This End User License Agreement ("Agreement" or "EULA") is a legally binding contract between you ("User," "you," or "your") and AI Passport Photo & Resume Portrait Maker ("Company," "we," "us," or "our") governing your use of the AI Passport Photo & Resume Portrait Maker mobile application ("App"), available on the Apple App Store and Google Play Store.
By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not download, install, or use the App.
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a compatible mobile device that you own or control, solely for your personal, non-commercial purposes.
You agree not to, and you will not permit others to:
(a) Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App;
(b) License, sublicense, sell, resell, rent, lease, transfer, assign, distribute, time share, or otherwise commercially exploit or make the App available to any third party;
(c) Use the App for any unlawful purpose, including but not limited to the creation of fraudulent identity documents, forged passports, or any material intended to deceive governmental authorities;
(d) Use the App to generate images that violate any applicable law, regulation, or third-party right;
(e) Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the App;
(f) Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App;
(g) Upload, transmit, or distribute any content that is obscene, defamatory, harassing, offensive, or otherwise objectionable;
(h) Attempt to gain unauthorized access to the App, other user accounts, or computer systems or networks connected to the App.
The App, including all intellectual property rights therein, is and shall remain the sole and exclusive property of the Company. This Agreement does not convey to you any rights of ownership in or related to the App. All rights not expressly granted herein are reserved by the Company.
The App utilizes artificial intelligence ("AI") technology to transform user-uploaded photographs into professional-style portraits suitable for passports, resumes, CVs, LinkedIn profiles, and similar professional purposes. The AI processes your facial features to generate a modified image with professional attire and appropriate backgrounds.
We do not guarantee that AI-generated images will be accepted by any governmental authority, embassy, consulate, visa processing center, employer, or any other institution for official identification or documentation purposes. It is your sole responsibility to verify that any generated image meets the specific requirements of the intended recipient.
While our AI technology strives to produce high-quality, photorealistic results, we cannot guarantee perfect accuracy in facial feature preservation, clothing rendering, or background generation. Results may vary based on the quality of the uploaded photograph, lighting conditions, and other factors.
By uploading a photograph to the App, you grant us a limited, non-exclusive, worldwide, royalty-free license to process, transform, and temporarily store the image solely for the purpose of providing the AI portrait generation service. We do not retain, share, sell, or use your photographs for any other purpose. Uploaded images are processed in real-time and are not permanently stored on our servers.
Upon successful generation, you retain full ownership of the AI-generated portrait image. You are free to use, download, share, print, and distribute the generated image for personal and professional purposes, subject to the restrictions outlined in Section 1.2.
The App operates on a credit-based system. Each AI portrait generation requires a specific number of credits ("Credits"). Credits can be purchased through in-app purchases or subscription plans.
We offer the following subscription options:
Weekly Subscription: Provides a set number of Credits, billed weekly.
Monthly Subscription: Provides a set number of Credits, billed monthly.
Yearly Subscription: Provides a set number of Credits, billed annually.
Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
You may manage your subscription and turn off auto-renewal by going to your Account Settings on the Apple App Store or Google Play Store after purchase. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription.
All purchases are processed through the Apple App Store or Google Play Store. Refund requests are subject to the respective store's refund policies. We do not directly process refunds. For refund inquiries, please contact Apple Support or Google Play Support.
We reserve the right to modify subscription prices at any time. Any price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use of the App after a price change constitutes your acceptance of the new price.
The App collects and processes the following data:
Photographs: User-uploaded selfies or photos for AI processing. These are transmitted securely to our AI processing partner (Replicate) and are not permanently stored.
Usage Data: Anonymous usage statistics to improve app performance.
Purchase Data: Transaction information related to in-app purchases, managed by Apple or Google.
The App utilizes the following third-party services for AI image processing:
Replicate: For AI-powered image generation and facial feature preservation.
No personal identifiers (name, email, phone number, location) are shared with these services. Only the uploaded image and processing parameters are transmitted.
We implement industry-standard security measures to protect your data during transmission and processing. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
The App is not intended for use by children under the age of 13 (or the applicable age of digital consent in your jurisdiction). We do not knowingly collect personal information from children. If you believe a child has provided us with personal data, please contact us immediately.

You expressly agree not to use the App for any of the following purposes:
(a) Creating fraudulent, counterfeit, or forged identity documents of any kind;
(b) Impersonating another person or misrepresenting your identity;
(c) Generating images of individuals without their explicit consent;
(d) Creating content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;
(e) Violating any applicable local, state, national, or international law or regulation;
(f) Infringing upon any third party's intellectual property rights, rights of privacy, or rights of publicity;
(g) Distributing generated images in a manner that could cause harm, embarrassment, or distress to any individual;
(h) Using the App for any commercial purpose without our prior written consent.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
(a) The App will meet your specific requirements;
(b) The App will be uninterrupted, timely, secure, or error-free;
(c) The results obtained from the use of the App will be accurate or reliable;
(d) Any errors in the App will be corrected;
(e) AI-generated images will be accepted by any authority or institution for official purposes.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
(a) Your use or misuse of the App;
(b) Your violation of this Agreement;
(c) Your violation of any applicable law or regulation;
(d) Your violation of any rights of a third party;
(e) Any content you upload, transmit, or create using the App.
You may terminate this Agreement at any time by deleting the App from your device and ceasing all use. Termination does not entitle you to any refund of purchased Credits or subscription fees.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to your breach of this Agreement.
Upon termination:
All rights and licenses granted to you under this Agreement shall immediately cease;
You must immediately stop using the App;
Any provisions of this Agreement that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
We reserve the right to modify this Agreement at any time. We will notify you of any material changes by updating the "Last Updated" date at the top of this Agreement and, where feasible, through an in-app notification. Your continued use of the App after the effective date of any modifications constitutes your acceptance of the modified Agreement.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates, without regard to its conflict of law provisions.
Any dispute arising out of or relating to this Agreement shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the appropriate legal channels.
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and the Company regarding your use of the App and supersedes all prior agreements and understandings.
If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.
No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and the Company's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.
You may not assign or transfer this Agreement or your rights hereunder, in whole or in part, without the Company's prior written consent. The Company may assign this Agreement without restriction.
The Company shall not be liable for any failure or delay in performing its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
If you are using the App on an Apple device, the following additional terms apply:
(a) This Agreement is between you and the Company only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
(b) Apple has no obligation to provide any maintenance or support services for the App.
(c) In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. Apple has no other warranty obligation with respect to the App.
(d) Apple is not responsible for addressing any claims by you or any third party relating to the App.
(e) Apple is a third-party beneficiary of this Agreement and, upon your acceptance, will have the right to enforce it against you.
