These End User License Agreements ("EULA") constitute a contract between Shengpeng Li ("Company", "we" or "us") and users of our mobile applications ("Users", "you" and the "App") Agreement. These EULAs govern your use of the App and the Services (defined below) provided therein.
ACCEPTANCE OF EULA: Please read this EULA carefully before downloading or using the Application and Services. You acknowledge that these EULAs constitute a binding and enforceable legal electronic contract between you and Company. By installing and using the App and Services, you acknowledge that you have read, understood and agree to be bound by these EULAs, use the App and the services provided therein in accordance with the terms set forth herein, and abide by these Terms in relation to your use of the App Conditions and Conditions All applicable laws and regulations apply. If you do not agree to the provisions of these EULAs, or any part thereof, you may not use the App and, if applicable, uninstall it.
Amendments
We reserve the right, in our sole discretion, to modify or revise these EULAs from time to time. Such revisions are effective as of the "Last Revision" heading at the top of this EULA. If, in our judgment, the changes are material, we will make reasonable efforts to notify you. We recommend that you review these EULAs periodically, as your continued use of the Application and Services after the date of last revision will constitute acceptance of and agreement to be bound by those changes.
Payments
Certain Apps may include additional features and services that are subject to payment, the payment can be in terms of an ongoing subscription plans ("Subscription") or one-time payment.
The Subscription includes different prices or The subscriptions for which payment terms apply, or the type of device you own, are specified on our pricing page, available here. Our subscriptions are prepaid and you will be charged once at the beginning of each subscription period. We may offer distinctive features or services, subscribe to addnew features or change or cancel any existing features or features, at Tour's sole discretion and further reserve the right to change subscription fees at its sole discretion. If you are at the time of this change, the new exchange rate is affected
during your next subscription period; otherwise, you have the option to cancel your subscription, if you will receive a prorated refund.
The Company may, at its sole discretion, offer a free trial with each Subscription. When you sign up for a free trial, you acknowledge and agree that you will automatically be charged in accordance with the then-current terms of the applicable subscription after the trial unless you voluntarily cancel your subscription before the end of the free trial.
After purchasing a subscription, your subscription will automatically renew and your chosen payment method will be charged the applicable fee, unless you voluntarily cancel the subscription using your AppStore or GooglePlay account subscription, as applicable, in which case you will lose the End access subscriptions for the current billing cycle, you will not receive funds for the current billing cycle regardless of the cancellation date.
Cancellation terms and disputes will be governed by such payment processor terms.
The Refund Company may issue a full or partial refund for its Paid Services depending on the reason for the refund. The Company's refund policy allows users to issue a refund request within thirty (30) days to refund purchases. Users with refund requests approved by the case company will receive a cancellation email from Google.
Company shall be deemed in breach of these EULAs if Company fails to provide the Application and its Service Portions
User Consent for Data Processing Related to Refund Requests
In accordance with the App Store’s refund policy, when a user initiates a refund request, our server will receive a notification (CONSUMPTION_REQUEST) from Apple. In such cases, we will provide Apple with data related to the user’s subscription to assist Apple in making a decision regarding the refund request. Please note that the data provided is strictly limited to subscription-related consumption information and does not include any personal or sensitive data. We are committed to complying with Apple’s requirements and ensuring that all data processing activities fully adhere to privacy protection laws and regulations. By using this app, you consent to the transmission of your subscription consumption data to Apple, as required for processing refund requests, in compliance with the App Store’s refund policies.
