利用規約

本利用規約は、モバイルデバイス向けアプリ「Shinsiryoku+3D simulator」およびotaly2が運営する関連サービス（以下、総称して「本アプリケーション」）に適用されます。otaly2は、以下「サービス提供者」と称します。

本アプリケーションをダウンロードまたは使用することにより、お客様は本利用規約に同意したものとみなされます。本アプリケーションを使用する前に、本規約をよくお読みください。

本アプリケーションの使用許諾

お客様が本規約を遵守することを条件として、サービス提供者は、個人的または社内業務上の目的でモバイルデバイスに本アプリケーションをインストールし使用するための、限定的、非独占的、譲渡不能かつ取り消し可能なライセンスをお客様に付与します。適用法により明示的に許可されている場合を除き、またその許可された範囲を超えて、本アプリケーションの複製、頒布、改変、二次的著作物の作成、リバースエンジニアリング、逆コンパイル、または逆アセンブルを行うことはできません。

知的財産権

サービス提供者は、本アプリケーション（コード、デザイン、商標、サービスマーク、商号、ロゴ、ブランディングを含みますが、これらに限定されません。以下「知的財産」）に関するすべての知的財産権を保持します。本規約のいかなる規定も、サービス提供者の商標、ロゴ、またはブランディングを何らかの目的で使用するライセンスや権利をお客様に付与するものではありません。お客様は、本アプリケーションに表示される著作権、商標、またはその他の所有権に関する表示を削除、変更、または隠蔽しないことに同意するものとします。

利用の終了

お客様が本規約に重大な違反をした場合、サービス提供者は本アプリケーションまたはサービスへのアクセスを停止することができます。サービス提供者は違反に関する書面による通知を行い、違反の是正が可能な場合、お客様は通知受領後14日以内に当該違反を是正するものとします。当該期間内に違反を是正しなかった場合、サービス提供者は本アプリケーションへのアクセスを終了させることができます。

本アプリケーションにアクセスし使用することにより、お客様は、ご自身の居住地域（法域）において本アプリケーションを使用することが法的に許可されていることを表明するものとします。本アプリケーションを使用するには、9歳以上（お客様の居住地域におけるデジタル同意年齢）である必要があります。9歳未満の場合は、親または法定代理人がお客様に代わって本規約を確認し、同意する必要があります。

本アプリケーション、本アプリケーションの一部、またはサービス提供者の商標の無断複製や改変は、固く禁じられています。本アプリケーションのソースコードを抽出すること、本アプリケーションを他の言語に翻訳すること、または派生版を作成することは許可されません。本アプリケーションに関連するすべての商標、著作権、データベース権、およびその他の知的財産権は、サービスプロバイダーに帰属します。

ユーザー生成コンテンツおよび利用規定

本アプリケーションにおいて、ユーザーがコンテンツを投稿、共有、またはアップロードできる場合、お客様は以下のコンテンツを投稿しないことに同意するものとします。

違法なもの、または第三者の知的財産権（著作権、商標権、特許権）を侵害するもの

侮辱的、脅迫的、嫌がらせ、名誉毀損、またはヘイトスピーチにあたるもの

差別、暴力の扇動、または違法行為の助長を含むもの

スパム、フィッシング、またはマルウェアを含むもの

他者のプライバシーや個人データに関する権利を侵害するもの

誤解を招くもの、虚偽、または欺瞞的なもの

過激な暴力表現や性的なコンテンツを含むもの（適切な年齢制限が設けられている場合を除く）

コンテンツが本規約に違反している、お客様の権利を侵害している、または違法であるとお考えの場合は、サービスプロバイダー（ota007@ccn5.aitai.ne.jp）までご報告ください。報告の際には、サービスプロバイダーが当該コンテンツを特定し、苦情を検討し、必要に応じてお客様に連絡を取ることができるよう、十分な情報を含めていただく必要があります。

Terms & Conditions

These terms and conditions apply to the Shinsiryoku+3D simulator app for mobile devices, together with any related services operated by otaly2 (collectively, the "Application"). otaly2 is hereby referred to as the "Service Provider".

By downloading or using the Application, you agree to these Terms and Conditions. You should read them carefully before using the Application.

License to use the Application

Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a mobile device for personal or internal business purposes. You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except as and only to the extent that such activity is expressly permitted by applicable law.

Intellectual Property

The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos, and branding (the "IP"). Nothing in these Terms grants you any license or right to use the Service Provider's trademarks, logos, or branding for any purpose. You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed in or on the Application.

Termination

The Service Provider may suspend your access to the Application or services if you materially breach these Terms. The Service Provider will provide you with written notice of the breach and, where the breach is capable of cure, you will have 14 days from receipt of notice to remedy the breach. If you fail to cure the breach within that period, the Service Provider may terminate your access.

By accessing and using this Application, you represent that you are legally permitted to use it in your jurisdiction. You must be at least 9 years of age (the age of digital consent in your jurisdiction) to use the Application. If you are below 9, a parent or legal guardian must review and accept these Terms on your behalf.

Unauthorized copying, modification of the Application, any part of the Application, or the Service Provider's trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

User-Generated Content and Acceptable Use

If this Application allows users to post, share, or upload content, you agree not to post content that:

Is illegal or violates third-party intellectual property rights (copyright, trademark, patents)

Is abusive, threatening, harassing, defamatory, or hate speech

Contains discrimination or incitement to violence or illegal activity

Is spam, phishing, or contains malware

Violates the privacy or personal data rights of others

Is misleading, false, or deceptive

Contains explicit violence or sexual content (unless age-gated appropriately)

If you believe content violates these Terms, infringes your rights, or is unlawful, you may report it to the Service Provider at ota007@ccn5.aitai.ne.jp. The report should include enough information for the Service Provider to identify the content, evaluate the complaint, and contact you if follow-up is required.
