By downloading, installing, or using the Nota application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Nota is an AI-powered productivity application that provides four core services:
2.1 Speech-to-Text (STT) Services
Providers: Leading speech recognition AI models from established technology companies
Functionality: Audio transcription with duration-based usage allowances
Free Tier: 2 transcription requests
Allowances measured in: Minutes of audio processing time
2.2 AI Chat Services
Providers: Multiple state-of-the-art large language models from established AI companies
Functionality: Conversational AI with context preservation and provider fallbacks
Free Tier: 3 chat requests
Allowances measured in: Input and output tokens
2.3 Note Analysis Services
Providers: Advanced reasoning AI models optimized for document analysis
Functionality: AI-powered analysis of user notes with conversation history
Free Tier: 3 note analysis requests
Allowances measured in: Input and output tokens
2.4 Image Generation and Editing Services
Providers: Advanced AI image generation models from established technology companies
Functionality: AI-powered image creation and editing capabilities with prompt-based generation
Free Tier: 2 image generation/editing requests
Allowances measured in: Number of images generated or edited

All AI and transcription services are provided through third-party AI service providers from established technology companies. Your use of these services is subject to their respective terms of service and privacy policies. We do not control these third-party services and are not responsible for their availability, performance, or any changes to their terms.
CRITICAL NOTICE:
All AI-generated content is provided for reference purposes only. You acknowledge and agree that:
AI systems can make errors, provide inaccurate information, or generate inappropriate content
AI responses may be biased, incomplete, or factually incorrect
AI-generated images may contain artifacts, inaccuracies, or unintended content. You are responsible for reviewing all generated images before use
You are solely responsible for verifying the accuracy of any AI-generated content
We are not responsible for any consequences arising from your use of AI-generated content
AI-generated content should not be used as a substitute for professional advice (medical, legal, financial, etc.)
We do not endorse, guarantee, or warrant the accuracy of any AI-generated responses
You agree NOT to use the App to:
Generate harmful, illegal, or abusive content
Generate images depicting illegal activities, violence, or explicit content
Create images that violate copyright, trademark, or personality rights
Generate deepfakes or misleading imagery intended to deceive
Create images depicting identifiable minors
Violate any applicable laws or regulations
Infringe on intellectual property rights
Attempt to reverse engineer or circumvent usage limitations
Use the service for automated or bulk processing without permission
6.1 Subscription Billing
Subscriptions automatically renew unless cancelled
Payment processed through Apple App Store
Refunds subject to Apple's refund policy and the following conditions:
No refunds are available once any AI service (chat, transcription, note analysis, or image generation) has been used after payment
Refund requests must be made before using any subscription allowances
Allowances are credited to your account upon successful payment processing
Service access may be suspended if payment issues arise until billing matters are resolved
6.2 Monthly Subscription Allowance
Each monthly subscription includes a usage credit, which provides approximately 6 million tokens (combined input and output) when using OpenAI GPT-5 Mini, or equivalent value for other AI providers based on their respective pricing. The actual token count will vary depending on the selected AI model and provider.
Example token estimates:
GPT-5 Mini: ~6 million tokens (~3M input + ~3M output)
GPT-5 Nano: ~30 million tokens
Claude Sonnet: ~500K tokens
Gemini Flash: ~3 million tokens
Image generation allowance:
Approximately 600 image generations (based on standard image generation costs)
Actual number may vary by provider and image resolution/quality settings
This allowance is allocated automatically upon successful payment on the user billing date.
6.3 Weekly Subscription Allowance
Each weekly subscription includes a usage credit, which provides approximately 1.7 million tokens (combined input and output) when using OpenAI GPT-5 Mini, or equivalent value for other AI providers based on their respective pricing. The actual token count will vary depending on the selected AI model and provider.
Example token estimates:
GPT-5 Mini: ~1.7 million tokens (~840K input + ~840K output)
GPT-5 Nano: ~8.5 million tokens
Claude Sonnet: ~140K tokens
Gemini Flash: ~840K tokens
Image generation allowance:
Approximately 170 image generations (based on standard image generation costs)
Actual number may vary by provider and image resolution/quality settings
This allowance is allocated automatically upon successful payment on the user billing date.
6.4 Purchasing Additional Allowance Credits
If your subscription allowance is depleted before the next billing cycle, you can purchase additional credits at any time. Each top-up provides a usage credit, which delivers approximately 2 million tokens (combined input and output) when using OpenAI GPT-5 Mini, or equivalent value for other AI providers based on their respective pricing.
Top-up token estimates:
GPT-5 Mini: ~2 million tokens (~1M input + ~1M output)
GPT-5 Nano: ~10 million tokens
Claude Sonnet: ~167K tokens
Gemini Flash: ~1 million tokens
Image generation allowance:
Approximately 200 image generations (based on standard image generation costs)
Actual number may vary by provider and image resolution/quality settings
Top-up credits are applied immediately upon successful payment and can be purchased multiple times as needed.
6.5 Usage Tracking
Allowances are consumed in real-time during service usage
STT billing follows provider-specific models (some providers use incremental billing units)
Token consumption varies based on content length and complexity
Image generation costs vary based on resolution, quality settings, and provider
Unused allowances roll over between billing periods
6.6 Service Availability
We strive for 99% uptime but do not guarantee uninterrupted service
Rate limits apply to prevent service abuse
Third-party provider outages may affect service availability
7.1 Data Processing
We implement encryption in transit for all API communications
Temporary files used for generating user specific content are automatically deleted after processing
Conversation history is stored anonymously and securely to enable context preservation
This conversation data is kept private and is not accessible to third parties
7.2 Data Retention
Search and note analysis history: Retained for service functionality
Audio files: Deleted immediately after transcription
Generated images: Deleted immediately after delivery to user
Usage analytics: Retained for billing and service improvement
7.3 Third-Party Data Sharing
Content is shared with AI providers (OpenAI, Anthropic, Google and others) for processing
We do not sell or share personal data to third parties
Service providers may have their own data retention policies
You retain ownership of your original content
AI-generated content ownership may be subject to provider terms
AI-generated images may be subject to specific licensing terms from the provider
You are responsible for ensuring any generated images comply with applicable laws and third-party rights before commercial use
Our app code and design are protected by copyright
Third-party provider terms apply to AI-generated content
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SERVICE
WE ARE NOT RESPONSIBLE FOR THIRD-PARTY PROVIDER ACTIONS OR FAILURES
We reserve the right to:
Modify features, pricing, or allowances with reasonable notice
Suspend or terminate accounts for Terms violations
Update these Terms
Discontinue the service with 30 days notice
You may cancel subscriptions through Apple App Store settings
Upon cancellation, existing token allowances will remain available for use until fully depleted
We may terminate accounts for violations of these Terms
Upon termination, access to paid features ceases immediately
Data deletion follows our retention policies
Initial Resolution: We encourage users to contact our support team first to resolve any disputes or concerns before pursuing legal action
Contact Process: Please reach out via our designated support channels to discuss any issues
Arbitration: Disputes that cannot be resolved through direct communication may be subject to arbitration where permitted by law
Class Action Waiver: Class action waivers apply where legally enforceable
