END USER LICENSE AGREEMENT (EULA)

1. ACCEPTANCE OF TERMS
By downloading, installing, or using the "AI Podcast Cover Maker" application ("App"), you agree to be bound by the terms and conditions of this End User License Agreement ("Agreement"). If you do not agree to the terms of this Agreement, do not download, install, or use the App.
2. LICENSE GRANT
Subject to your compliance with this Agreement, we grant you a personal, worldwide, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal and commercial use on a mobile device or computer that you own or control, strictly in accordance with the App's documentation.
3. AI-GENERATED CONTENT AND USAGE RIGHTS
The App utilizes artificial intelligence (AI) to generate podcast cover art and audio thumbnails based on your text prompts.Â
a. Ownership: You retain all rights to the text prompts you input into the App. We claim no ownership over the raw text prompts you provide.
b. Commercial Use: Subject to your compliance with this Agreement, you are granted full commercial rights to the AI-generated images produced by you within the App. You may use these images for your podcast covers, marketing materials, and other commercial purposes.
c. No Infringement: You agree not to use the App to generate content that infringes upon the copyrights, trademarks, or intellectual property rights of any third party.
4. SUBSCRIPTIONS, IN-APP PURCHASES, AND CREDITS
Certain features, premium styles, and high-resolution exports within the App may require a paid subscription or the purchase of in-app credits.
a. Billing: All payments are processed through the respective app store (e.g., Apple App Store, Google Play Store) and are subject to their terms of service.
b. Renewals and Cancellations: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage your subscriptions and turn off auto-renewal in your account settings after purchase.
c. Refunds: Refunds for in-app purchases and subscriptions are handled entirely by the platform from which you purchased them, in accordance with their respective refund policies.
5. PROHIBITED USES
You agree not to use the App to:
a. Generate any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
b. Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
c. Modify, translate, adapt, or create derivative works based on the App itself.
d. Circumvent or attempt to circumvent any security features or paywalls within the App.
6. PRIVACY POLICY
Your use of the App is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. The App may require access to your device's photo library solely for the purpose of saving the cover art you choose to export. We do not read, scan, upload, or modify your existing photos.
7. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.
9. TERMINATION
We reserve the right to terminate or suspend your license and access to the App at our sole discretion, without notice, for conduct that we believe violates this Agreement or is harmful to other users of the App, us, or third parties, or for any other reason. Upon termination, you must cease all use of the App and delete all copies of the App from your devices.
10. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the applicable laws, without regard to its conflict of law principles. Any legal action or proceeding arising under this Agreement will be brought exclusively in the competent courts.
