By downloading, installing, accessing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the App.
1. Acceptance of Terms & Eligibility
Age Requirements: By using the App, you represent and warrant that you are at least 13 years of age (or 16 in certain jurisdictions within the European Economic Area). If you are under 18, you must have the consent of a parent or legal guardian to use the App.
Account Registration: You are responsible for maintaining the confidentiality of any credentials associated with your account and for all activities that occur under your account.
2. AI Video Generation & Intellectual Property Rights
A. User Submissions & Inputs
You retain all ownership rights in the original text prompts, photos, images, audio, or video clips you submit or upload to the App ("User Inputs").
By submitting User Inputs, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit your User Inputs solely for the purpose of generating your requested AI output and operating the App services.
B. Ownership of AI Generated Content
Subject to your compliance with these Terms, as between you and PE25 Limited, you own the video files generated by the App using your User Inputs ("Generated Content") to the extent permitted by applicable copyright and intellectual property laws.
You acknowledge that AI technology is non-deterministic, and similar prompts submitted by other users may yield identical or similar output. You do not acquire exclusive rights or ownership over generated output that is identical to that created for other users.
C. Company Intellectual Property
The App, including its code, software, user interface design, trademarks, graphics, logo, and core infrastructure, is the exclusive property of PE25 Limited and its licensors. You are granted a limited, personal, non-transferable, non-exclusive license to use the App for personal or authorized commercial purposes in accordance with these Terms.
3. User Conduct & Acceptable Use Policy
You agree NOT to use the App or generate AI content that:
Violates Laws: Infringes upon any local, national, or international law, regulation, or court order.
Infringes Rights: Violates or misappropriates any third party's copyright, trademark, patent, privacy right, publicity right, or trade secret.
Deepfakes & Non-Consensual Imagery: Creates, manipulates, or distributes non-consensual sexual, abusive, defamatory, harassing, or hate speech content involving real individuals (living or deceased) without explicit legal permission.
Harmful Content: Promotes self-harm, illegal violence, child sexual abuse material (CSAM), extremism, terrorism, or discrimination based on race, religion, gender, sexual orientation, disability, or age.
System Abuse: Reverse-engineers, decompiles, scrapes, hacks, overburdens, or interferes with the normal operation, API endpoints, or server infrastructure of the App.
We reserve the right to immediately suspend or terminate your access to the App, without prior notice or liability, if you violate these rules.
4. Subscriptions, In-App Purchases & Payments
A. In-App Purchases & Billing
The App offers premium features, consumable credits, and recurring subscription plans (e.g., weekly, monthly, or annual access).
All monetary transactions are processed securely through Google Play In-App Billing (Google Play Store). Payments will be charged to your Google Play Account at confirmation of purchase.
B. Automatic Renewal
Subscriptions automatically renew at the current subscription rate unless canceled at least 24 hours prior to the end of the current billing period.
Your Google Play Account will be charged for renewal within 24 hours prior to the end of the current period.
C. Subscription Cancellation
You may manage or cancel your subscription at any time through your Google Play Store account settings (Google Play App > Profile Icon > Payments & subscriptions > Subscriptions).
Uninstalling or deleting the App does not automatically cancel your subscription.
D. Refund Policy
All payments and refunds are governed by Google Play Store Refund Policies.
Within 48 Hours: You may request a refund directly from Google Play via Google Play Account Subscriptions.
Technical Errors: If you experience billing errors or failed rendering credits due to technical bugs, contact our support at bishopreginald559@gmail.com with your Google Play Transaction ID (GPA order number) for assistance.
Consumable Credits: In-app credits or rendering tokens that have been consumed or used are non-refundable to the extent permitted by law.
5. Disclaimers & Limitation of Liability
A. "As-Is" Service & AI Limitations
The App and all AI video generation features are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
AI generation output is highly automated and dependent on prompt inputs. We do not guarantee that the generated videos will always be accurate, error-free, photorealistic, continuous, or suitable for any specific purpose.
B. Limitation of Liability
To the maximum extent permitted by applicable law (including UK Consumer Rights Legislation), PE25 Limited and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption arising out of or related to your use or inability to use the App.
In no event shall our total aggregate liability exceed the total amount paid by you to us for using the App in the twelve (12) months preceding the event giving rise to the claim.
6. Indemnification
You agree to indemnify, defend, and hold harmless PE25 Limited, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from:
Your violation of these Terms;
Your User Inputs or Generated Content that infringes any third-party intellectual property or privacy rights;
Your misuse of the App.
7. Termination
We reserve the right, in our sole discretion, to modify, suspend, or terminate your access to the App or any part thereof, at any time with or without notice, if we believe you have breached these Terms or engaged in illegal or fraudulent behavior. Upon termination, your right to use the App will immediately cease.
8. Governing Law & Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales, without giving effect to any choice of law rules.
Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Changes to Terms of Service
We may update these Terms from time to time. When changes are made, we will update the "Last Updated" date at the top of these Terms and, where appropriate, provide an in-app notification. Your continued use of the App following the posting of revised Terms constitutes your acceptance of the changes.
