Please carefully read these Terms of Use (hereinafter referred to as "My Smart sofa" as the My Smart sofa APP) before installing and using the software, any additional programs that may be provided or materials that form part of it, and/or electronic or online documents (hereinafter collectively referred to as the "Software").
This My Smart sofa does not provide for the rights and obligations of corresponding services, such as using apps downloaded from 360, Google Play, or App Store servers that are not part of the agreement, especially without involving guarantees, responsibilities, maintenance, and services.
If you install the My Smart sofa APP as an administrator or as an authorized employee of a company, and if you subsequently provide the My Smart sofa APP to users, you also agree to use the My Smart sofa APP only as described in this article. However, if you refuse the terms of this My Smart sofa, you have no right to download, install, and use the My Smart sofa app in any way.

The My Smart sofa APP is provided by Shenzhen Yikongdi Smart Home Technology Co., Ltd. for your use (hereinafter referred to as the "User"). Shenzhen Yikongdi Smart Home Technology Co., Ltd. (hereinafter referred to as the "Licensor"), in accordance with the terms of this My Smart sofa. All rights not explicitly granted in this My Smart sofa are still reserved.
2. Application purpose
The My Smart sofa APP aims to achieve data exchange and communication with the licensor's products, which enables the operation and remote control of the licensor's products, such as changing the position settings of the head, back, legs, and/or feet through the My Smart sofa APP. Other features of the licensor's product, as long as they are included in the licensor's product as a device, can be controlled through the My Smart sofa APP. Any other use of My Smart sofa APP that is different from the above does not meet the expected use and is not allowed.
3.permit
3.1The licensor grants the My Smart sofa APP users a non exclusive right to install and use the My Smart sofa APP on mobile smartphones supported by the My Smart sofa APP, where the user is its owner or has the right to dispose of the service in accordance with the terms of use, such as 360 Mobile Assistant, Google Play, or App Store, which do not violate.
3.2Users have no right to transfer or sell their rights and obligations granted by the license to third parties or to grant sub licenses.
3.3In addition, users are not allowed to distribute the My Smart sofa app for the purpose of providing it to third parties (unless the service (such as 360, Google Play, or App Store) is permitted under the terms of use) for lending, leasing, or any other distribution.
3.4If the user sells, lends, leases, or leases the licensor's products related to the My Smart sofa APP to a third party, the obligations in sections 3.2 and 3.3 shall not apply.
3.5In addition, users are not allowed to decompile, disassemble, translate, integrate, adopt, or attempt to convert software in modified form, or create exported versions of the My Smart sofa APP, neither in whole nor in part.
3.6The end user is not allowed to copy the My Smart sofa APP and the device where the backup copy is saved is the user's property, or they have the right to dispose of the device legally. Users have an obligation to protect unauthorized third parties from accessing such copies forever.
3.7The licensor will take legal action against any attempt to violate the above obligations and/or any such violation, and reserves the right to claim damages in such circumstances.
3.8This End User License Agreement also applies to potential updates provided by the licensor as an additional or replacement offer, as long as such updates are not subject to the independent license agreement.
3.9The licensor reserves the right to modify the above terms.
4.Technical prerequisites
4.1 The My Smart sofa APP is developed for use on smartphones and provided by servers for download, such as 360 Mobile Assistant, Google Play, or App Store. In addition, the My Smart sofa APP requires an appropriate operating system version. Regarding Android, an operating system version 4.3 or higher is suitable. Although the licensor attempted to adjust the My Smart sofa APP to change the operating system version and make it available on this terminal device, users do not have the right to request such updates.
4.2The user is personally responsible for checking and protecting whether the mobile terminal device they intend to install is suitable under the aforementioned technical conditions.
4.3The licensor reserves the right to adjust the technical prerequisites at any time.
5.User's security obligation for possible software conflicts: Before installing the My Smart sofa APP, due to their security responsibility, check whether this installation may cause conflicts with any software already installed. In addition, users should ensure that they are provided with backup copies of all their data. When using the My Smart sofa app, all other reasonable protective measures should be taken to avoid any possible software errors.
6. warranty
6.1The licensor guarantees that the My Smart sofa APP developed by the licensor is free of charge when downloaded from platforms, data carriers, or data transfers (such as 360 Mobile Assistant, Google Play, or App Store). In addition, the licensor guarantees that the My Smart sofa APP in all key points will respond according to user documentation, provided that it is executable on the terminal device, has not been altered, and has not installed incompatible additional software from external sources on the terminal device, or if there are no other circumstances within the user's scope that would impair operability. Users should immediately check the My Smart sofa APP after installation and notify any defects by email or letter to the contact data provided in item 9.
6.2If the My Smart sofa APP proves to have defects, the licensor has the opportunity to correct the defects by repairing or compensating for delivery and subsequent execution based on the nature of the defects and other circumstances.
6.3The licensor shall not be liable for any defects or interferences caused by unauthorized modifications to the My Smart sofa APP, improper use of software or hardware, or improper handling of accessories by users or third parties. Claims for damages caused by defects in the My Smart sofa APP can only be made in accordance with the terms of Project 7.
7.responsibility
7.1The liability of the licensor, its legal representatives, and agents for property and asset losses caused by negligence of duty and infringement is limited to intentional acts and gross negligence. In the event of a breach of significant contractual obligations (so-called "basic obligations"), the licensor also bears simple negligence liability. In any case, liability is limited to foreseeable typical contractual damages.
7.2The licensee promises to abide by the normal use of the software and apply the software separately, so that the use of the software will not cause harm to the device and life.
7.3To avoid data loss, the licensee shall use the backup copy function, but shall not conflict with any other applicable usage plan.
7.4The licensor shall not be held responsible or liable for any losses caused by the failure to use data backups before installing the software or property and personnel damage caused by improper use.
8.There is no confirmation regarding the export restrictions
The user confirms and ensures that they do not reside in a country subject to government sanctions, are classified as a "support for terrorism" country by the government, or are listed on the government's export ban list or restrictions.

10.Approve data
The technical data and information that the user agrees to process, such as the collection of technical information for terminal devices, operating systems, and user software, for the purpose of updating, supporting services, and other service industry regulations, shall be stored and used with a license (as long as necessary) connected to the My Smart sofa APP. The licensor has the right to retain and use this data in a non personal or non personal form to improve its products.
11.Deadline, Termination
This My Smart sofa remains valid as long as it is not cancelled by the parties to this agreement. If the user does not comply with the conditions of this End User License Agreement, their rights will automatically terminate without further notice from the licensor. Upon termination of this My Smart sofa, the user is obligated to immediately cease use of the application and destroy all copies of their My Smart sofa APP or partial copies of the My Smart sofa APP. After uninstalling the My Smart sofa APP software or deleting all data of the My Smart sofa APP, or deleting all data or backing up copies, this My Smart sofa will automatically end.
12.Protecting Copyright
12.1 My Smart sofa APP is protected by copyright.
12.2The licensor does not assume any guarantee of copyright protection for the licensed My Smart sofa APP or any part thereof.
13. Location and Applicable Law
The application of the laws of the People's Republic of China does not include its principles of international private law. Excluding the application of the Sales Convention.
My Smart sofa APP shall have jurisdiction over all disputes arising from this My Smart sofa.
14.severability clause
If any provision of this agreement becomes invalid or if the agreement contains any loopholes, the validity of the other provisions shall not be affected. Instead of invalid provisions, effective provisions should be considered as agreed terms that are as close as possible economically to the intentions of all parties involved; This also applies to any vulnerability situation.
15.Revision of the Agreement
Any modifications to this agreement shall be made in writing to make it effective, and there are no supplementary agreements to this agreement."
