Introduction
Welcome to NFC EMV Card Reader - paid software, designed and built by pXdWorks, published by Viliyan Vasilev (together called "Company", "we", "our", "us").
These Terms of service statement (shortly called "Terms" in this document) govern your use of NFC EMV Card Reader software product (mobile application) and their related website located at www.sites.google.com/view/nfc-emv-card-reader (everything called "Service"). This text also includes Privacy policy statement, which governs your use of the Service and explains how we collect, safeguard, and disclose information that results from your use of our product. Your agreement with us includes these Terms and our Privacy policy legal texts (shortly "Legal texts"). You acknowledge that you have read and understood Legal texts, and agree to be bound by them. These Terms apply to all visitors, users, and others who wish to access or use this Service. If you do not agree (or cannot comply) with Legal texts, then you should not use this Service.

1. General conditions
   By using our Service, terms specified in these Legal texts will automatically apply to you. You agree to use Service for legitimate purposes and not for illegal activities. We reserve the right to limit the access to the Service to anyone, at any time, for any reason. We reserve the right to make any modifications to Service, including terminating, changing, suspending, or discontinuing at any time, without notice, too. We may impose additional rules or limits on the use. You agree that you have to review this page regularly and your continued use will mean that you agree to any changes to the Legal texts.

2. Agreements
   Following agreement texts contain important information about the Service. Please read it carefully.
   
   By using this Android application you are agreeing to the following terms of use:

- This software is designed to read and store contactless payment card data and information (which are accessible) from contactless payment cards.
- This software must only be used to read your own payment cards where legally appropriate. It must not be used for any kind of illegal purposes.
- The software must not be used for any illegal purposes. You should not use this software if you are breaking any local applicable law.
- The software could include technical or other mistakes, inaccuracies or typographical errors.
- The software is provided "as it" without warranty of any kind.
- The software shall be used at your own risk. Payment cards scanned with this application can be damaged or become totally unusable.

We (publisher and developer of this software):

- Guarantee that no data is being sent and stored by us.
- Assume no responsibility for errors or omissions in the third-party software (libraries) used in this application.
- In no event shall be liable to you or any third parties for any special, punitive, incidental, indirect or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, lost data or profits, or any liability, arising out of or in connection with the use of this software.

3. About us
   We are committed to ensuring that the Service is available to use and works properly. We promise to strive for making the Service as useful and efficient as possible. For that reason, we reserve the right to make changes to the Service at any time, for any reason. Our mission is to serve you a good working software product, you will be able to operate with whenever you want, wherever you are. You should be aware that there are certain things that we will not take responsibility for. Certain functions of Service will require an active and stable Internet connection. Thank you for choosing us and our Service!

4. Purchases
   If you wish to purchase any product or service made available through Service (simply "Purchase"), you may be asked to supply certain information relevant to your Purchase including but not limited to, your credit or debit card number, the expiration date of your card, your billing address, and your shipping information. You represent and warrant that you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase, and that the information you supply to us is true, correct, and complete. We may employ the use of third-party services for the purpose of facilitating payment and the completion of Purchase. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy. We reserve the right to refuse or cancel your order at any time for reasons including but not limited to product or service availability, errors in the description or price of the product or service, an error in your order, or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
   
   Note: We will never charge you for the product or its services without your request, permission, and in-product confirmation. We do not collect any kind of sensitive payment information or data.

5. Refund
   We are able to issue manual refunds within 15 days of the original purchase of the contract.
   If you want to cancel, reschedule or want a refund on any experiences or activities, you can do so without any additional charge within 15 days prior to the start time of the event. No refunds will be issued after that term.
   You have to contact us via email to request a refund. Our contact email is n37sn4k3@gmail.com.
   For processing your refund request, we may ask you for some additional information about your purchase. The information that you provide to us must be true, complete, and accurate. If you provide us with inaccurate or false data, and we suspect or identify fraud, we may not approve your refund request.
   
   Note: Refunds are being returned using the original method of payment.

6. Prohibited use
   You may use Service only for lawful purposes and in accordance with Terms of service.
   You cannot use the Service in the following cases:
   - (a) in case you are not the legal owner of the device;
   - (b) in any way that violates any applicable national or international law or regulation;
   - (c) for the purpose of exploiting, harming, or attempting to exploit or harm user rights;
   - (d) in any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
   
   Note: We state expressly that access to this software is given only to anyone who has a legal right to a device. If you install or use Service on a device, that you are not the legal owner of, you are breaking Legal texts and will be liable in the event of any legal proceeding or recourse to monetary, criminal, or civil sanctions that may apply later on.

7. Data collection
   We do not collect any kind of data and personal information, result of usage of this software product.

Terms used in this statement have the same meanings as in our Terms.

Important notes:
(a) We are not monitoring you and your data. All your data is being kept (stored in a database) locally, on your device, and no one (including us) has any kind of access to it. We guarantee!
(b) Data stored on your device internal's storage is being kept raw (unencrypted). It means it still can be accessed by some other software of a malicious kind.
It is your responsibility to take care of yourself by not escalating privileges of your device operating system (also known as "root"). Stay safe!

8. Information collection and use
   No information was being collected and used when using this Service.

Security note: Application uses only "NFC" and "VIBRATE" permissions. There is no "INTERNET" permission. It means that no data is being sent & stored by us (developer and publisher of this software).

9. Improper use of this product
   By agreeing to our Terms, you have expressly avowed that you will not use this Service to extort, defame, threaten, harass, abuse or stalk anyone or infringe on the personal privacy of others. You are also expressly precluding the provider of the software from any damages that may arise from your improper use of the software, as already stated.

10. License and publisher intellectual property
    Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of us and our licensors. Service is protected by copyright, trademark, and other laws of foreign countries. Service trademark and brand resources may not be used in connection with any product or service without our explicit written consent. Unless otherwise stated, we and our licensors own the intellectual property rights for all materials. All intellectual property rights are reserved. You may access this Service for your own personal use, subject to restrictions set in these terms and conditions.
    You must not (it is forbidden to):
    (a) redistribute any kind of content, subject to copyright
    (b) repost, republish, reproduce, and duplicate materials, part of Service
    (c) sell, rent, or sub-license materials, part of Service

11. Other texts
    Disclaimer: All payment cards names and their logos (used in the Service) are subsidiaries or/and registered trademarks of companies, which are not bound by this software and we (developer and publisher of this software) have nothing to deal with them.

12. Rights reservation
    We reserve the right to request that you remove all links or any particular link to our Service. You agree to immediately remove all links to our Service upon request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By linking to our Service, you are agreeing to be bound to and follow Legal texts statements.

13. Children's privacy
    Our Service do not address anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13 years of age. In the case we discover that a child under 13 has provided some with personal information, we will immediately delete this. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us, so that we will be able to do the necessary actions.

14. Content, material, and product disclaimer
    If you find anything in our Service that is offensive for any reason, you are free to contact and inform us at any moment. We will consider requests to edit or remove content, but we are not obligated to or so or to respond to you directly.
    We do not ensure that:
    (a) all the information in our products is correct, accurate, and complete
    (b) entire Service or/and materials in it will remain available
    (c) Service or/and its content will be kept up to date in future

15. Ads and content personalization
    The Service is ad-free, which means it does not show any kind of advertisements during your session.

16. Target audience and content rating
    Our Service is designed for everyone, including children (13+), and complies with Google Play Families policy requirements.
    Primary audience target age - the Service is intended for use by 13 years of age or older (in some jurisdictions, this age limit may be higher).
    Content rating - issued by International Age Rating Coalition authority.
    Additional and up-to-date content information and age ratings are available in the Google Play listing.

17. Third-party services
    The Service use third-party services which declare their own terms and policies, but in most cases these texts refer to us (developer and publisher of this software).
