PRIVACY POLICY
This Privacy Policy describes how Postcardly ("we", "our", or "the App") handles information when you use our iOS application. We are committed to protecting your privacy and being transparent about our data practices.
1. WHO WE ARE
Postcardly is a creative photo-editing application that turns your photos into vintage stamps and postcards. The App is operated by the Postcardly team. If you have questions about this Privacy Policy, please contact us at:
Email: support@postcardlyapp.com
2. INFORMATION WE DO NOT COLLECT
We have designed Postcardly to operate entirely on your device. The App does NOT collect, transmit, store on remote servers, or share with any third party:
- Your name, email address, phone number, or any account credentials (the App does not require sign-up).
- Your photos, images, or any creations you make with the App.
- Your contacts, calendar, location, microphone, or any other personal data.
- Device identifiers used for advertising or cross-app tracking.
- Browsing or usage analytics.
- Crash reports containing personal information.
3. INFORMATION HANDLED LOCALLY ON YOUR DEVICE
The following information is processed only on your device and never leaves it:
- Photos you select from your photo library: Used solely for the editing operation you request, then converted into a stamp or postcard image. The original photo is not modified.
- Creations you generate (stamps, postcards): Saved either to your iOS Photos library (with your permission) or in the App's private storage on your device for the in-app Gallery feature. You may delete any creation at any time from within the App.
- User-entered text (caption, denomination, country/year for postmark): Embedded into the generated image and stored alongside it locally. Never transmitted.
4. PERMISSIONS WE REQUEST
The App may request the following iOS permissions:
- Photo Library (Read): Required to let you pick a photo to convert into a stamp or postcard. We only access the specific photo you select.
- Photo Library (Add): Required to save your finished creation back to your photo library. We only write the file you choose to save.
You can revoke either permission at any time in iOS Settings > Privacy > Photos.
5. NETWORK ACCESS
Postcardly does not require an internet connection to function. The App does not make network requests for analytics, advertising, configuration, or content delivery. The Privacy Policy and Terms of Use pages inside the App are loaded from local files bundled with the App and do not reach the network.
6. THIRD-PARTY SERVICES
We do not integrate any third-party analytics, advertising, attribution, social-login, or tracking SDKs. We do not share information with third parties because we do not collect such information in the first place.
7. CHILDREN'S PRIVACY
Postcardly is intended for general audiences and is not directed at children under the age of 13. Because we do not collect personal information from any user, we do not knowingly collect personal information from children. If a parent or guardian believes information has somehow been provided to us, please contact us so we can take appropriate action.
8. DATA RETENTION AND DELETION
Because we do not collect personal information, there is nothing for us to retain or delete on remote servers.
- Creations stored in the App's local Gallery remain on your device until you delete them via the in-app delete action or uninstall the App.
- Uninstalling the App removes all local data created by the App from your device.
9. YOUR RIGHTS UNDER GDPR (European Economic Area users)
You have the right to access, correct, delete, restrict processing of, or object to the processing of your personal data, and the right to data portability. Because Postcardly does not collect personal data, these rights are satisfied by the App's design: there is no remote data set to access, correct, delete, or transfer.
10. YOUR RIGHTS UNDER CCPA (California residents)
You have the right to know what personal information is collected, the right to delete personal information, the right to opt out of the sale or sharing of personal information, and the right to non-discrimination for exercising these rights. Postcardly does not collect, sell, or share personal information.
11. SECURITY
Because all data is processed on your device and not transmitted, there is no transmission to be intercepted. The security of data on your device is governed by the iOS operating system's standard sandboxing protections.
12. CHANGES TO THIS POLICY
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where appropriate, notify users via an in-app notice on the next launch. Continued use of the App after a change indicates your acceptance of the updated policy.
TERMS OF USE
Please read these Terms of Use ("Terms") carefully before using Postcardly (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. LICENSE GRANT
Subject to your compliance with these Terms, Postcardly grants you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and use the App on any iOS device that you own or control, in accordance with the Apple Media Services Terms and Conditions and the Usage Rules of the App Store.
2. RESTRICTIONS
You agree NOT to:
a. Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent that such activity is expressly permitted by applicable law.
b. Rent, lease, lend, sell, redistribute, sublicense, or otherwise transfer the App or your rights under these Terms.
c. Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) of Postcardly or its licensors on or in the App.
d. Use the App in any unlawful manner or for any unlawful purpose, including but not limited to creating content that infringes intellectual property rights, violates privacy rights, or contains hateful, harassing, defamatory, obscene, or otherwise objectionable material.
e. Use the App to create content depicting real persons without their consent, in a manner that is misleading, defamatory, or harmful.
f. Attempt to gain unauthorized access to any portion of the App, its features, or any systems or networks connected to the App.
3. USER CONTENT AND OWNERSHIP
You retain all rights, title, and interest in and to the photos, text, and other content ("User Content") that you provide to or create with the App. By using the App, you grant Postcardly a strictly local, non-transferable license to process your User Content on your device for the sole purpose of providing the App's features (i.e., generating stamp and postcard images from your input). The App does not transmit your User Content to any remote server, and Postcardly does not claim any ownership or right to use your User Content beyond the local processing required to operate the App.
You are solely responsible for the User Content you create, including ensuring that you have the necessary rights and permissions to use any photo or text you provide.
4. INTELLECTUAL PROPERTY
The App, including all software, designs, graphics, text, logos, and trademarks (excluding your User Content), is owned by Postcardly or its licensors and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to use Postcardly trademarks, logos, or trade dress.
5. DISCLAIMERS
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. POSTCARDLY DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
YOU USE THE APP AT YOUR SOLE RISK. POSTCARDLY MAKES NO REPRESENTATION THAT THE APP IS APPROPRIATE OR AVAILABLE FOR USE IN ANY PARTICULAR JURISDICTION.
6. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POSTCARDLY, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF POSTCARDLY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
POSTCARDLY'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP, OR (B) FIVE U.S. DOLLARS (USD 5.00).
7. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Postcardly and its affiliates, officers, employees, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from or related to (a) your use or misuse of the App, (b) your violation of these Terms, or (c) your User Content.
8. TERMINATION
These Terms remain in effect until terminated by you or Postcardly. You may terminate these Terms at any time by uninstalling the App from your device. Postcardly may terminate or suspend these Terms (and your access to the App) at any time, with or without notice, for any reason, including but not limited to your breach of these Terms. Upon termination, the license granted in Section 1 immediately expires, but Sections 4 through 11 will survive.
9. CHANGES TO THESE TERMS
We may modify these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page and, where appropriate, notify users via an in-app notice on the next launch. Your continued use of the App after a change constitutes your acceptance of the modified Terms.
10. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the App shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts. Notwithstanding the foregoing, Postcardly may seek injunctive or equitable relief in any court of competent jurisdiction.
If you reside in the European Economic Area, the United Kingdom, or any other jurisdiction whose mandatory law grants you the right to bring suit in your local courts, those rights are not waived by this section.
11. APPLE-SPECIFIC TERMS
You acknowledge and agree that:
a. These Terms are between you and Postcardly only, not with Apple Inc. ("Apple"), and Apple is not responsible for the App or its content.
b. Apple has no obligation to provide any maintenance and support services for the App.
c. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. Apple has no other warranty obligation whatsoever with respect to the App.
d. Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App.
e. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
12. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Postcardly regarding the App and supersede all prior agreements and understandings, whether written or oral.
13. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
