Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use. This license is granted in accordance with the Apple Media Services Terms and the Usage Rules of the App Store.
You agree not to:
Reverse engineer, decompile, or disassemble the App, except where such activity is expressly permitted by applicable law.
Modify, adapt, translate, or create derivative works based on the App.
Remove or alter any proprietary notices contained within the App.
Use the App in a way that violates applicable laws, regulations, or the rights of any third party.
Attempt to interfere with the normal operation of the App or with any device or network on which the App runs.
The App allows you to create and manage custom mineral entries, personal collections of finds, collection trips, and related notes and value estimates. This content is stored locally on your device. You retain full ownership of the content you create. You are solely responsible for the accuracy, legality, quality, backup, and use of that content.
MohsVault is a personal mineral reference and collection-tracking tool. It does not provide professional gemological, geological, mineralogical, or financial appraisal advice. Identification suggestions, hardness references, and value estimates produced by the App are informational approximations only. They are provided for personal use only and should not be treated as expert guidance.
You are responsible for verifying important information independently and for consulting a qualified professional before making identification, purchase, sale, or valuation decisions regarding any specimen.
The App may allow you to export or share a text summary of your collection. You are responsible for reviewing exported or shared content before sending it to others. Once you share content through system features or another app, that content is handled according to the policies and settings of the receiving service.
The App stores your content locally on your device. You are responsible for maintaining any backups you consider necessary. Deleting records inside the App, using "Erase Everything", or uninstalling the App may permanently remove locally stored minerals, collections, trips, preferences, and related records.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of mineral records, collections, trip plans, notes, value estimates, or other locally stored data, arising out of or in connection with your use of, or inability to use, the App. Our aggregate liability under these Terms shall not exceed the amount you actually paid for the App, if any, during the twelve months preceding the event giving rise to the claim.
We may release updates to the App from time to time. Updates may add, modify, or remove features. We may also revise these Terms. The updated Terms will be indicated by a new "Effective date". Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms remain in effect until terminated. You may terminate them at any time by uninstalling the App. We may suspend or terminate your license if you materially breach these Terms. Upon termination, your right to use the App ceases and you must remove it from your devices.
You acknowledge that these Terms are concluded between you and the developer only, and not with Apple. Apple is not responsible for the App or its content. In case of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, will have the right to enforce these Terms against you.
These Terms are governed by and construed in accordance with the laws applicable in your country of residence, without regard to its conflict of law provisions, and subject to the mandatory consumer protection rules that may apply.
