely on your consent to process your data, you have the right to withdraw that consent at any time without affecting the lawfulness of processing before withdrawal.

The NTSA Theory Test App is intended for individuals who are eligible to obtain a driving licence, which in Kenya and East Africa typically requires a minimum age of 18 years. We do not knowingly collect personal information from children under the age of 18.
If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately at privacy@qwellart.com. We will take steps to delete such information from our systems.
When you make payments through M-Pesa, please note:
You will receive an STK Push notification on your phone prompting you to enter your M-Pesa PIN
Your M-Pesa PIN is entered directly on your device and is never transmitted to or stored by us
Payment confirmation is received from Safaricom and used solely to activate your subscription
M-Pesa transaction records may be retained for up to 7 years as required by financial regulations
For M-Pesa payment disputes, please contact Safaricom customer care on 100
Our App may contain links to third-party websites or services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. We encourage you to review the privacy policies of any third-party services you use.
Your information may be transferred to and maintained on computers located outside of your country, where data protection laws may differ. If you are located in Kenya or East Africa and choose to provide information to us, please note that we transfer the data to our servers and process it there.
We ensure that appropriate safeguards are in place for such transfers, including standard contractual clauses where required.
We may update our Privacy Policy from time to time. We will notify you of any changes by:
Posting the new Privacy Policy within the App
Sending you an email notification to the address associated with your account
Displaying a prominent notice within the App before the change becomes effective
We encourage you to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted.
If you have a complaint about how we handle your personal data, please contact us first at privacy@qwellart.com. We will investigate and respond within 30 days.
If you are not satisfied with our response, you may lodge a complaint with the Office of the Data Protection Commissioner of Kenya (ODPC) at www.odpc.go.ke.
Users of NTSA Drivers & Riders Exams can request deletion of their account and associated data.
