IMPORTANT — PLEASE READ CAREFULLY

These Terms of Use (“Terms”) form a legally binding agreement between you (“you,” “user”) and PureTuber (“we,” “us,” “our”) regarding your use of the PureTuber mobile application (the “App”).

By downloading, installing, accessing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. About the App

PureTuber is a focused in-app web browser experience with tools for multitasking playback, including Picture-in-Picture and background audio where supported by iOS and the media page you are viewing.

The App is published on the Apple App Store:

• App Name: PureTuber

• Bundle Identifier: com.puretuber.player

• Apple App ID: (pending)

• Publisher: PureTuber

2. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable, non-sublicensable license to install and use the App on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions and App Store usage rules.

You may not:

• Copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract source code except to the extent allowed by law

• Circumvent purchase, entitlement, security, or access controls

• Use the App for unlawful, harmful, fraudulent, or infringing activity

• Misrepresent affiliation with PureTuber or any third party

3. No Affiliation Disclaimer

PureTuber is an independent product. The App is not affiliated with, endorsed by, sponsored by, or officially connected to any third-party media platform unless expressly stated. All third-party trademarks remain the property of their respective owners and are used only for descriptive/identification purposes where necessary.

4. Intellectual Property & Copyright

The App, including its name, branding, UI design, icons, text, layout, and original code/content provided by PureTuber, is protected by copyright and other intellectual property laws. Except for the limited license above, no rights are granted to you.

Third-party websites, videos, audio, trademarks, and other materials you access through the browser remain the property of their respective owners. You are solely responsible for ensuring you have the right to access and use such content.

5. No Advertisements

PureTuber does not monetize core usage through third-party display advertising. Paid features are unlocked through Apple In-App Purchases.

6. In-App Purchases & Feature Unlock

Certain features require PureTuber Pro (“Premium Features”), which may include the full browser Home experience, floating Picture-in-Picture workflow, background listening workflow, and related tools described in the App Store listing and paywall.

Unlock methods:

• Auto-renewable subscriptions (Weekly / Monthly / Yearly), and/or

• Lifetime (non-consumable) one-time purchase

All purchases are processed by Apple via your Apple ID. PureTuber does not process card payments directly inside the App.

Restore Purchases:

If you previously purchased on the same Apple ID, use Restore Purchases in the App.

7. Subscriptions (Auto-Renewal)

If you purchase an auto-renewable subscription:

• Payment is charged to your Apple ID account at confirmation of purchase

• The subscription renews automatically unless canceled at least 24 hours before the end of the current period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• You can manage or cancel subscriptions in iOS Settings → [Your Name] → Subscriptions

• Any unused portion of a free trial (if offered) is forfeited when you purchase a subscription, where applicable

8. Refunds (In-App Purchases)

Because purchases are made through Apple, refund requests for In-App Purchases and subscriptions are handled by Apple, not by PureTuber directly granting store refunds.

You may also start from your purchase receipt email from Apple.

PureTuber cannot override Apple’s refund decisions. If you contact puretuberplayer.app@gmail.com, we may guide you to Apple’s official refund flow, but Apple remains the merchant of record for App Store purchases.

9. No PureTuber Server Dependency / No Remote App Data Updates

The App’s purchase unlock and core client features are designed to work without a PureTuber-operated user account server and without mandatory remote “data update” packages from PureTuber.

This means:

• No PureTuber account registration is required

• Pro entitlement is validated through Apple purchase/restore mechanisms and on-device flags

• We do not require continuous connection to a PureTuber backend for keeping an already unlocked App usable

However:

• Internet access is required to browse websites and stream online media

• Availability of websites, videos, and media is controlled by third parties

• System features (PiP, background audio) depend on iOS version, device settings, and website media behavior

10. Acceptable Use

You agree not to use the App to:

• Violate any law or third-party rights (including copyright, trademark, privacy)

• Attempt unauthorized access to systems or content

• Distribute malware, spam, or abusive content

• Interfere with the App’s operation or other users’ enjoyment

• Bypass digital rights management, paywalls, or technical protection measures of third-party services

• Download, rip, or permanently archive streaming content in ways that violate law or platform terms

PureTuber does not provide a video downloader / ripper / DRM bypass. You must comply with the terms of any website you visit.

11. Internet, Availability & Third-Party Content

The App may be unavailable during maintenance, OS updates, network outages, or circumstances beyond our control. Third-party sites may change, block embedding, restrict media, or become inaccessible. We do not guarantee uninterrupted, error-free, or perpetual availability of any third-party content.

12. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

• THE APP WILL MEET ALL OF YOUR REQUIREMENTS

• THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE

• PICTURE-IN-PICTURE OR BACKGROUND AUDIO WILL WORK ON EVERY WEBSITE OR DEVICE CONFIGURATION

• THIRD-PARTY WEBSITES OR MEDIA WILL REMAIN AVAILABLE OR COMPATIBLE

SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THOSE CASES, DISCLAIMERS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURETUBER AND ITS DEVELOPERS, OFFICERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO UNLOCK PURETUBER PRO THROUGH THE APP STORE IN THE THREE (3) MONTHS PRECEDING THE CLAIM (OR, IF GREATER, THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW).

NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW (INCLUDING LIABILITY FOR FRAUD OR DEATH/PERSONAL INJURY CAUSED BY NEGLIGENCE WHERE SUCH EXCLUSION IS PROHIBITED).

14. Indemnification

You agree to indemnify and hold harmless PureTuber from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the App, your violation of these Terms, or your violation of any law or third-party rights (including content you choose to access).

15. Privacy

Your use of the App is also governed by our Privacy Policy. Please review it carefully.

16. Apple-Required Terms (App Store)

You acknowledge that:

• These Terms are between you and PureTuber, not Apple

• Apple has no obligation to provide maintenance or support for the App

• In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the App purchase price (if any) to the extent required; to the maximum extent permitted by law, Apple has no other warranty obligation

• Apple is not responsible for addressing claims relating to the App or your possession/use of the App, including product liability, legal compliance, or consumer protection claims

• Apple is not responsible for investigating, defending, settling, or discharging third-party intellectual property infringement claims

• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

17. Termination

We may suspend or terminate access to the App (including by removing it from distribution) if you violate these Terms or if required by law / platform rules. You may stop using the App at any time by deleting it. Provisions that by nature should survive (IP, disclaimers, limitations, indemnity, refunds guidance) will survive termination.

18. Changes to the Terms

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use after changes constitutes acceptance, except where additional consent is required by law.

19. Governing Law

These Terms are governed by the laws applicable in the publisher’s principal place of business, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country require otherwise. If you are a consumer in the EEA/UK, you may also benefit from mandatory local protections.
