PeekCard Terms of Use

Effective date: July 31, 2026
Last updated: July 31, 2026

Please read these Terms carefully. They govern your use of PeekCard, including AI card identification, card catalog and market references, local collection tools, and auto-renewable subscription features. By downloading, accessing, purchasing through, or using PeekCard, you agree to these Terms. If you do not agree, do not use PeekCard.

1. Provider and Agreement

PeekCard is provided by the developer identified for PeekCard on the applicable Apple App Store product page (the "Developer," "we," "us," or "our"). You may contact us at guoyingchun1987@163.com.

These Terms supplement the Apple Standard Licensed Application End User License Agreement ("Apple Standard EULA"). Your license to use PeekCard is subject to the Apple Standard EULA and Apple's applicable App Store terms. If these Terms conflict with a mandatory provision of the Apple Standard EULA or applicable law, that mandatory provision controls.

2. Eligibility

You must be at least 16 years old to use PeekCard. If you have not reached the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms for you. PeekCard is not directed to children under 16.

You may not use PeekCard if applicable law prohibits you from receiving or using the Services.

3. What PeekCard Provides

PeekCard may provide:

Features, catalog coverage, providers, usage limits, and availability may vary by device, region, subscription status, network conditions, provider availability, and app version.

4. License

Subject to these Terms and the Apple Standard EULA, the Developer grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use PeekCard on Apple-branded devices that you own or control, as permitted by Apple's usage rules, solely for lawful personal use.

PeekCard is licensed, not sold. No rights are granted except those expressly stated in these Terms, the Apple Standard EULA, or mandatory law.

5. Device-Based Profile and Access

PeekCard currently does not require a conventional email, phone-number, or social-login account for its core experience. The Services may use device and SDK identifiers to establish a device-based user profile, synchronize subscription entitlement, prevent fraud, and operate app functionality.

You are responsible for maintaining control of your device and Apple Account. A device reset, app deletion, identifier change, loss of local data, or change in Apple Account may affect locally stored records or entitlement synchronization. Use Restore Purchases where available and contact us if an Apple purchase is not reflected after a reasonable synchronization period.

6. Camera, Photos, and Permissions

PeekCard requests camera access only to photograph cards for identification. You may instead select a single image using Apple's system photo picker. You can change permissions in iOS Settings.

You represent that you have the right to capture, select, and submit each image. You must not submit:

7. AI Card Identification

When you start identification, PeekCard sends the cropped card image that you confirm to Replicate for processing by the configured Google Gemini model. You grant the Developer and its service providers a limited right to host, transmit, transform, and process that image and related request data solely to provide, secure, troubleshoot, and lawfully operate the requested recognition service.

AI output is probabilistic and may be incomplete, delayed, unavailable, or wrong. PeekCard may misidentify a card, set, number, variant, rarity, language, condition, or value. You must independently verify all results before buying, selling, insuring, grading, shipping, or making another decision about a card.

PeekCard does not provide professional authentication, grading, appraisal, investment, tax, legal, or financial advice. A recognition result is not a guarantee that a card is authentic, genuine, correctly printed, or worth any particular amount.

8. Card Catalog and Market Information

Card data, images, set information, availability, and market-price references may come from third parties, including Pokémon TCG API data and TCGplayer-related references. Information may be delayed, incomplete, inaccurate, unavailable, or based on market variants that differ from your card.

Market values are informational estimates, generally displayed in USD, and are not offers to buy or sell. PeekCard does not operate a marketplace, broker transactions, guarantee liquidity, predict future prices, or determine an official appraisal or insurance value. You are solely responsible for transaction, tax, shipping, authenticity, condition, grading, and counterparty decisions.

9. Local Collection Data

Collection, wishlist, search, scan-history, note, quantity, condition, purchase-price, and date information is primarily stored locally on your device. You are responsible for the accuracy of information you enter and for maintaining any backup or export that you require.

PeekCard may apply plan-based storage or display limits. Current behavior may include a limit of 50 collection records for non-PRO use, up to the most recent 20 scan-history records for non-PRO use, and up to 200 records or approximately 180 days of scan history for PRO use. Limits may be updated for operational, security, fairness, or product reasons, subject to applicable law and any commitments shown at purchase.

The Clear All Local Data action is destructive and may not be reversible. It does not cancel an Apple subscription, issue a refund, or necessarily delete server-side purchase, entitlement, analytics, security, or legally required records.

10. PRO Subscriptions and In-App Purchases

10.1 Offer information

Available packages, billing periods, prices, currencies, trial periods, introductory prices, eligibility, and renewal terms are shown in PeekCard and Apple's purchase confirmation sheet before purchase. These details are obtained dynamically and may vary by user, region, Apple Account, eligibility, or promotional campaign. The Apple purchase sheet controls if it differs from other promotional text.

10.2 Auto-renewal and billing

PRO subscriptions are auto-renewable unless Apple states otherwise. Payment is charged to your Apple Account when you confirm the purchase. Your subscription renews automatically at the price and interval presented by Apple unless you cancel before the renewal deadline shown by Apple. Apple may notify you or request consent for certain price changes as required by its rules or applicable law.

10.3 Trials and introductory offers

A package may offer a free trial, a discounted first period, or another introductory offer. Eligibility is determined by Apple and the applicable offer. Unless canceled before the trial or introductory period ends, the subscription automatically converts to the paid renewal price displayed before purchase. An offer may not be available to users who previously received a similar benefit.

10.4 Managing and canceling

You can manage or cancel an Apple subscription in your Apple Account subscription settings. Deleting PeekCard or clearing local data does not cancel a subscription. Cancellation normally takes effect at the end of the current paid period unless Apple or applicable law provides otherwise.

10.5 Restoring and synchronizing access

Restore Purchases asks Apple to identify eligible purchases and then asks PeekCard's server to confirm membership. A successful Apple transaction may require a short synchronization period before PRO access appears. PeekCard treats server-confirmed membership status as the entitlement source for protected features.

10.6 Refunds

Apple processes App Store payments and refund requests. Refund eligibility and processing are governed by Apple's policies and applicable law. The Developer cannot access your full payment credentials and may not be able to issue an Apple refund directly.

10.7 PRO features and reasonable use

PRO may include AI scanning, additional market information, expanded collection capability, and longer scan history as described at purchase. References to "unlimited" use mean that no ordinary per-scan or per-record consumer quota is intended for normal personal use; they do not authorize automated, commercial-scale, abusive, unlawful, resale, benchmarking, model-extraction, denial-of-service, or security-testing activity. We may apply reasonable technical safeguards to protect service availability, providers, users, and costs.

11. Acceptable Use

You must not:

12. Your Content

You retain any rights you hold in images, notes, and other content that you submit. You grant the Developer and its processors a limited, worldwide, non-exclusive, royalty-free license to host, copy, transmit, format, crop, compress, analyze, and otherwise process that content only as reasonably necessary to provide, secure, troubleshoot, and improve the requested Services, comply with law, and enforce these Terms.

You are responsible for your content and for any consequences of submitting, exporting, or sharing it.

13. Developer and Third-Party Intellectual Property

PeekCard's software, interface, compilation, original graphics, text, branding, and related technology are owned by or licensed to the Developer and are protected by intellectual-property laws. These Terms do not transfer ownership to you.

Pokémon, Nintendo, Creatures, GAME FREAK, TCGplayer, Apple, Google, Gemini, Replicate, Firebase, AppsFlyer, Meta, and other names, logos, card images, characters, data, and marks belong to their respective owners. PeekCard is an independent utility and is not sponsored, endorsed, administered by, or affiliated with those rights holders unless expressly stated. Display of third-party content does not grant you a license to reuse it.

If you believe content accessible through PeekCard infringes your rights, email guoyingchun1987@163.com with identification of the work, the disputed material, your contact information, and a good-faith explanation of your claim.

14. Third-Party Services and Links

PeekCard depends on or links to services operated by Apple, Replicate, Google, Firebase, AppsFlyer, Meta, Pokémon TCG API providers, TCGplayer, and others. Third-party services are governed by their own terms and policies. The Developer does not control and is not responsible for third-party availability, content, data practices, prices, actions, or decisions.

Your use of Apple services is also governed by Apple's terms. Your use of external websites after leaving PeekCard is at your own risk.

15. Feedback and Communications

If you send feedback, ideas, or suggestions, you grant the Developer a worldwide, perpetual, irrevocable, royalty-free right to use them without restriction or compensation, provided that this does not grant ownership of personal information and remains subject to the Privacy Policy.

We may send service-related communications when reasonably necessary to respond to you, administer a transaction, notify you of material changes, protect security, or comply with law. PeekCard does not require marketing email consent as a condition of core app use.

16. Updates, Changes, and Availability

We may update PeekCard to add, modify, suspend, or remove features; address security, legal, technical, provider, or compatibility requirements; or improve performance. We do not promise that every feature, provider, card, image, price field, AI model, or external link will remain available.

We will not intentionally deprive you of a paid entitlement during an active paid period without providing a legally appropriate remedy, except where suspension is necessary for misuse, fraud, security, law, provider unavailability, or circumstances beyond reasonable control.

17. Suspension and Termination

You may stop using PeekCard at any time. We may restrict or terminate access if we reasonably believe you violated these Terms, created legal or security risk, abused a provider, failed to pay through Apple, or used the Services in a way that could harm others.

Termination does not automatically cancel an Apple subscription. You must manage cancellation through Apple. Provisions that by their nature should survive termination remain effective, including intellectual property, payment obligations, disclaimers, limitations of liability, dispute terms, and rights granted for lawful retention.

18. Disclaimers

To the maximum extent permitted by law, PeekCard is provided "as is" and "as available." The Developer disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, non-infringement, and uninterrupted or error-free operation.

Without limiting the above, we do not warrant that:

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent permitted by law, and mandatory consumer guarantees remain unaffected.

19. Limitation of Liability

To the maximum extent permitted by law, the Developer and its affiliates, licensors, providers, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, opportunity, goodwill, data, cards, or collection value; or losses arising from reliance on AI, catalog, market, authentication, grading, or pricing information.

To the maximum extent permitted by law, the aggregate liability arising from PeekCard or these Terms will not exceed the greater of the amount you paid for PeekCard during the 12 months preceding the event giving rise to the claim or USD 50.

These limitations do not exclude liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable. Mandatory consumer rights remain unaffected.

20. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless the Developer and its affiliates, licensors, and providers from third-party claims, losses, and reasonable costs arising from your unlawful use of PeekCard, content you submit, infringement of another person's rights, or material violation of these Terms. This section does not apply where prohibited by consumer law.

21. Privacy

Our Privacy Policy explains how PeekCard processes information. It is incorporated into these Terms by reference for notice purposes but does not reduce rights granted by applicable privacy law.

22. Governing Law and Disputes

These Terms are governed by the laws applicable to the Developer identified on PeekCard's Apple App Store product page, without regard to conflict-of-law rules, except that mandatory consumer-protection laws of your country or region remain applicable.

Before filing a claim, you and the Developer agree to attempt in good faith to resolve the dispute by contacting guoyingchun1987@163.com and allowing a reasonable opportunity to respond. Any unresolved dispute may be brought in a court that has jurisdiction under applicable law. Nothing in these Terms limits a consumer's right to use a competent local court, regulator, or alternative dispute-resolution body where that right cannot be waived.

23. Apple-Specific Terms

You acknowledge and agree that:

24. Changes to These Terms

We may update these Terms to reflect changes in PeekCard, providers, subscriptions, law, or business practices. We will update the "Last updated" date and provide additional notice where required. If a material change requires consent, it will not bind you until the required consent is obtained. Continued use after other changes take effect constitutes acceptance to the extent permitted by law.

25. General Terms

If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without written permission; the Developer may assign them in connection with a merger, acquisition, reorganization, or transfer of PeekCard, subject to applicable law.

These Terms, the Privacy Policy, the Apple Standard EULA, and the purchase terms displayed by Apple form the agreement governing your use of PeekCard. Purchase-specific information displayed by Apple controls for that transaction if it conflicts with general promotional text.
