In DILG Legal Opinion No. 86, s. 2025, the Department emphasized the long-standing rule that ๐จ๐ง๐ฅ๐ฒ ๐ญ๐ก๐ ๐๐จ๐ฎ๐ซ๐ญ๐ฌ ๐๐๐ง ๐๐๐๐ฅ๐๐ซ๐ ๐๐ง ๐จ๐ซ๐๐ข๐ง๐๐ง๐๐ ๐ข๐ง๐ฏ๐๐ฅ๐ข๐ ๐จ๐ซ ๐ฎ๐ง๐๐จ๐ง๐ฌ๐ญ๐ข๐ญ๐ฎ๐ญ๐ข๐จ๐ง๐๐ฅ. Approved ordinances enacted by the sanggunian are presumed valid, binding, and entitled to obedience until nullified by judicial authority.
The Supreme Court in Hagedorn, et al. v. COA (G.R. No. 260458, June 4, 2024) made this clear:
โUntil after the judiciary, in an appropriate case, declare its invalidity, an ordinance is entitled to obedience and respect.โ
