Outwork Terms of Use (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Jakub Sochacki ("Service Provider") regarding your use of the Outwork mobile application ("Application").

By downloading, installing, or using the Application, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not download, install, or use the Application.

1. License Grant

The Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial use, subject to the terms of this Agreement.

2. Restrictions

You agree not to:

• Copy, modify, or create derivative works of the Application.

• Disassemble, decompile, or reverse engineer any part of the Application.

• Remove or alter any copyright, trademark, or other proprietary notices from the Application.

• Use the Application for any illegal or unauthorized purpose.

• Distribute, sell, lease, or rent the Application to any third party.

3. Intellectual Property

All intellectual property rights in and to the Application, including but not limited to trademarks, copyrights, and database rights, are and shall remain the exclusive property of the Service Provider.

4. Updates and Modifications

The Service Provider may, at its sole discretion, provide updates, modifications, or patches to the Application. You agree to accept and install such updates as necessary for the continued use of the Application. The Service Provider reserves the right to modify or discontinue the Application or any features thereof at any time without notice.

5. Termination

This Agreement is effective until terminated. The Service Provider may terminate this Agreement at any time without notice if you breach any terms of this Agreement. Upon termination, you must cease all use of the Application and delete all copies from your devices.

6. Disclaimer of Warranties

The Application is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service Provider does not warrant that the Application will be uninterrupted or error-free.

7. Limitation of Liability

In no event shall the Service Provider be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Application, even if the Service Provider has been advised of the possibility of such damages. The total liability of the Service Provider for any claim arising out of or relating to this Agreement shall not exceed the amount paid by you for the Application.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of laws principles.

9. Dispute Resolution

Any disputes arising out of or relating to this Agreement shall be resolved through good faith negotiations between the parties. If the dispute cannot be resolved through negotiations, it shall be submitted to binding arbitration in accordance with the rules of the Arbitration Court at the Polish Chamber of Commerce in Warsaw.

10. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11. Entire Agreement

This Agreement constitutes the entire agreement between you and the Service Provider regarding the use of the Application and supersedes all prior or contemporaneous understandings and agreements.

By downloading, installing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
