Thank you for applying to use the automatic subscription service (hereinafter referred to as "this service") provided by PixVideo AI (hereinafter referred to as "this product"). Please carefully read and agree to all the terms of the "Member Automatic Subscription Service Agreement" (hereinafter referred to as "this agreement"). If you do not agree to all or part of this agreement, please do not select "Agree and Accept" or use this service in any form of confirmation (including but not limited to: checking boxes, clicking). By checking "Agree and Accept this Product's Automatic Subscription Service Agreement," you indicate that you have entered into an agreement with this product and voluntarily accept all the terms of this agreement. Thereafter, you may not raise any objection based on not having read the terms of this agreement.
I. Prerequisites for Using this Service
1. This service is a sub-service of this product's member service. This service is also launched to meet your need for automatic subscription and to avoid losses caused by your failure to subscribe to this product's online service in a timely manner due to negligence or other reasons. Therefore, your application to activate this product's online service is a prerequisite for applying to use this service. 2. You must possess the corresponding legal capacity and capacity for action to independently assume legal responsibility when using this service. If you are under the age of 18, you must use this service under the supervision and participation of your parents or guardians.
3. This agreement is a sub-agreement of the "Member Service Agreement of this Product" and has the same and inseparable legal effect. Therefore, before using this service, you should accept and agree to the contents of the "Member Service Agreement of this Product", this agreement, and all related agreements, rules, and announcements, especially the relevant clauses that limit or exempt liability (the clauses that limit or exempt liability may be highlighted in bold). At the same time, your following actions will also be deemed as your acceptance of all the terms of this agreement and the series of agreements of this product's online service:
(1) Actual use of this service;
(2) Or Actual use of any product or service (if any) provided by this product together with this service;
(3) Or Actual use of any product or service (if any) provided by a third party together with this service. Your agreement to this Agreement constitutes your acknowledgment and acceptance of all terms of this Agreement and the online service series agreement for this product, and you warrant that you will fully comply with the foregoing agreement.
II. Rights and Obligations of Both Parties under this Service
1. By applying to use this service, you irrevocably authorize this product to deduct the fee for the next billing cycle from your own product membership recharge account and the Apple Pay balance linked to your product membership service account (hereinafter collectively referred to as the "Account") before or after the expiration of your membership service period. Billing cycles include, but are not limited to, weekly, monthly, quarterly, and annual cycles (the same applies below) (the specific billing cycle will be based on the billing cycle you select when choosing this service). This service is contingent upon you having linked your product online service account to the aforementioned account and successfully deducting fees from the aforementioned account.
2. Automatic renewal specifically refers to, based on the premise of paragraph 1 of this article, this product collecting the fee for the next billing cycle from your aforementioned account, recording the amount in your payment record, and simultaneously extending the validity period of your membership service accordingly. You must ensure that payment for this product can be successfully deducted from the above-mentioned account. You will be solely responsible for any renewal failures due to insufficient funds in the above-mentioned account.
3. If you activated this service through an Apple ID (in this agreement, "Apple" refers to Apple Inc. and its affiliates), and do not actively cancel this auto-renewal service 24 hours before the next subscription expires, Apple will automatically deduct the service fee for the next subscription period from the balance of the Apple ID account linked to your activation of this auto-renewal service (hereinafter collectively referred to as the "Account") 24 hours before the expiration of each subscription period, thereby extending the service validity period corresponding to that subscription period.
4. Please pay attention to the status of the above-mentioned account and its available funds. You will be solely responsible for any risks or losses arising from renewal failures due to account issues or insufficient funds (such as termination of corresponding rights, inability to participate in activities, or impact on membership status). If you do not explicitly choose to cancel this service, it will be deemed that you agree that the company may attempt to deduct payment from time to time within a certain period after the subscription service expires (subject to the deduction rules of each payment channel). The company will continue to provide you with automatic renewal service when/after your account balance is restored to sufficient funds. Once the deduction is successful, the company will continue to provide you with paid benefits.
5. In the event of an error during the deduction process, this product will cooperate with you to investigate the cause, and each party shall bear the loss caused by its own fault. If the loss is caused by unequal fault on both sides, each party shall bear the corresponding responsibility according to the degree of fault; if both parties are jointly responsible, they shall share the responsibility equally.
6. The services provided to you by this product are limited to your use on this product's client. Any act of maliciously cracking or otherwise illegally accessing the content of this service provided by this product is not considered part of the service stipulated in this agreement. All legal consequences arising therefrom shall be borne by the perpetrator, and this product will pursue the perpetrator's legal liability in accordance with the law. 7. You may choose whether to cancel this service. If you do not choose to cancel, it will be deemed that you agree that this product will attempt to deduct payment periodically according to certain rules. Once the deduction is successful, this product will activate your monthly service for the next billing cycle.
8. If the service price you pay through this service is adjusted before or during automatic renewal, the currently valid price shall prevail.
9. This product does not charge you any additional fees for activating this service, but this product has the right to decide whether to charge for the service itself or adjust the automatic renewal cycle and fees based on business needs or market changes.
III. Validity and Termination of this Service
1. This service is valid indefinitely, effective from the date you choose to accept or use this service, until you terminate (including your voluntary termination and termination due to your violation of relevant agreements, rules, etc.) this service or a specific online service of this product that you access through this service. 2. You have the right to terminate this service at any time in accordance with the instructions in Article 4 of this Agreement. Upon termination, this product will cease providing this service to you.
3. Any instructions you have made to automatically renew your subscription before choosing to terminate this service will remain valid. This product will not refund any fees deducted based on such instructions, and you will bear the relevant responsibilities.
4. The company may choose to suspend or interrupt this service due to its own business decisions or other reasons. In such cases, the company will notify you through a public announcement.
IV. Cancellation of this Service
1. You may choose to unsubscribe from this service.
2. If you wish to cancel automatic renewal, you can do so through your Apple iOS "App Store" account settings 24 hours before the end of the next subscription period.
V. Other
1. Law and Dispute Resolution: This Agreement shall be governed by the laws of the People's Republic of China, excluding any conflict of laws provisions. In the event of any dispute, you and the company agree to submit the dispute to the court with jurisdiction in the location of the company. 2. The Company's failure to exercise, timely exercise, or full exercise of any right under this Agreement or as provided by law shall not be deemed a waiver of such right, nor shall it affect the Company's right to exercise such right in the future.
