AGREEMENT TO TERMS
Welcome to Muse AI ("App", "we", "us", or "our"). These Terms of Use constitute a legally binding agreement between you ("User", "you") and Muse AI regarding your use of our mobile application and services.
By downloading, installing, or using Muse AI, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use this App.
We reserve the right to modify these Terms of Use at any time. Your continued use of the App following any changes constitutes your acceptance of the new Terms.
1. USE LICENSE
Muse AI grants you a limited, non-exclusive, non-transferable license to use this App for personal, non-commercial purposes. This license does not include the right to: Modify or copy the materials; Use the materials for any commercial purpose or for any public display; Attempt to decompile or reverse engineer any software contained on the App; Remove any copyright or other proprietary notations from the materials; Transfer the materials to another person or "mirror" the materials on any other server; Violate any applicable laws or regulations in your jurisdiction.
2. USER RESPONSIBILITIES
You agree to use Muse AI in compliance with all applicable laws and regulations. You shall not: Use the App for any illegal, harmful, or unethical purposes; Infringe upon the intellectual property rights of others; Harass, threaten, or defame any person; Transmit viruses, malware, or any code of a destructive nature; Attempt to gain unauthorized access to the App or its systems; Use the App in any manner that violates these Terms of Use; Upload or share content that is obscene, hateful, or discriminatory.
3. CONTENT AND INTELLECTUAL PROPERTY
All content, features, and functionality of Muse AI, including but not limited to text, graphics, logos, images, and software, are the exclusive property of Muse AI or its content suppliers and are protected by international copyright, trademark, and other intellectual property laws.
You retain all rights to content you create or upload using Muse AI. However, by using the App, you grant Muse AI a worldwide, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of providing and improving the App's services.
4. USER-GENERATED CONTENT
You are solely responsible for any content you upload, create, or transmit through Muse AI. You represent and warrant that: You own or have the necessary rights to all content you upload; Your content does not violate any third-party intellectual property rights; Your content is accurate and does not contain false or misleading information; Your content does not violate any applicable laws or regulations.
Muse AI reserves the right to remove, delete, or modify any content that violates these Terms of Use or is otherwise objectionable.
5. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, MUSE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
This limitation applies regardless of the form of action and whether or not we have been advised of the possibility of such damages.
6. WARRANTY DISCLAIMER
MUSE AI IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE EXTENT PERMITTED BY LAW, MUSE AI MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APP, INCLUDING BUT NOT LIMITED TO: Implied warranties of merchantability or fitness for a particular purpose; Warranties of non-infringement or title; Warranties regarding the accuracy, reliability, or completeness of content; Warranties that the App will be uninterrupted or error-free.
We do not guarantee that the App will meet your requirements or that it will be suitable for any particular purpose.
7. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Muse AI and its officers, directors, employees, agents, and successors from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in connection with: Your use of the App; Your violation of these Terms of Use; Your violation of any applicable law or regulation; Your infringement of any third-party intellectual property rights; Any content you upload or create using the App.
8. TERMINATION
Muse AI reserves the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.
Sections that by their nature are intended to survive termination, including but not limited to Limitation of Liability, Warranty Disclaimer, and Indemnification, shall survive any termination of these Terms of Use.
9. THIRD-PARTY LINKS AND SERVICES
Muse AI may contain links to third-party websites and services. We are not responsible for the content, accuracy, or practices of these third-party services. Your use of third-party services is at your own risk and subject to their own terms of use and privacy policies.
We do not endorse any third-party services and are not liable for any damage or loss caused by your use of them.
10. GOVERNING LAW AND JURISDICTION
These Terms of Use shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in the United States, and you irrevocably submit to the jurisdiction of such courts.
11. SEVERABILITY
If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
