1. Acceptance of Terms

By downloading, installing, or using MyWallPapers AI ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. Description of Service

MyWallPapers AI provides:

• Access to a curated gallery of HD and 4K wallpapers

• AI-powered wallpaper generation using DALL-E technology

• Premium subscription options for AI generation

• Unlimited gallery downloads

3. Subscriptions

3.1 Premium Subscriptions

The App offers three auto-renewable subscription options:

Weekly Premium Subscription

• Duration: 1 week (7 days)

• Price: $4.99 USD per week

• Features: Unlimited gallery downloads, 10 AI generations per week, ad-free experience, 4K high-resolution exports, priority support

• Renewal: Automatically renews every week unless cancelled at least 24 hours before the end of the current period

• Use Case: Perfect for trying Premium features

Monthly Premium Subscription

• Duration: 1 month

• Price: $29.99 USD per month

• Features: Unlimited gallery downloads, 50 AI generations per month, ad-free experience, 4K high-resolution exports, priority support

• Renewal: Automatically renews every month unless cancelled at least 24 hours before the end of the current period

• Use Case: Most popular plan for regular users

Yearly Premium Subscription

• Duration: 1 year (12 months)

• Price: $199.99 USD per year ($16.67/month)

• Features: Unlimited gallery downloads, 750 AI generations per year, ad-free experience, 4K high-resolution exports, priority support

• Renewal: Automatically renews every year unless cancelled at least 24 hours before the end of the current period

• Savings: Best value - equivalent to $16.67 per month

3.2 Payment and Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase

• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• You can manage and cancel your subscriptions by going to your App Store account settings after purchase

3.3 Cancellation

• You can cancel your subscription at any time through your Apple ID account settings

• Cancellation takes effect at the end of the current billing period

• No refunds for unused portions of subscription periods

• Unused AI generations do not carry over to the next billing period

4. Free Features

4.1 Gallery Access

• Free users can browse the entire wallpaper gallery

• Limited free downloads per day (with advertisements)

• Full gallery access without restrictions for Premium subscribers

4.2 Advertisements

• Free users may see advertisements via Google AdMob

• Ads are displayed to free users when downloading wallpapers

• Premium subscribers receive a completely ad-free experience

5. AI Generation Service

5.1 Availability

• AI wallpaper generation is available exclusively to Premium subscribers

• Free users must subscribe to any Premium plan to access AI generation features

• AI generation uses OpenAI's DALL-E 3 technology

5.2 Generation Limits

• Weekly Plan: 10 AI generations per week

• Monthly Plan: 50 AI generations per month

• Yearly Plan: 750 AI generations per year (approximately 62 per month)

• Unused generations do not roll over to the next billing period

• Limits reset automatically at the start of each new billing period

5.3 Content Generation

• AI wallpapers are generated using OpenAI's DALL-E 3 technology

• Generation quality and accuracy may vary

• We do not guarantee specific results

• Inappropriate prompts may be rejected or filtered

• Generation may take 10-30 seconds depending on complexity

6. User Conduct

You agree NOT to:

• Use the App for any illegal purposes

• Attempt to reverse engineer or hack the App

• Generate inappropriate, offensive, or illegal content with AI

• Generate content that violates others' intellectual property rights

• Share your account credentials with others

• Abuse the AI generation feature or attempt to circumvent limits

• Violate any applicable laws or regulations

7. AI-Generated Content

7.1 Content Ownership

• AI-generated wallpapers created through the App are provided for personal use

• You retain rights to your prompts and generated images

• We do not claim ownership of user-generated content

• You may use generated wallpapers for personal, non-commercial purposes

• Commercial use of AI-generated content requires separate licensing

7.2 Content Restrictions

• The App may refuse to generate content that violates our policies

• We reserve the right to filter or block inappropriate prompts

• Repeated violations may result in account suspension

8. Intellectual Property

• Gallery wallpapers are sourced from Unsplash and other licensed providers

• All gallery content is subject to original creators' licenses

• App design, code, and branding are protected by copyright

• You may not copy, modify, or redistribute the App

• Premium features and AI technology are proprietary

9. Privacy

Your privacy is important to us. Please review our Privacy Policy at PRIVACY POLICY to understand how we collect, use, and protect your information.

Key points:

• We collect minimal personal data

• AI prompts are sent to OpenAI for processing

• AdMob collects data for ad personalization (free users only)

• We do not sell your personal information

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will be uninterrupted or error-free

• Defects will be corrected

• The App is free of viruses or harmful components

• Results from using the App will meet your expectations

• AI-generated content will be suitable for your intended purpose

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages

• Loss of profits, data, or business opportunities

• Damages arising from use or inability to use the App

• Any damages exceeding the amount you paid for the App or subscription in the past 12 months

• Issues arising from third-party services (OpenAI, AdMob, etc.)

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the App or on our website. Your continued use of the App after changes constitutes acceptance of the new Terms.

We will notify users of significant changes via:

• In-app notifications

• Email (if provided)

• App Store update notes

13. Termination

We reserve the right to:

• Terminate or suspend your access at any time for violations

• Remove any content that violates these Terms

• Discontinue the App or any features with 30 days notice

• Refund remaining subscription time on a pro-rata basis in case of App discontinuation

14. Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law principles.

2. If unresolved, disputes will be settled through binding arbitration

3. You waive any right to class-action lawsuits

4. Small claims court remains available for qualifying disputes
