Terms of Use – Peakly

These Terms of Use (“Terms”) constitute a legally binding agreement between Peakly, operated by the Service Operator (an individual) (“Company,” “we,” “us,” or “our”) and you (“User,” “you”). These Terms govern your use of:

• The Peakly mobile application (“App”)

• Any related services, including audio summaries, text summaries, information, graphics, software, notifications, and communication features (“Content”)
  
  

Collectively, the App and Content are referred to as the “Services.”

By downloading, accessing, or using the Services, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, do not use the Services.

Please also review our Privacy Policy, which is incorporated into these Terms by reference.

1. Summary of the Service

Peakly provides educational summaries of non-fiction books, including audio and text versions. These summaries are original works created by Peakly and are intended solely for learning and personal development.

Peakly does not replace reading the original book.
Peakly does not provide professional, medical, mental-health, legal, or financial advice.

2. Subscription and Payments

Peakly is offered as a subscription-based service.

• Subscriptions: Purchased through the platform's store (Apple App Store or Google Play).

• Renewal: Automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

• Account Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period.

• Cancellation: You can manage or cancel your subscription in your device's Account Settings after purchase. Deleting the app does not cancel the subscription.
  
  

3. Eligibility

You must:

• Be at least 16 years old, and

•  Have legal capacity to enter into these Terms.
  
  

If you are under the age of majority in your country (typically 18), you may use the Services only with the permission and supervision of a parent or guardian.

4. Account Registration

When signing in via Google:

• You agree to provide accurate information.

• You are responsible for all activity under your account.

• You must notify us of unauthorized account access.
  
  

We may suspend or terminate accounts that violate these Terms.

5. Important Disclaimers

• All summaries represent Peakly’s interpretations, not the original authors’ opinions.

• Authors and publishers do not endorse Peakly.

• Results from implementing ideas in summaries may vary.

• The Service is provided for educational purposes only.
  
  

Peakly is not liable for any decisions you make based on the content.

6. Intellectual Property

All content in the Services—including audio, text, graphics, and design—is the exclusive property of Peakly or its licensors.

You may not:

• Copy, reproduce, distribute, or adapt any content

• Reverse engineer, decompile, or tamper with the App

• Use the Services for commercial purposes

• Create competing products using Peakly’s content

Your use is limited to personal, non-commercial purposes.

7. User Conduct Restrictions

You agree not to:

• Interfere with the functionality of the Services

• Upload harmful software

• Use automated systems (bots, scripts)

• Circumvent access controls

• Harvest or scrape data

• Misuse the Services in any unlawful way
  
  

Violation may result in immediate termination of access.

8. Third Parties

The App may link to third-party tools or services. We are not responsible for:

• Their content

• Their policies

• Their availability
  
  

You use third-party features at your own risk.

9. Service Changes

We may modify, suspend, or discontinue parts of the Services at any time without liability.

10. Disclaimer of Warranties

The Services are provided “as is”, without warranties of any kind.

We do not guarantee:

• Accuracy

• Availability

• Uninterrupted service

Use is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law:

• Peakly is not liable for indirect, incidental, special, or consequential damages.

• Total liability shall not exceed the amount you paid for the Services during the past 12 months.
  
  

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Israel.

Exclusive jurisdiction is granted to the competent courts of Tel Aviv, Israel.

13. Termination

We may suspend or terminate your access if you violate these Terms.

You may stop using the App at any time by uninstalling it (this does not cancel subscriptions).
