Welcome to Optimon! These Terms of Service ("Terms") govern your use of the Optimon app (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.
Creating an account is optional. However, some features may be restricted to account holders. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
The App is intended for personal, non-commercial use only. You agree not to use the App for any commercial purposes or for any illegal or unauthorized purpose.
Users can share text and pictures on the App. You retain ownership of any content you submit, post, or display on or through the App ("User Content"). By submitting User Content, you grant Optimon a non-exclusive, royalty-free, worldwide license to use, modify, publicly display, reproduce, and distribute your User Content in connection with operating and providing the App.
You agree not to post any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable. Optimon reserves the right to remove any User Content that violates these guidelines or is otherwise deemed inappropriate.
All content provided by Optimon, including text, graphics, logos, images, and software, is the property of Optimon or its content suppliers and is protected by intellectual property laws. You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the App without the express written permission of Optimon.
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and disclose information from our users. By using the App, you agree to the collection and use of information in accordance with the Privacy Policy.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. Optimon disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall Optimon be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; or (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party.
Optimon reserves the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
Optimon reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
