Petite Congress Approves Second Constitution!

On January 2nd, the Petite Congress Approved the 2nd Petite Constitution! This makes the principles of Petite and our laws more clear. Here's the full constitution below.

PETITE CONSTITUTION 

To further strengthen the nation, the fundamental principles—including the rights of the people, liberty, justice, and equality shall be enshrined in the Constitution for the Federal Republic of Petite and its districts.

Rights Of The People,

Section One.

Every citizen of Petite has the right to the freedoms of speech, religion, press, assembly, and petition.

Section Two.

Every citizen of Petite has the right to not self incriminate, protection from double jeopardy, and the right to a fair and free trial. All must also be informed of what they are being charged with and the rights they maintain. Finally, this also prevents judges from overturning a jury's factual findings.

Section Three.

No citizen of Petite can be subjected to unreasonable fines or bail, cruel punishments that don’t match the crime, or harm from officers of the law without reason.

Section Four.

All parts of the constitution can be updated by wish of the people (majority).

Section Five.

Every citizen of Petite maintains equal rights, no matter the color of skin, gender, or other. This also prohibits slavery or anything deemed as slavery. Votes, education, or anything must be equal without segregation based on race/identity, and cannot be withheld from certain people without reason.

Section Six.

All naturally born citizens in Petite gain instant citizenship.

Section Seven.

All can join the army, and with that may be drafted into the armed forces.

Section Eight.

No Soldier of either the Petite army or any other form of soldier can enter the homes of civilians without direct permission, unless directed instruction from the President of Petite.

Structure of our Government,

Section One.

All terms for president (after 2025) are 4 years each, after which they need to be elected by the people with a 50.1% majority at minimum. And a voter turnout of 50% at minimum.

Section Two.

The Petite Congress will be made up of two chambers, the Lower and Upper chamber. The “Upper” chamber will be made up of Superior Delegates, the President, the Vice President, and the Secretary of Defense. The “Lower” Chamber will be made up of representatives elected yearly based on the amount of territories and provinces, this will be updated yearly.

Section Three.

The President gets 2 votes in the Upper chamber to represent the territories without representation at the time

Section Four.

All people get the right to vote, as mentioned in section five of the “rights of the people”, and this is for any politician of any kind, local or nation wide. This also means that anyone can run for office.

Section Five.

The Presidential Committee will be made up of the Secretary of Defense, the Secretary of the Treasury, the Secretary of State, and the Secretary of Justice. These advisors will be chosen by the President, and approved by both chambers of Congress. Not all positions have to be filled, they can stay vacant for 2 years of presidency.

Section Six.

All politicians can be removed from office during their term, as long as 65% of the people or 80% of the congress agrees, the representative can appeal this.

Section Seven.

The President of Petite has certain rights, and things that they do not have the jurisdiction to pass. If the President resigns or is taken out of office, they will be succeeded by the Vice President. If the Vice President resigns or is taken out of office, they will be followed by the Secretary of State, then the Secretary of Treasury, then the Secretary of Defense, then longest serving member from the Lower Chamber. If all leave office or are removed from office, any remaining Secretaries will become the sitting President of Petite.

Section Eight.

Any and all parties can have representatives towards elections, unless deemed unconstitutional or not fit for office.

Section Seven.

The President of Petite has certain rights, and things that they do not have the jurisdiction to pass. If the President resigns or is taken out of office, they will be succeeded by the Vice President. If the Vice President resigns or is taken out of office, they will be followed by the Secretary of State, then the Secretary of Treasury, then the Secretary of Defense, then longest serving member from the Lower Chamber. If all leave office or are removed from office, any remaining Secretaries will become the sitting President of Petite.

Laws of the Nation and Provinces,

Section One.

Each Province can make its own laws, these do not have to be passed by federal houses, or either chambers.

Section Two.

For nationwide laws, one representative from each province must be present at the voting. After a certain amount of time, without all representatives voting, the law/bill votes will be final.

Section Three.

All Provinces and Territories must follow nationwide laws, federal laws, and laws passed by international organizations that Petite must follow.

Section Four.

The President can Veto Bills if it was passed with a majority of 50.1-55%. Otherwise, it is very hard for a President to veto a bill without it being overturned by either chamber of congress. Both chambers would need to overturn it, as most votes are combined.

Section Five.

Those who break laws will be subject to punishments mentioned in article one, section three. And rights stated in section two, also a part of the first article, the article named “Rights of the People”.

Section Six.

All being taxed on Petite land must be represented in some way. If not, a political, department, or other can force taxes. 

Section Seven.

Territories or other districts under Petite Jurisdiction cannot make their own laws, and must follow those of the Federal Government, or laws put in place by representatives from higher Petite Government. Such as Congress, the Presidential Committee, the President or Vice President, and more.

Section Eight.

There will be three main courts. The International court, a court handled by other nations' representatives. The Federal Court/Supreme Court, this will be handed by the Petite department of justice, and the Petite Secretary of Justice.

This Constitution is made to protect the people of Petite, their rights, and their freedoms. It establishes how the government of the Federal Republic of Petite works and limits the power of those in office. This Constitution may be changed by the will of the people, as stated earlier, so that Petite can continue to grow and improve while keeping its core values. Once approved by both chambers of Congress, this Constitution shall take effect, and all representatives must agree to uphold and follow it.
