This MOKO Privacy Policy explains how MOKO ("MOKO" "we" "us" "our") processes any personal data we collect from visitors and users of the services related to the application (collectively, the "MOKO Services").


We value the privacy of our users, subscribers, publishers, members and others who access and use the MOKO Services (collectively or individually, "you" or "users") and want you to be familiar with how we collect, use and disclose personal information from and about you.


When using the MOKO service, you may share personal information. One example is when you provide information about yourself in the process of creating a MOKO account. Another example is when you take certain public or intended public actions on the MOKO Service, such as when you broadcast content, post profile information, follow a channel, or subscribe to a broadcast channel. Given the social nature of some of the MOKO Services, this information may be collected, used or disclosed by others who participate in that social interaction. In addition, some features of the MOKO Service are designed to provide information to others about user activity, for example, to identify users who create particular clips or the subscription status of users of particular channels. We encourage you to be aware of this when considering your activities on the MOKO Services.

1. What information we collect


When we provide the MOKO service, we obtain information about you in the manner discussed below. Please note that we require certain types of information so that we can provide the MOKO service to you.

Information provided by users 


When you create an account on the App or use MOKO services, such as uploading content on the App or contacting us for technical support, you agree to provide some or all of the following personal information.

- Registration information, such as your date of birth, phone number (or email, if applicable), user identification and language.

- Profile information, such as your alias, profile picture, gender, self-description and occupation.

- User-generated content ("UGC"), such as comments, text, messages, pictures, images, videos, sounds, code or other data or materials that you upload, distribute or stream on the App while using the MOKO Services.

- facial data, for example, when you use some of the features we provide to create special effects or emojis for your streaming section or for pictures you upload on the MOKO service, but this data will only be processed offline for special effects or emojis and we will not use it for other purposes unless we have your explicit consent or make it de-identified; furthermore, we will not use your facial data for marketing or advertising purposes, nor will we share it with any third parties. In addition, if you use real person profile picture authentication, we will collect your profile picture and facial recognition video for real person profile picture authentication by comparing your profile picture and facial recognition video, with your approval. This authentication protects you from impostors and fake accounts or developing the authenticity of the MOKO service. We do not keep your facial recognition video in our servers, this video is only used for verification.

- Payment information such as full name, billing address, billing zip code, billing country, date of birth, purchase amount, payment method, credit or debit card number or other payment information required for payment.

- Transaction information, such as transaction serial numbers and transaction history since you purchased the paid service.

- With your permission, your social network contacts when you activate the "Discover Friends" feature and allow us to access your contacts.

- your Global Positioning System (GPS) information after you have given us permission to do so, but you can change access to your GPS information through the settings on your mobile device.

- Your choices and communications with us, such as information used to verify your account or resolve your feedback or complaints; and

- Information you provide when you participate in in-app surveys and events.

- Information you provide when you create a MOKO account by linking a third-party social media outlet (e.g., Facebook, Instagram, Twitter, Google) or when you link a MOKO account to a third-party social media account.




Information collected for legitimate interests 


When you use the MOKO service for legitimate interests, we may collect some or all of the following personal information from you.

- Web activity information such as your browsing history, search history, the videos or web pages you visit, the dates and times of your visits, the accounts of other users to whom you subscribe, and information about your interactions with other users.

- Information from other sources. We may obtain additional information from third parties and from sources other than the MOKO service. For example, we may obtain additional information from games or services that you use, or from social media networks (such as Facebook) that you have granted us access to. When you access the MOKO Services through a social media network, or when you connect the MOKO Services to a social media network, you authorize MOKO to collect, store and use such additional information and content in accordance with this Privacy Policy

- Device identifiers such as your operating system, browser type, mobile device make, model and serial number, Internet Protocol (IP) address, mobile carrier, screen resolution, language setting, IMEI number, IMSI number, and media access control address.

- Information about your access to and use of other applications.

- Other location information, such as information based on your SIM card.

- Mobile advertising identifiers, used by mobile operating systems and provided to advertising vendors to collect metrics on mobile applications (Apple's IDFA or Google's AAID), help us and advertisers serve ads that may be more relevant to your interests.

- Cookies, small pieces of data that enable us to provide certain features, are collected by us or our business partners to measure and understand the pages you click on and how you use the MOKO Services and to enhance your experience with the MOKO Services.


We may also collect, use and share information about you to generate and share aggregate insights that do not identify you. Aggregate data may be derived from your personal information, but is not considered personal information because it does not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users who access specific site features, to generate statistics about our users, to calculate the percentage of users who access specific site features, or to calculate ad impressions served or clicked.


The storage of and access to cookies in connection with the MOKO Services is governed by the MOKO Cookie Policy ("Cookie Policy").



2. How we use your information

We may also collect information sent by your browser ("Usage Data") when you access the Services through or via your mobile device. When you access the Services through or via your mobile device, this Usage Data may include the type of mobile device you are using, the unique ID of your mobile device, the IP address of your mobile device, and other diagnostic data. Our product integrates with the AppsFlyer SDK, which collects your advertising ID for the purpose of gathering data about user usage or application performance around your application and sending queries or notifications about you or your application.


We will only use your personal information as permitted by applicable law. In general, we use your personal information for the following purposes.

- Location: This feature is used to view nearby users and allow other users to find you, but you can choose not to provide location information.

- Phone number: Used to register your account.



This application does use third-party services that may collect information used to identify you.

- Provision of Services: to show you the MOKO Service and its content, including any interactive features on the MOKO Service, and to provide you with information, products or services that you have allowed us to provide; we also collect and use personal information to verify your eligibility and to offer prizes in connection with promotions and sweepstakes.

- Service Improvement: Improve and personalize our services by proposing new services, information, suggestions and feedback.

- Customer Management: To manage registered users' accounts, provide registered users with customer support and notifications regarding their accounts or subscriptions, and notifications of changes to the MOKO service or any other products or services we offer or provide through it.

- Communication: To communicate and interact with you directly, for example, we may send notifications about upcoming changes, promotions or improvements to the MOKO service.

- Content Review: Review images, graphics and content posted or generated on the MOKO Service to ensure that we comply with any applicable content regulations in any relevant jurisdiction.

- Content Customization: Research and analysis of your use of or interest in content, products, advertisements or services offered on the MOKO Services in order to develop and display content on our websites and applications that is tailored to your interests.

- Performance Analysis: Determine if users of the MOKO service are unique or if the same user is using the MOKO service on multiple occasions, and monitor aggregate metrics such as total number of visitors, number of videos viewed, and demographic patterns.

- Functionality and Security: Identify users who do not meet the age limit, diagnose or fix technical problems, and detect, prevent and respond to actual or potential fraud, illegal activity or intellectual property infringement.

- Compliance: enforce our terms of use and comply with our legal obligations.

- Aggregation: Aggregating the information we collect about you for one or more of the above purposes



In addition, we use your email or other login or device information to link your contact or subscriber information to your activities on our Platform across all of your devices. We are not responsible for the privacy practices of these third parties, and the information practices of these third parties are not covered by this Privacy Policy.


You can refuse or disable cookies by adjusting your browser settings. because each browser is different, please consult the instructions provided by your browser. Please note that you may need to take additional steps to reject or disable certain types of Cookies. in addition, your opt-out choices are specific to the particular browser or device you are using when you opt-out, so you may need to opt-out separately for each browser or device. If you choose to reject, disable or delete Cookies, certain features of the Platform may no longer be available to you.

3. How we share your information


- Please note that if your profile is public, then anyone on the platform can see your content and your friends and followers as well as third parties such as search engines, content aggregators and news sites may also be able to access or share your content. You can change who can see the video or image each time you upload a video.

- We may also share your information with other members of our group of companies, subsidiaries or affiliates to improve, optimize the platform and prevent illegal use.

- We may share your personal information outside of the MOKO service when we have your consent (either explicit or implicit).

- We may disclose your personal information to members of our group of companies (i.e., entities that control, are controlled by, or are under common control with us) to the extent necessary for service, customer management, content customization, advertising, analysis, authentication, functionality and security, and compliance.

- We may disclose your personal information to authorized service providers who perform certain services on our behalf. These services may include order fulfillment, credit card payment processing, customized content, analytics, security, map navigation, data storage and cloud services, support for our features, and other features offered through the MOKO service. These service providers may have access to personal information needed to perform their functions, but are not permitted to share or use such information for any other purpose. However, if you connect to a third party service through the MOKO Service or otherwise link your MOKO account to a third party service, you are requesting and authorizing us to share or authorize access to information with that third party on your behalf. We may also send information about the content you watch or your activities on the MOKO Service to that third party to enhance your experience on the MOKO Service.

- We may disclose or share your personal information with a buyer or other successor in the event of a merger, divestiture, reorganization, restructuring, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of a bankruptcy, liquidation or similar proceeding in which the personal information we hold about our users is among the transferred assets. If such a sale or transfer occurs, we will use reasonable efforts to ensure that the entity to which we transfer your personal information uses the information in a manner consistent with this Privacy Policy.

- We may access, maintain and share your personal information with regulatory, law enforcement or other authorities when we have reason to believe that disclosure is necessary to (a) comply with any applicable law, regulation, legal process or governmental request, (b) enforce applicable terms of use, including investigating potential violations, (c) detect, prevent or otherwise address illegal or suspected illegal activity, security or technical problems, (d) protect against harm to the rights, property or safety of our company, users, employees or other third parties or (e) maintain and protect the security and integrity of the MOKO Services or infrastructure.

- We may disclose aggregated information about our users. We may also share aggregated information with third parties for general business analysis. This information does not contain any personal information and may be used to develop content and services that we hope will be of interest to you and other users.



4. International data transmission


Your personal information may be processed by us, our trusted third party suppliers, outside the country in which you reside, including in countries where data protection and privacy laws or regulations may be equivalent to or the same as the data protection laws and regulations in the country in which you are located. In accordance with applicable data protection and privacy laws and regulations, we will take appropriate measures to ensure that your personal information remains protected and secure when it is transferred to a jurisdiction outside of your country where there is a lower level of protection for personal data.  These measures include (where applicable) transfers under data transfer agreements that implement standard data protection provisions.


We may also transfer your personal information outside of your country, as permitted by applicable data protection and privacy laws and regulations.  For example, we need to transfer your personal information (a) to perform a contract with you (or to take steps in advance of a contract at your request); (b) to perform a contract for your benefit; or (c) in connection with a legal claim.

When you click on a link to any other website, mobile application or third party content through the MOKO service, you will be taken to another website or other mobile application, and another entity may collect information from or about you. We have no control over, do not review, and are not responsible for these third-party websites or mobile applications or their content. Please note that the terms of this Privacy Policy do not apply to these third party websites or mobile applications or content, or to any information collected after you click on a link to these third party websites, mobile applications or content.



5. Data security


We take appropriate administrative, technical and physical security measures to protect your personal information from unauthorized access and disclosure. For example, only authorized employees are permitted to access personal information, and they may do so only for permitted business functions. In addition, we use encryption technology when transferring certain of your personal information between your systems and ours, and we use firewalls to help prevent unauthorized access to your personal information. However, please note that we cannot completely eliminate the security risks associated with the storage and transmission of your personal information. You should exercise caution when submitting information through the MOKO service and be especially careful when deciding what information to provide to us.


You are responsible for maintaining the confidentiality of your password and account information at all times.



6. Your choice


You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. Please note that when you choose to disable cookies, it will be specific to the particular browser or device you are using, so you may need to disable cookies for each type of browser or device separately. if you disable or reject cookies, please note that some parts of the Site may not be accessible or may not function properly.


You can request at any time to opt out of allowing us to send you push notifications by adjusting your mobile device's permissions.


If you don't want to share, you can turn off GPS location, microphone, camera or other similar features on your mobile device. You can also hide your location, uploaded videos, time of recent activity, and other information by adjusting the "Privacy" settings.


You may choose not to provide us with personal information, but this may prevent you from using certain features of the MOKO Services, as you may need such information to register as a user, purchase paid services, participate in promotions, surveys, sweepstakes, or file complaints.


You can change the mobile ad identifier in your mobile device or restrict ad tracking through your mobile device's privacy settings. You can make changes to your information, including accessing your information, correcting or updating your information or deleting your information by editing your profile in the App.



7. Your rights


The laws of some jurisdictions grant MOKO users specific rights, which are described in this section. Depending on applicable law, you may have all or some of the rights described below. We will respond to your request as soon as practicable (usually within one month) after the appropriate verification process, consistent with applicable law. The exercise of these rights by you is generally free of charge, unless we believe that a fee is required under applicable law.


Access Rights - You may submit a request to access the personal information we collect about you by (a) using the help or feedback features of the MOKO service, or (b) sending us your request via email at delikeji2023@gmail.com.


Right to Correction - You may submit a request to correct personal information we have collected about you by (a) using the help or feedback features on the MOKO service, or (b) sending us your request via email at delikeji2023@gmail.com.


Right to Delete - You may submit a request to delete the personal information we collect about you by (a) using the help or feedback features of the MOKO service, or (b) by sending us your request by email at. While we cannot guarantee the complete deletion of your data stored on our backup servers, we promise not to use the data on our backup servers for any other purpose.


Right to Data Portability - If your personal information was collected on the basis of your consent, you may request that we transfer some of your personal information to you or another environment you specify in a structured, commonly used and machine-readable format, if technically feasible, by (a) using the help or feedback features of the MOKO service or (b) sending us an email at your request to delikeji2023@gmail.com.


Right to Withdraw Consent - If your personal information was collected on the basis of your consent, you may withdraw your consent and ask us not to continue collecting or processing your personal information at any time by (a) using the help or feedback features of the MOKO service, or (b) sending us your request via email. Your exercise of this right will not affect processing activities that occurred prior to your withdrawal.


Right to Restrict Processing - If you believe that your personal information was collected illegally, or if you have other reasons, you may request that we stop processing your personal information by (a) using the help or feedback features on the MOKO service, or (b) sending us your request via email at delikeji2023@gmail.com. We will review your request and respond accordingly.


Right to object - If we collect any personal information about you based on legitimate interests, you may object to the processing at any time by (a) using the help or feedback features on the MOKO service or (b) sending us your request via email (delikeji2023@gmail.com). Please note that we may deny your request if we prove that there is a compelling legitimate reason for the processing that overrides your interests and freedoms, or that the processing is necessary to establish, exercise or defend a legal claim.


Rights Regarding Automated Decision Making and Profiling - If you believe that such automated decision making and profiling has a legally or similarly significant impact on you, you may request that we stop automated decision making or profiling by (a) using the help or feedback features on the MOKO service, or (b) sending us your request via email: delikeji2023@gmail.com. We will review your request and let you know if your request applies under the relevant laws and regulations.



In addition to the rights described above, you have the right to file a complaint with the competent data protection authority ("DPA"), which is usually the DPA of your country.



Children


We do not knowingly collect or store personal information from persons under the age of 18. If we learn that personal information of persons under the age of 18 has been collected on or through the MOKO service, we will take appropriate steps to delete such information.

Retain your information


We will retain your personal and other information for as long as you maintain your MOKO account.


You may request deletion of your account at any time via My > Settings > Account Management > Connected Accounts > Delete Account in the application at or by sending an email to delikeji2023@gmail.com. After we make such a request and review it appropriately, we will delete data that we do not need to retain due to regulatory, tax, insurance, litigation, or other legal requirements. For example, we will retain location, device, and usage data for as long as reasonably necessary for these purposes; while retaining such data, we may also use it for safety, security, fraud prevention and detection, and research and development purposes. In some cases, we may not be able to delete your account, for example, if there is a balance on the account or if there is an unresolved claim or dispute. After we have resolved the issue that prevented deletion, we will delete the account as described above.


We may also retain certain information if it is necessary for safety, security, and fraud prevention purposes. For example, if we deactivate a user's account due to unsafe behavior or a security incident, we may retain certain information about that account to prevent that user from opening a new MOKO account in the future.

Changes and Updates to this Privacy Policy


We may modify or revise our Privacy Policy from time to time. Although we may attempt to notify you of material changes to this Privacy Policy, you should periodically check the most current version of the MOKO service so that you are aware of any changes, as they are binding on you.


If we change anything in the Privacy Policy, the date of the change will be reflected in the "Last Updated Date". By continuing to access or use the Services after these changes become effective, you agree to be bound by the revised Privacy Policy.
