This Legal Policy explains our Privacy Policy, Terms & Conditions, Rejection and Replacement Policy, and other important rules related to the use of the OKnear app. By accessing, registering, or using OKnear, you agree to the policies, terms, and practices described in this document. If you do not agree with any part of these policies, you should discontinue use of the app and services.

1. PRIVACY POLICY

Introduction: Welcome to OKnear. We value the trust you place in us and recognize the importance of secure transactions and information privacy. This Privacy Policy describes how OKnear (referred to as "we", "us", or "our") collects, uses, shares, or otherwise processes your personal information through our mobile application. Our primary goal in doing so is to provide you with a safe, efficient, smooth, and customized shopping experience for your clothing needs.

By downloading, installing, or using the OKnear app, you agree to this Privacy Policy. If you do not agree, please do not use or access our app. We reserve the right to change this policy at any time, and we encourage you to review it periodically to stay informed.

1.1 Information We Collect: We collect information that you provide directly to us and some information automatically. This includes:

Personal Identification Information: Your full name, email address, and mobile phone number provided during registration and profile setup.
Delivery and Address Data: Your precise delivery address, pincode, and locality (village/area) to facilitate the delivery of goods.
Order and Transactional Information: Details of the products you purchase (item names, quantities, pricing), total transaction amounts, and your preferred payment method (e.g., Cash on Delivery).
Account and Session Data: Unique User Identifiers (UID), login credentials, and local data stored on your device.
Device & Advertising Identifiers: We automatically collect certain device information, such as your Google Advertising ID (AAID), device model, and operating system version, to provide personalized advertising and app analytics.
Loyalty Data: Tracking of successful delivery counts to determine eligibility for the "8 Deliveries = 1 Gift" rewards program.Total Spend' is tracked to calculate eligible reward values.

1.2 How We Use Your Data: We use the information we collect for the following purposes:

Account Management & Order Fulfillment: To maintain your profile, verify identity (Google Sign-In), and ensure your purchases reach the correct address.
Serviceability Verification: To determine if our delivery services are available in your specific location.
Order Tracking & Communication: To provide real-time updates on your order status and manage customer support requests.
Personalized Advertising: We use your Advertising ID to display relevant ads through Google AdMob and to measure the performance of these advertisements.
App Optimization & Security: To monitor app performance, prevent fraudulent transactions, and maintain a secure environment for all buyers.

1.3 Data Storage, Security & Sharing:

Third-Party Service Providers: We use Google Firebase for backend services and authentication. We use Google AdMob to display advertisements. These third parties handle data under Google’s privacy standards.
Advertising (Google AdMob): Our app displays ads. Google AdMob may collect and use your Advertising ID and device data to show you relevant ads and perform analytics. You can manage ad preferences in your Google Account or device settings.
Delivery Partners: Your name, address, and phone number are shared with our local delivery team solely to fulfill your orders.
No Commercial Sale: We NEVER sell or rent your personal identification data to third-party marketing agencies for their own use.
Legal Requirements: We may disclose your information if required to do so by Indian law or in response to valid requests by public authorities.
Data Security: We implement industry-standard security measures (including SSL encryption) to protect your personal data from unauthorized access or disclosure.

1.4 ACCOUNT DELETION & DATA RETENTION: In compliance with Google Play Store policies, we provide users with full control over their data:

Right to Delete: You can permanently delete your account and all associated data through the "Delete Account" option in the 'Edit Profile' section of the app.
Data Wiping: Upon account deletion, your personal profile, saved addresses, and order history are removed from our active database immediately.
Retention Period: Residual data in encrypted system backups will be fully purged within 30 days of your deletion request for security and auditing purposes.

1.5 Third-Party Services & Links:

Google Firebase: Used for secure data storage, authentication, and app hosting.
Google AdMob: Used to serve advertisements within the app. AdMob has its own privacy policy regarding the data it collects.
Google Sign-In: Used for seamless authentication. Google shares your basic profile (name, email) with us when you use this service.
Google Play Services: Used for app stability and update notifications.

2. TERMS & CONDITIONS

2.1 Eligibility : To use the OKnear app and place orders, you must meet the following criteria:

Age: You must be at least 18 years of age. If you are a minor, you may use the app only under the supervision of a parent or legal guardian.
Location: Our services are currently limited to specific serviceable pincodes within India. By placing an order, you represent that you are a resident of a serviceable area.
Valid Credentials: You must possess a valid Indian mobile number and a Google account to register.
Truthfulness: All information provided during registration (Name, Address, Pincode) must be accurate and truthful. We reserve the right to block users who provide fake or misleading information.

2.2 User Account Responsibility: When you create an account on OKnear, you agree to the following responsibilities:

Security: You are solely responsible for maintaining the confidentiality of your account credentials (Google Login). Any activity performed through your account will be considered your responsibility.
Accuracy of Data: Since we offer Cash on Delivery (COD), it is your responsibility to provide the correct delivery address and an active phone number. Our delivery partners will use this data to contact you.
Order Integrity: You agree not to place 'fake' or 'test' orders. Frequent cancellations or refusal to accept COD orders without a valid reason may lead to permanent suspension of your account.
Device Security: You should ensure that your mobile device is secure and that no unauthorized person has access to your OKnear app to place orders on your behalf."

2.3 Product Information: We strive to display the products on OKnear as accurately as possible. However:

Color Accuracy: The actual colors you see depend on your mobile screen settings and brightness. We cannot guarantee that your monitor's display of any color will be 100% accurate.
Sizing: Clothing sizes may vary between different styles and categories. Users are advised to check the size specifications before ordering.
Material & Description: Product descriptions and images are provided for guidance. While we ensure high quality, slight variations in fabric texture or embroidery may occur.

2.4 Order Acceptance & Pricing:

Your receipt of an order confirmation does not signify our acceptance of your order.

Right to Cancel: We reserve the right to accept or decline your order for any reason, such as unavailability of stock, errors in pricing, or suspicion of fraudulent activity.
Pricing: All prices are listed in Indian Rupees (₹). While we try to ensure all prices on the app are accurate, errors may occur. If we discover an error in the price of an item you have ordered, we will notify you and give you the option to reconfirm or cancel.
Delivery Fees: Applicable delivery charges or 'Free Delivery' thresholds (as shown at checkout) are final and must be paid along with the product price via Cash on Delivery (COD).

2.5 Service Availability:

OKnear currently operates in selected geographical locations within India.

Pincode Verification: Delivery is only available for 'Serviceable Pincodes' listed in our system. If your area is not covered, the app will prevent you from placing an order.
Operational Hours: Order processing and delivery happen during our standard business hours. Any delays due to public holidays, weather conditions, or local restrictions are beyond our control.

2.6 Prohibited Uses:

As a user of OKnear, you agree NOT to:

Fake Orders: Place orders with no intention of accepting them. Frequent 'Refusal at Doorstep' will lead to a permanent ban.
Abuse Support: Misuse the 'Request Replacement' feature by providing false reasons or returning damaged/used products.
Data Scraping: Use any automated system (bots/crawlers) to extract product images, prices, or data from the app.
Harassment: Harass, threaten, or abuse our delivery partners or customer support staff.
System Interference: Attempt to bypass any security features of the app or upload malicious code.

2.7 Loyalty Rewards Program:

•Eligibility: Users automatically earn 1 loyalty point for every successful, non-returned delivery.

•Offline Tracking: For purchases made at our physical store, users must provide their registered mobile number to the seller to have the delivery counted manually.

•Reward Threshold: Upon reaching eight (8) successful deliveries, the user becomes eligible for one (1) loyalty gift.•

•The value of the gift is discretionary and may be based on the user's 'Total Spend' across the 8 qualifying orders.

•Gifts must be claimed during your next order/visit and cannot be exchanged for cash.

•Redemption: Gifts can be claimed at the store or with the next online order. Once a gift is redeemed, the counter resets to zero (0).

•Discretion: OKnear reserves the right to modify or terminate the rewards program at any time without prior notice. Reward points have no cash value.

3. Rejection and Replacement Policy

IMPORTANT NOTICE: OKnear does NOT provide cash or bank refunds. Our service model is based on "Check and Accept" at the time of delivery.

3.1 Open Box Delivery (OBD) - Mandatory Inspection: To ensure total transparency, we offer and encourage Open Box Delivery.

Doorstep Inspection: You are required to open the package and inspect the product in the presence of the delivery partner.
Verification: You must check for physical damage, material quality, or if the correct item has been delivered.
Instant Rejection: If you find any damage or are unsatisfied with the quality, you have the right to Reject the order immediately at the doorstep. In this case, no payment is required, and the parcel will be taken back by the delivery partner.

3.2 Size-Replacement Policy (Post-Delivery): Once you have inspected the product, paid for it, and the delivery partner has left, we will not accept any claims for damage or quality. However, we understand that a size might not fit perfectly.

Eligibility: Replacement is available ONLY for Size Issues. We do not offer replacements for "change of mind" or "minor color variations."
The 12-Hour Window: A size replacement request must be initiated through the "My Orders" section of the app within exactly 12 hours of the delivery timestamp. After this 12-hour period, the "Request Replacement" option will be automatically disabled by the system.
Approval Process: Our team will review the request. Once approved, our delivery partner will visit for the pickup.

3.3 Condition of Item for Replacement: For a replacement to be successful, the item must meet the following criteria:

It must be in its original, unused, and unwashed condition.
All brand tags, price tags, and original packaging must be intact.
If the item is found to have been worn, washed, or damaged by the user, the replacement will be rejected, and the item will be returned to you.

4. Shipping & Delivery Policy

4.1 Serviceable Areas: At OKnear, we aim to provide a localized and efficient shopping experience.

Geographic Restrictions: Our delivery services are currently restricted to specific Pincodes and regions.
Automatic Validation: Before you can place an order, our system uses the Pincode provided in your profile to verify if our delivery partners operate in your area.
Non-Serviceable Locations: If your Pincode is not within our serviceable zone, the app will notify you immediately, and the "Place Order" feature will be disabled for that address.

4.2 Delivery Charges : We maintain a transparent pricing policy regarding shipping costs.

Standard Delivery Fee: A nominal shipping fee may be applied to orders depending on the distance and delivery partner rates. This fee is calculated and displayed clearly in your "Cart Summary" before you confirm the order.
Free Delivery Eligibility: To provide better value, we offer Free Delivery on orders that exceed a specific minimum value (e.g., ₹500 or as defined in the app's current configuration).
Combined Orders: If you order multiple items in a single transaction, they will be bundled together to minimize delivery costs.

4.3 Delivery Timeline: We strive to get your favorite clothes to you as quickly as possible.

Estimated Delivery Time: Most orders are processed and delivered within 1 to 2 business days from the date of order acceptance.
Business Hours: Deliveries are typically made between 10:00 AM and 7:00 PM.
Delays: While we aim for punctuality, delivery timelines may be affected by external factors such as extreme weather, public holidays, or local transit restrictions. In such cases, you will be notified through the app.

4.4 Cash on Delivery (COD) Process: To ensure a risk-free shopping experience, we exclusively offer the Cash on Delivery (COD) payment method.

Payment Requirement: The total invoice amount (Product Price + Shipping Fee, if any) must be paid in full to the delivery executive at the time of handing over the parcel.
Modes of Payment: While Cash is the primary mode, many of our delivery partners also accept digital payments via UPI or QR Code scanning at your doorstep.
No Partial Payments: We do not accept partial payments. The full amount stated on the app's order screen must be cleared to receive the package.

4.5 Open Box Delivery: To eliminate concerns regarding fabric quality, size accuracy, or "wrong item" issues, we provide an Open Box Delivery service.

Inspection at Doorstep: Upon the arrival of your order, you are permitted—and encouraged—to open the package and inspect the items in the presence of the delivery associate.
On-the-Spot Rejection: If the product does not match the description, has a visible defect, or the size is incorrect, you may Reject the order immediately.
Zero Obligation: If you reject the order during an Open Box inspection, you are not required to make any payment. The delivery associate will take the parcel back to the store.
Acceptance Policy: Once you have inspected the item, paid the amount, and the delivery associate has left, the "Open Box" window is closed. Any issues discovered thereafter must be handled through our Replacement Policy.

4.6 Tracking & Updates: You can stay informed about your package's journey directly through the OKnear app.

Order Statuses:

◦Pending: Your order has been received and is awaiting approval from our retail store.

◦Accepted: Your items have been picked, packed, and are ready for dispatch.

◦Out for Delivery: Our delivery partner has left the store and is heading to your address.

◦Delivered: The transaction is complete.

Delivery Coordination: On the day of delivery, our executive will contact you via the mobile number provided to ensure someone is available to receive the parcel and make the payment.

4.7 User Availability:

Our delivery partner will attempt to reach you via the mobile number provided.
If you are unavailable at the time of delivery, we will make up to two additional attempts. If the delivery fails after three attempts, the order will be automatically cancelled.

5. Cancellation Policy

5.1 Cancellation by the User:

Pre-Shipping: You can cancel your order for free at any time through the "My Orders" section as long as the status is "Pending" or "Order Accepted."
Post-Shipping: Once the order has been "Shipped" or is "Out for Delivery," the system will not allow digital cancellation. In this case, if you wish to cancel, you must use the Rejection at Doorstep process during Open Box Delivery.

5.2 Cancellation by SHIVKRUPA COLLECTION CHAMORSHI: We reserve the right to cancel any order at our sole discretion for reasons including but not limited to:

Stock Issues: If the product becomes unavailable due to unforeseen inventory errors.
Unserviceable Location: If the pincode provided is found to be outside our actual delivery range.
Incomplete Information: If the address or phone number provided is incorrect or unreachable.
Fraud Detection: If our system flags the order as a potential fraudulent or fake transaction.

5.3 Impact of Repeated Cancellations/Rejections: Since we operate on a Cash on Delivery (COD) model and provide fast local shipping, every cancellation or rejection results in logistical costs for us.

Policy: If a user repeatedly cancels orders after dispatch or rejects COD orders at the doorstep without a valid reason (e.g., product damage), OKnear reserves the right to permanently suspend or ban that user's account.

7. LEGAL NOTICE & DISCLAIMER

7.1 Nature of Business : OKnear is a digital retail platform owned and operated by SHIVKRUPA COLLECTION CHAMORSHI. We act as a reseller/retailer and not as a manufacturer. We source clothing and lifestyle products from various third-party suppliers and brands to provide them to our local community.

7.2 Third-Party Trademarks and Logos: All product names, logos, and brands displayed on this application are the property of their respective owners.

The use of these names, trademarks, and brands does not imply endorsement by us.
SHIVKRUPA COLLECTION CHAMORSHI does not claim any ownership rights over the third-party brands sold through the app.

7.3 Product Quality and Manufacturer Liability: Since we are not the manufacturers of the garments:

Fabric & Color: Any issues related to fabric quality, color bleeding, stitching defects, or durability are the sole responsibility of the original manufacturer.
Health Disclaimer: We are not liable for any skin irritations, rashes, or allergic reactions caused by the materials, dyes, or chemicals used in the production of the clothing. Users with sensitive skin are advised to wash garments before the first use.
Sizing: Sizes are provided as per the manufacturer’s standards. Variations in fit between different brands are common and do not constitute a defect on our part.

7.4 "As-Is" Information Warranty: All information, products, and services provided through the app are offered on an "as-is" and "as-available" basis. While we strive to ensure product descriptions and prices are correct, we do not warrant that all content is 100% error-free. In the event of a pricing error, we reserve the right to cancel the order and notify the user.

7.5 Limitation of Liability: To the maximum extent permitted by law, SHIVKRUPA COLLECTION CHAMORSHI and its employees shall not be liable for any direct, indirect, incidental, or consequential damages resulting from:

The use or inability to use the OKnear application.
Any unauthorized access to your user data.
Any delay in delivery due to circumstances beyond our control (Weather, local strikes, etc.).

7.6 Legal Jurisdiction: These policies and any disputes arising from the use of the OKnear app shall be governed by the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts located in Gadchiroli, Maharashtra.
