These Terms of Use ("Terms") govern your use of PhotoColors: Story Cards ards ("we", "our", or "us") (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use. This license is conditioned on your continued compliance with these Terms.
You may not:
Copy, modify, decompile, reverse-engineer, or attempt to derive the source code of the App
Rent, lease, sell, sublicense, or redistribute the App or any part of it
Use the App to violate any law or third-party rights
Bypass, disable, or circumvent any feature gating or payment mechanism
The App offers a one-time Lifetime Pro purchase that unlocks premium templates, unlimited exports, and other Pro features.
All purchases are processed by Apple through the App Store.
Receipt validation and Pro feature unlocks are handled by RevenueCat.
Prices are shown in your local currency in the App and are subject to change.
Purchase confirmation, refunds, and billing inquiries are governed by Apple's App Store terms. We do not issue refunds directly.
You can restore a previous purchase on any device signed in to the same Apple ID via the "Restore Purchases" option in the App.
Any photos you import, capture, edit, or save with the App remain entirely yours. We do not claim any ownership of your photos or generated cards.
All photo processing happens on your device.
We do not upload, store, or transmit your photos to any server.
You are solely responsible for ensuring you have the rights to use any photo you import.
You agree not to use the App to create, save, or share content that:
Infringes someone else's copyright, trademark, or other intellectual property rights
Is unlawful, defamatory, harassing, hateful, or violates anyone's privacy
Contains malware or attempts to interfere with the App's operation
The App, including its design, templates, code, name, logo, and visual assets, is owned by us and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership of the App to you.
The App relies on third-party services including the Apple App Store, Apple Photos, Apple CoreLocation, and RevenueCat. Your use of these services is also subject to their respective terms. We are not responsible for the actions, content, or availability of any third-party service.
The App is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected. Use of the App is at your sole risk.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption arising out of or in connection with your use of the App. Our total liability for any claim related to the App shall not exceed the amount you paid for it during the twelve (12) months prior to the claim.
We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms. You may stop using the App at any time by uninstalling it from your device. Provisions that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will continue to apply.
We may release updates, bug fixes, or new features from time to time. Some updates may be required to keep the App functional. We reserve the right to add, modify, or remove features at any time without prior notice.
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this document. Your continued use of the App after the update constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of that jurisdiction.
