Terms of Use for Digital Stamp Verification Application
Welcome to the Digital Stamp Verification Application (‘App’), a service provided by the Nigerian Bar Association (NBA) through a third party software company, LawPavilion. Please read these Terms of Use carefully as it governs the relationship between you ("You" or "Your"), LawPavilion and Nigerian Bar Association (“we,” “us,” or “our”) regarding your access and use of the App, including any content, functionality, and services offered through it. These Terms shall apply to all visitors, users and others who access or use this App.
1. Acceptance of Terms
By downloading, accessing, or using the Digital Stamp Verification App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, as well as our Privacy Policy.
2. Purpose of the App
The Digital Stamp Verification App is designed to allow users to verify the authenticity of documents bearing a digital stamp issued by the Nigerian Bar Association (NBA). The app ensures that documents are legally verified and have not been tampered with.
3. User Responsibilities
Accurate Information: You agree to provide accurate, current, and complete information when using the app and to update this information as needed.
Lawful Use: You agree to use the app only for lawful purposes and in a manner consistent with these Terms of Use. You may not use the app in any way that could damage, disable, overburden, or impair the app or interfere with any other party's use of the app.
4. Verification Process
The app verifies digital stamps by cross-referencing the data with the NBA’s secure blockchain database.
Verification results provided by the app are based on data available at the time of the query. While the app is designed to be accurate and reliable, we do not guarantee the absolute accuracy of the verification results.
5. Data Collection and Privacy
The app may collect certain personal information from users as part of the verification process. This may include, but is not limited to, device information and details of the document being verified.
We act as a data processor, handling personal data on behalf of the Nigerian Bar Association (NBA), which is the data controller. All data collected is processed in accordance with our Privacy Policy and the NBA’s data protection policies.
6. Security
We implement appropriate security measures to protect the data transmitted through the app. However, you acknowledge that no security measure is completely infallible, and we cannot guarantee the absolute security of your data.
You are responsible for the security of your device and any activities conducted through the app.
7. Intellectual Property
All content, design, text, graphics, and interfaces within the app are the intellectual property of LawPavilion or are licensed for use. You may not reproduce, distribute, or create derivative works based on any part of the app without our express written permission.
The NBA retains all rights to its digital stamp system, including the stamps, seals, and related verification data.
8. Limitation of Liability
The app is provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, we disclaim all liability for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app, even if we have been advised of the possibility of such damages.
9. Termination
We reserve the right to terminate or suspend your access to the app at our sole discretion, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties.
Upon termination, all rights granted to you under these terms will immediately cease.
10. Governing Law and Jurisdiction
These Terms of Use are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
Any disputes arising out of or related to these terms or your use of the app shall be subject to the exclusive jurisdiction of the courts in Nigeria.
11. Changes to Terms of Use
We may update these Terms of Use from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons.
Continued use of the app after any changes to the terms indicates your acceptance of the new terms.
