TERMS AND CONDITIONS OF USE

These Terms and Conditions ("Terms") govern your access to and use of the Photo Recovery & Cleaner mobile application (the "App") provided by AppRepublic LLC ("we," "us," or "our"), a company registered in Turkey.
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not download or use the App.

1. ELIGIBILITY
You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

2. LICENSE TO USE THE APP
Subject to your compliance with these Terms, AppRepublic LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial use.
This license is granted in accordance with the Apple App Store Terms of Service, including the Licensed Application End User License Agreement (EULA).

3. HOW THE APP WORKS — IMPORTANT DISCLOSURE
The App helps you:
- Find and restore photos located in your iPhone's "Recently Deleted" folder, where iOS retains deleted photos for up to 30 days before permanent deletion.
- Identify duplicate, similar, blurry, and low-quality photos in your library.
- Free up storage by helping you delete unwanted media.
- Compress large videos and photos.
- Hide selected photos in a secure album.
IMPORTANT — WHAT THE APP CANNOT DO:
iOS does not allow any third-party application to recover photos that have been permanently deleted from your device. This means:
- We cannot recover photos that have been removed from the "Recently Deleted" folder.
- We cannot recover photos deleted more than 30 days ago.
- We cannot recover photos that were never on the device with the App installed.
- We cannot recover photos lost due to factory reset, device damage, or iOS reinstallation.
You acknowledge and agree that these are platform limitations imposed by Apple and iOS, not by the App. AppRepublic LLC makes no warranty that any specific photo can be recovered.

4. SUBSCRIPTIONS, PAYMENTS, AND FREE TRIALS
4.1 Subscription Plans
The App offers auto-renewing subscriptions that unlock premium features. Subscription pricing, duration, and features are displayed within the App at the time of purchase.
4.2 Payment
Payment is charged to your Apple ID account at confirmation of purchase. All payments are processed by Apple under Apple's terms.
4.3 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal at the then-current price within 24 hours prior to the end of the current period.
4.4 Free Trials
If a free trial is offered, it automatically converts to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial will be forfeited if you purchase a subscription during the trial.
4.5 Managing and Canceling Subscriptions
You can manage or cancel your subscription at any time by going to your iPhone's Settings > [Your Name] > Subscriptions, or through the App Store. Cancellation takes effect at the end of the current billing period.
4.6 Price Changes
We may change subscription prices from time to time. You will be notified of any price increase in accordance with Apple's policies and applicable law, and the change will only take effect after your next renewal.
4.7 Refunds
All purchases are processed by Apple. Refund requests are handled by Apple under their refund policy. You can request a refund through Apple at: https://reportaproblem.apple.com
AppRepublic LLC does not have the ability to issue refunds directly. We will, however, assist you in good faith if you experience a technical issue — contact us at burak@apprepublic.co.

5. ACCEPTABLE USE
You agree NOT to:
- Use the App for any unlawful, fraudulent, or unauthorized purpose.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
- Copy, modify, distribute, sell, lease, or sublicense any part of the App.
- Use the App to recover, view, restore, or otherwise process photos or media that do not belong to you or that you do not have legal permission to access.
- Use the App to violate the privacy or rights of any other person.
- Bypass, disable, or interfere with any security or technical limitations of the App.
- Use any automated tool, bot, or script to interact with the App.
- Upload or transmit any virus, malware, or malicious code in connection with the App.
We reserve the right to terminate your access to the App immediately if we reasonably believe you have violated these Terms.

6. PRIVACY
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We strongly recommend you read it to understand how we collect, use, and protect your information.
The App processes your photos and media on-device only. We do not upload, transmit, or store your photos on our servers.

7. INTELLECTUAL PROPERTY
The App, including all software, design, text, graphics, logos, icons, and other content (excluding user content), is the property of AppRepublic LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You are granted no rights or licenses in the App other than the limited license described in Section 2. All rights not expressly granted are reserved.
The name "Photo Recovery & Cleaner," the AppRepublic brand, and any associated logos are trademarks of AppRepublic LLC. You may not use them without our prior written permission.

8. THIRD-PARTY SERVICES
The App may interact with third-party services (such as Apple's iOS Photos framework, App Store, and analytics providers). Your use of those services is subject to their respective terms and policies. We are not responsible for third-party services, content, or practices.

9. DISCLAIMERS
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
WITHOUT LIMITING THE ABOVE, WE DO NOT WARRANT THAT:
- Any specific photo, video, or file can be recovered.
- The App will be compatible with every device or iOS version.
- The App will be free from bugs, defects, or interruptions.
- Any data loss can be prevented or reversed by use of the App.
YOU USE THE APP AT YOUR OWN RISK. WE RECOMMEND THAT YOU MAINTAIN INDEPENDENT BACKUPS OF YOUR IMPORTANT PHOTOS AND DATA AT ALL TIMES (FOR EXAMPLE, USING iCLOUD PHOTOS).

10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APPREPUBLIC LLC, ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS ($50).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability is limited to the maximum extent permitted by law.

11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless AppRepublic LLC and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your access to or use of the App.
- Your violation of these Terms.
- Your violation of any third-party right, including any intellectual property or privacy right.

12. TERMINATION
We may suspend or terminate your access to the App at any time, without notice, if we believe you have violated these Terms. You may stop using the App at any time by deleting it from your device.
Upon termination, the license granted to you under Section 2 ends immediately. Sections that by their nature should survive termination (including Sections 7, 9, 10, 11, 13, and 14) will continue to apply.

13. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of laws principles.
Any dispute arising out of or in connection with these Terms shall be resolved through good-faith negotiation in the first instance. If a resolution cannot be reached, the dispute shall be submitted to the competent courts and enforcement offices of Istanbul, Turkey, except where applicable consumer protection law gives you the right to bring proceedings in your country of residence.
If you are a resident of the European Union or United Kingdom, this clause does not affect your statutory rights under mandatory consumer protection laws.

14. APPLE-SPECIFIC TERMS
You acknowledge that these Terms are between you and AppRepublic LLC, not with Apple. Apple is not responsible for the App or its content. To the extent these Terms conflict with the Apple App Store Terms of Service, the Apple terms govern only with respect to your relationship with Apple.
You also acknowledge that:
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if applicable). Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App or your use of the App.
- Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms and may enforce them against you.

15. CHANGES TO THESE TERMS
We may modify these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Material changes will be communicated through the App or via email where appropriate. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.
If you do not agree to the updated Terms, you must stop using the App.

16. MISCELLANEOUS
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and AppRepublic LLC regarding the App.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
- Waiver: Our failure to enforce any right or provision will not be considered a waiver of that right or provision.
- Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.
- Language: These Terms are written in English. Any translation is provided for convenience only; the English version controls in case of conflict.
