Graphmasters GmbH and our affiliated companies (“Graphmasters,” “we”, “us” or “our”) provides the NUNAV Navigation and NUNAV Courier connected navigation applications (the “NUNAV Apps”) that enable users to optimize their travel routes to improve route time and fuel efficiency. When we refer to the “NUNAV Services” throughout this Privacy Notice, we mean, collectively, the Apps, and any other services provided by us to you in connection with any of the Apps.

This Privacy Notice describes how Graphmasters may process, use, transfer, store and disclose personal information in connection with the use of the NUNAV Services. Please read this Privacy Notice carefully.

The term “personal information” or “personal data” means any information about an individual from which that person may be identified. For example, it may include your name, telephone number, email address, or payment information, and in some jurisdictions your IP address. It does not include data from which the identity of an individual has been definitively removed along with any identifiers connected to such individual (also known as anonymous or anonymized data).

Graphmasters may collect personalinformation when you:

  • Download and/or use one of the Apps;

  • Purchase a subscription to access and use the NUNAV Services;

  • Interact with and use the NUNAV Services;

  • Interact with and/or use support and other services provided by us as part of or in connection with the NUNAV Services; and

  • ·Communicate with us directly.

BY ACCESSING OR USING THE NUNAV SERVICES,OR SUBMITTING INFORMATION IN CONNECTION WITH YOUR USE OR POTENTIAL USE OF THE NUNAVSERVICES, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ THIS PRIVACY NOTICE.

2. Changes to this Privacy Notice

We reserve the right to make changes to this Privacy Notice at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Notice. You are encouraged to periodically review this Privacy Notice to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Notice by your continued use of the App(s) after the date such revised Privacy Notice is posted.

This Privacy Policy does not apply to the third-party online/mobile store from which you download and install the App(s) or make payments. We are not responsible for any of the data collected by any such third party.

3. Information we Collect

a. Information Collected Directly

Graphmasters may collect the following personal information in connection with your use of the NUNAV Services:

  • Your email address, first name and/or last name,

  • Additional contact information such as business address and phone number;

  • Your username, password and/or other login credentials; and

  • Other information you may provide by filling out forms or by contacting us (such as your feedback or other communications with us).

Please be advised that we may ask you to update your information from time to time in order to keep it accurate. Additionally, if you provide personal information to us about someone else, you must ensure that you are entitled to disclose that information to us and that, without us taking any further steps required by data protection laws, we may collect, use and disclose such information for the purposes described in this Privacy Notice. For example, you should ensure the individual concerned is aware of the terms detailed in this Privacy Notice

b. Information Collected Indirectly

Usage Information

When using or interacting with the NUNAV Services we, or our authorized third-party service providers, automatically collect information about the use and interaction with the NUNAV Services as described below (collectively, “Usage Information”).

  • General Usage Information: We collect certain information about interactions with the NUNAV Services, including information about the device used to interact with and/or access the NUNAV Services, including, without limitation, IP address, access dates and times, information about the approximate location of the person accessing the NUNAV Services (as determined through the IP address), mobile device information, device event information and log data when accessing and using the NUNAV Services. If you set your App settings to enable the App to use your device camera, the App allows for the use of the camera to capture and transmit QR and barcodes and to view the information accessed through such QR codes and barcodes.

  • Geolocation: The Apps automatically collect, track, and transmit the geolocation of the device using the App(s) during use of the Apps, and depending on the settings that you select on your device, as long as the App is installed on your device. If you are using the app for your employer, this information may be accessible to your employer.

  • Technical and Performance Information: We automatically collect and record certain technical and performance information from the Apps such as, usage statistics, performance analytics, device model, software version, error logs, connectivity status, power status, and charge level, and whether product features are working properly. Typically, all technical and performance information is gathered by Graphmasters in anonymous form and does not identify an individual personally.

Graphmasters uses Usage Information to provide the NUNAV Services, and to understand how the NUNAV Services are being used (which may include administrative and support communications with us), and other actions taken in connection with the use of the NUNAV Services. We use this information for our internal purposes, specifically to operate, maintain, secure and improve the NUNAV Services. We may also use this information to provide users with notifications, recommendations, and information about specific features of the NUNAV Services and/or additional products, services, or features we believe may be of interest to you.

Cookies and Similar Technologies

We or authorized third parties collect certain information (including, without limitation, Usage Information) by automated means using cookies, web beacons, and server logs for analytic purposes. Graphmasters tracks users use of the NUNAV Services, but does not track users across third party websites. A cookie is a small text file that is stored on a user's computer for record-keeping purposes. When you access or use the NUNAV Services, we may by means of cookies, beacons, tags, scripts, and/or similar technologies automatically collect technical information about the devices and software used to access the NUNAV Services, such as the type of Internet browser or mobile device used, IP addresses or device IDs (or other persistent identifier that uniquely identifies a mobile device on the Internet), the operating system of the mobile device accessing the NUNAV Services, and other similar technical information. Typically, all technical, analytics, and usage information is gathered by Graphmasters in anonymous form and does not identify any individual personally.

We use both session ID cookies and persistent cookies. These technologies (or a combination of them) are used to help us:

  • Compile statistics and analytics about the use of and interaction with the NUNAV Services, including details about how and where our Service are accessed, how often a certain user visits or uses the NUNAV Services, the date and time of such visits, user actions on or through the NUNAV Services, and information regarding in-App activities, and other similar traffic, usage, and trend data, which allow us to better understand the functionality of our mobile software on mobile devices and gain insights about how mobile software is used in order to improve our customer experience;

  • Gather important functionality, testing, and performance data about the NUNAV Services, including performance data related to the Apps, such as networking activity and resource usage, among other relevant data;

  • Moderate user behavior on the NUNAV Services, such as protecting against fraud and other inappropriate activities;

  • Gather demographic information about our user base; and

  • Perform other similar functions.

We may use third party tools and technologies to help us gather this information discussed above. At present, we are not using any third-party tool or technologies to gather information.

c. Information Collected from Third PartiesInformation Collected Indirectly

In some instances, weprocess personalinformation from third parties other than from you directly, which consists of: Data from our partners, such as transactionaldata from providers of payment services or location data from Google Maps.

d. Aggregated Data

With the personal information and other data (including,Usage Information) collected by us, we process “Aggregated Data”, such as statistical or demographic data. Aggregated Data may be derived from personalinformation, but is not considered personal information under the law if itdoes not directly or indirectly reveal a person’s identity. If we combine or connect Aggregated Data with personalinformation so that it can directly or indirectly identify a person, we treatthe combined data as personal information, which will be processed inaccordance with this Privacy Notice.

4. Using Personal Information

We use personal information in the following instances:

  • To perform and provide the NUNAV Services;

  • Deliver direct marketing communications to users regarding current or future products and services that we may think are of interest to you;

  • Respond to queries and requests from users, or otherwise communicate directly with users;

  • Detect any fraudulent or illegal activity against Graphmasters or its other customers;

  • Perform system maintenance and upgrades, and enable new features;

  • To comply with a legal or regulatory obligation (for example, keeping records of our sales for tax compliance); and

  • Provide information to regulatory bodies when legally required, and only as outlined below in Legal Obligations and Security.

5. Sharing Personal Information

Aside from disclosing personal information to those of our personnel who are authorized to process the information in order to provide the NUNAV Services and who are committed to confidentiality, we disclose personal information only to the third parties as described below.

a. Employers

We will share and disclose personal information of users with an employers who opens an account that covers usage of the Apps by their drivers. This will enable the Employer to track, manage and gain insights on the performance and operation of the vehicles related to its operations.

If you are a user using the Apps related to your work, please consult with your employer to learn more about how your information may be used, shared and/or disclosed by us and the employer.

b. Third-Party Service Providers

  • Hosting services providers;

  • Analytics providers;

  • Payment service providers;

  • Providers of business operations and communication tools;

  • Other third-party service providers that help us provide features and functions for the NUNAV Services (e.g., customer support providers); and

  • Professional service providers, such as auditors, lawyers, consultants, accountants and insurers.

For a list of all third-party service providers we use, please contact us. We require all third parties to respect the security of personal information and to treat it in accordance with the law. We do not allow our third-party service providers to use personal information for their own purposes and only permit them to process personal information for specified purposes and in accordance with our instructions, unless the data is rendered fully anonymous.

c. Business Transfers

We may also share data with third parties to whom we choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use personal information in the same way as set out in this Privacy Notice.

d. Affiliates and Subsidiaries

Personal information that we collected through the NUNAV Services may be shared with the employees, contractors, and agents of Graphmasters and our affiliated and subsidiary entities (“Affiliates”) who are involved in providing or improving the NUNAV Services. We obligate the employees, contractors and agents of Graphmasters and our Affiliates to ensure the security and confidentiality of personal information and to act on that personal information only in a manner consistent with this Privacy Notice.

e. Legal Obligations and Security

If we are required to disclose personal information by law, such as pursuant to a subpoena, warrant or other judicial or administrative order, our policy is to respond to requests that are properly issued by law enforcement. Under such circumstances, unless prohibited by applicable law, we will attempt to provide you with prior notice that a request for personal information has been made. However, government requests may include a court-granted non-disclosure order, which prohibits us from giving notice to the affected individual.

Note that if we receive information that provides us with a good faith belief that there is an exigent emergency involving the danger of death or serious physical injury to a person, we may provide information to law enforcement trying to prevent or mitigate the danger (if we have it), to be determined on a case-by-case basis.

6. Marketing Communications

If you are a user, and have not otherwise opted out, or if you have opted in to receive direct marketing emails from us, we may use your personal information to send you marketing information about the NUNAV Services, including new feature releases, other Graphmasters products and services, and new products released in the future (for example, insurance products or offerings) that we think may interest you. We carry out direct marketing by email.

If you no longer wish to receive marketing communications, you have the right at any time to opt out as further explained in Your Choices.

7. Your Choices

Updating and Correcting Personal information

If you would like to correct or update certain personal information (such as your contact information) please contact us at info@graphmasters.net, and we will use reasonable efforts to correct and/or update such information.

Direct Marketing

You may manage your receipt of marketing and non-transactional communications (if applicable) by clicking on the “unsubscribe” link located on the bottom of any of our marketing e-mails. We will use commercially reasonable efforts to process such requests in a timely manner. You cannot opt out of receiving transactional e-mails related to the NUNAV Services (e.g., for support or related to payment transactions).

Cookies

With respect to your choices regarding cookie and other tracking technologies, most web and mobile device browsers automatically accept cookies, but if you prefer, you can change your browser to prevent that or to notify you each time a cookie is set. You can also learn more about cookies by visiting www.allaboutcookies.org which includes additional useful information on cookies and how to block cookies using different types of browsers or mobile devices. Please note, however, that by blocking or deleting cookies used on the NUNAV Services, you may not be able to take full advantage of the NUNAV Services.

Graphmasters does not process or respond to web browsers' "do not track" signals or other similar transmissions that indicate a request to disable online tracking of users who use our Service.

8. Sensitive Data

Graphmasters does not collect, or require any user to provide, any sensitive data about race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about health and genetic, and biometric data to use the NUNAV Services.

9. Children’s Privacy

Graphmasters does not target the NUNAV Services to persons under the age of 16 and does not knowingly collect personal information from minors. Therefore, we ask you not to provide us with personal information of persons under the age of 16. If we learn that personal information of persons under 16 years of age has been collected on or through the NUNAV Services, then we may deactivate the account or otherwise terminate access to the NUNAV Services and/or make the user content inaccessible.

10. Payment Processing

We do not directly collect or store any payment information. We use third-party, PCI-compliant, payment processors, which collect payment information on our behalf in order to complete transactions. Our administrators are only able to view limited transaction information via our payment processors’ portals.

11. App Stores and External Websites

If you have downloaded the App, your app store (e.g., the Apple App Store or Google Play) may collect certain information in connection with your use of the App, including, without limitation, personal information, geolocational information, and other usage-based data. We have no control over the collection of such information by a third-party app store, and any such collection or use will be subject to that third party’s applicable privacy policies.

On or through the NUNAV Services, we may provide or make available, for informational purposes only, links to other websites or resources with which we do not have a contractual relationship and over which we do not have control (“External Websites”). Such links are not paid advertisements, nor do they constitute an endorsement by Graphmasters of those External Websites, and are provided only as a convenience. By clicking on links to External Websites, the operators of the External Websites may collect personal information. We are not responsible for the content or data collection practices of those External Websites, and the use of External Websites is subject to their respective terms of use and privacy policies.

12. Data Retention

Personal information is processed for the period necessary to fulfill the purposes for which it is collected (for example, in connection with the NUNAV Services provided to you), to comply with legal and regulatory obligations and for the duration of any period necessary to establish, exercise or defend any legal rights.

To determine the most appropriate retention periods for your personal information, we consider the amount, nature and sensitivity of your information, the reasons for which we collect and process your personal information, and applicable legal requirements.

In some instances, we may choose to anonymize personal information instead of deleting it, for statistical use, for instance. When we choose to anonymize, we make sure that there is no way that the personal information can be linked back to any specific individual.

13. Data Security and Protection

We have put in place reasonable and appropriate security measures designed to prevent personal information from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. For example, we use encryption, secure socket layer, firewalls, and password protection. In addition, we limit access to personal information to those employees, agents, contractors and the third parties who have a business need-to-know.

We also have procedures in place to deal with any suspected data security breach; however, no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we take reasonable steps to provide secure services, by using the NUNAV Services, you understand and assume the risks associated with your activities on the internet.

In addition, you have responsibility and control over protecting your personal information. For example, you, and not Graphmasters, are responsible for safeguarding your password, and other authentication information you use to access the NUNAV Services. You should not disclose your authentication information to any third party and should immediately notify Graphmasters of any unauthorized use of your password.

In addition, as described in this Privacy Notice, Graphmasters cannot secure, and has no responsibility for, any personal information that you share or release on your own or that you request us to share or release.

Im Rahmen der Geschäftsbeziehung kann es, aufgrund Art. 6 Abs. 1a) DSGVO, zur Weitergabe der Kundendaten an einen Zahlungsdienstleister kommen. Der Weitergabe der Daten kann jederzeit, mit Wirkung für die Zukunft, widersprochen werden. Eine Bevorratung der Daten erfolgt einzig für die Dauer der gesetzlich vorgeschriebenen Fristen. Im Anschluss werden die Daten gelöscht.

§ 4 Webanalyse


Aktuell wird kein Tool zur Auswertung Ihres Nutzungsverhaltens eingesetzt. Sollte sich dies ändern, werden Sie hier darüber informiert.

3. Recht auf Löschung Sie können unter den Bedingungen des Art. 17 DSGVO die Löschung Ihrer personenbezogenen Daten verlangen.

4. Recht auf Einschränkung der Verarbeitung

Sie haben im Rahmen der Vorgaben des Art. 18 DSGVO das Recht, eine Einschränkung der Verarbeitung der Sie betreffenden Daten zu verlangen.

5. Recht auf Datenübertragbarkeit

Sie haben nach Art. 20 DSGVO das Recht, die Sie betreffenden personenbezogenen Daten, die Sie uns bereitgestellt haben, in einem strukturierten, gängigen und maschinenlesbaren Format zu erhalten oder die Übermittlung an einen anderen Verantwortlichen zu verlangen.

6. Recht auf Widerruf der datenschutzrechtlichen Einwilligungserklärung

Sie haben nach Art. 7 Abs. 3 DSGVO das Recht, Ihre datenschutzrechtliche Einwilligungserklärung jederzeit zu widerrufen. Die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf erfolgten Verarbeitung wird dadurch nicht berührt.

7. Recht auf Beschwerde bei einer Aufsichtsbehörde

Wenn Sie der Ansicht sind, dass die Verarbeitung der Sie betreffenden personenbezogenen Daten gegen die DSGVO verstößt, steht Ihnen nach Art. 77 DSGVO das Recht auf Beschwerde bei einer Aufsichtsbehörde (insbesondere in dem Mitgliedstaat ihres Aufenthaltsorts, ihres Arbeitsplatzes oder des Orts des mutmaßlichen Verstoßes) zu.

§ 7 Datenschutz in den Apps

1. App-Nutzung Durch die Nutzung unserer App erklären Sie sich mit der Erhebung, Verarbeitung und Nutzung von Daten gemäß der nachfolgenden Beschreibung einverstanden.

2. Floating Car Data Die App erhebt Daten bezogen auf der Aktuellen Position des Gerät, gefahrene Geschwindigkeit und Ausrichtung. Diese Daten werden anonymisiert weiterverarbeitet und zur Verkehrsanalyse genutzt.

3. Auslesen von Kontaktdaten Die App kann, sofern es der Nutzer erlaubt, auf Kontaktdaten zugreifen, die auf dem Gerät gespeichert sind. Auslesung, Verarbeitung und Speicherung der Daten erfolgt ausschließlich auf dem Endgerät und wird zu keinem Zeitpunkt an andere Services gesendet. Sollte der Nutzer zu einem Kontakt navigieren wird ausschließlich die von Graphmasters ermittelte Geoposition and Graphmasters Services gesendet.

4. Auskunftsrecht Sie haben das jederzeitige Recht, sich unentgeltlich und unverzüglich über die zu Ihrer Person erhobenen Daten zu erkundigen. Sie haben das jederzeitige Recht, Ihre Zustimmung zur Verwendung Ihrer angegeben persönlichen Daten mit Wirkung für die Zukunft zu widerrufen. Zur Auskunftserteilung wenden Sie sich bitte an den Anbieter unter den Kontaktdaten im Impressum.

5. Kameranutzung Die App kann, sofern der Nutzer es erlaubt, auf die Gerätekamera zugreifen. Die Kamera wird ausschließlich dazu verwendet, QR-Codes und Barcodes zu erfassen und auf dem Endgerät auszuwerten.

Bitte beachten Sie auch Ihr Widerspruchsrecht nach Art. 21 DSGVO:
