1.0 ACCEPTANCE OF TERMS

1.1 AGREEMENT

By downloading, installing, accessing, or using 2248 Merge Journey ("the App,"

"Game," "we," "us," or "our"), you agree to be bound by these Terms of Use

("Terms"). If you do not agree to these Terms, do not use the App.

1.2 UPDATES TO TERMS

We may update these Terms from time to time. Continued use of the App after

changes constitutes acceptance of the updated Terms. We encourage you to

review these Terms periodically.

1.3 ADDITIONAL TERMS

Certain features may be subject to additional terms, which will be presented

to you when you access those features.

2.0 ELIGIBILITY AND ACCESS

2.1 AGE REQUIREMENTS

The App is rated 4+ and is designed for all ages. There are no age restrictions

for using the App. Children under 13 may use the App without parental consent

because we do not collect personal information.

2.2 PARENTAL SUPERVISION

While children of all ages may use the App, we encourage parental supervision

of children's mobile device usage.

2.3 GEOGRAPHIC AVAILABILITY

The App is available worldwide, subject to local laws and app store policies.

Some features may not be available in all regions.

2.4 NO ACCOUNT REQUIRED

You can use the App without creating an account. An anonymous user identifier

is automatically generated for you to save your progress.

2.5 DEVICE REQUIREMENTS

To use the App, you need:

(a) iOS 14.0 or later, OR Android 9.0 or later

(b) Internet connection (for cloud sync and leaderboards)

(c) Sufficient device storage

3.0 DESCRIPTION OF SERVICE

3.1 THE GAME

2248 Merge Journey is a free-to-play mobile puzzle game where you:

(a) Connect chains of same-numbered tiles

(b) Merge tiles to create higher values

(c) Earn points and progress through levels

(d) Compete on global and country leaderboards

3.2 FREE TO PLAY

The App is free to download and play. You do not need to make any purchases

to enjoy the full game experience.

3.3 ADVERTISING

The App displays advertisements:

(a) Banner Ads: Small advertisements at the bottom of the game screen

(b) Rewarded Video Ads: Optional ads you can watch to earn virtual gems

3.4 NO IN-APP PURCHASES

Currently, the App does not offer in-app purchases. All features are available

through gameplay or watching optional rewarded advertisements.

3.5 SERVICE AVAILABILITY

We strive to keep the App available at all times but do not guarantee

uninterrupted access. We may:

(a) Perform maintenance that temporarily limits availability

(b) Update the App to improve features or fix issues

(c) Modify or discontinue features with or without notice

4.0 ACCEPTABLE USE POLICY

4.1 PERMITTED USES

You may use the App to:

(a) Play the game for personal entertainment

(b) Compete on leaderboards

(c) Connect with friends via friend codes

(d) Watch rewarded ads to earn virtual currency

4.2 PROHIBITED CONDUCT

You agree NOT to:

(a) Cheating and Exploitation

    - Use hacks, cheats, bots, or automated scripts

    - Exploit bugs or glitches for unfair advantage

    - Manipulate scores or leaderboard rankings

    - Use modified versions of the App

(b) Offensive Content

    - Use offensive, vulgar, or inappropriate usernames

    - Use names that impersonate others or are misleading

    - Use names that contain hate speech or discrimination

    - Use names that reference illegal activities

(c) Harmful Activities

    - Attempt to access other users' data

    - Interfere with the App's operation or servers

    - Reverse engineer, decompile, or disassemble the App

    - Distribute malware or harmful code

    - Circumvent security measures

(d) Commercial Exploitation

    - Sell or transfer your account or virtual items

    - Use the App for commercial purposes without permission

    - Advertise or promote third-party products

4.3 ENFORCEMENT

We reserve the right to:

(a) Remove or modify inappropriate usernames

(b) Reset or delete accounts that violate these Terms

(c) Ban users who engage in prohibited conduct

(d) Report illegal activities to appropriate authorities

5.0 INTELLECTUAL PROPERTY RIGHTS

5.1 OUR OWNERSHIP

The App and all its content, including but not limited to:

(a) Game design, mechanics, and rules

(b) Graphics, artwork, and visual elements

(c) Music, sound effects, and audio

(d) Software code and architecture

(e) Text, logos, and trademarks

(f) User interface design

are owned by New Version Limited or our licensors and are protected by

intellectual property laws.

5.2 YOUR LICENSE

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable,

revocable license to:

(a) Download and install the App on your personal device

(b) Use the App for personal, non-commercial entertainment

(c) Access features available to you through normal gameplay

5.3 RESTRICTIONS

You may NOT:

(a) Copy, modify, or distribute the App or its content

(b) Create derivative works based on the App

(c) Remove or alter any copyright or trademark notices

(d) Use our trademarks without written permission

(e) Use the App's content for any commercial purpose

5.4 USER CONTENT

When you create a display name, you:

(a) Grant us a license to display it on leaderboards

(b) Represent that it does not infringe third-party rights

(c) Understand we may modify or remove it if inappropriate

6.0 VIRTUAL CURRENCY (GEMS)

6.1 EARNING GEMS

You can earn virtual currency ("Gems") through:

(a) Completing levels and achievements

(b) Watching rewarded video advertisements

(c) Daily rewards and bonuses

6.2 USING GEMS

Gems can be used within the App to:

(a) Unlock cosmetic themes and backgrounds

(b) Purchase power-ups for gameplay assistance

6.3 NO REAL VALUE

Gems have NO real-world monetary value. You acknowledge that:

(a) Gems cannot be exchanged for real currency

(b) Gems cannot be transferred to other users

(c) Gems cannot be sold, traded, or bartered

(d) We may adjust Gem values or earning rates at any time

6.4 NO REFUNDS

Gems are non-refundable. If your account is terminated for violating these

Terms, you forfeit all accumulated Gems.

6.5 VIRTUAL NATURE

Gems exist only within the App and have no existence outside of it. We may

modify, suspend, or discontinue Gems or the virtual economy at any time.

7.0 ADVERTISEMENTS

7.1 CONSENT TO ADVERTISEMENTS

By using the App, you consent to the display of advertisements. Ads help us

provide the App for free.

7.2 TYPES OF ADVERTISEMENTS

(a) Banner Ads

    Automatically displayed during gameplay. You cannot skip these ads,

    but they do not interrupt your gameplay.

(b) Rewarded Video Ads

    Completely voluntary. You choose when to watch these ads to earn Gems.

    You are never required to watch rewarded ads.

7.3 THIRD-PARTY CONTENT

Advertisements are provided by Google AdMob. We do not control the content

of these advertisements. The appearance of an ad does not constitute our

endorsement of the advertiser or their products.

7.4 CHILD-APPROPRIATE ADS

We configure our advertising to show only contextual, non-personalized ads

appropriate for all ages. If you see an inappropriate ad, please report it

to mergejourney-support@newversion.tech.

7.5 ADVERTISING POLICIES

Advertisements are subject to Google's advertising policies. We are not

responsible for:

(a) Third-party products or services advertised

(b) Accuracy of advertising claims

(c) Your interactions with advertisers

8.0 LEADERBOARDS AND SOCIAL FEATURES

8.1 LEADERBOARDS

The App features leaderboards that display:

(a) Your display name (username)

(b) Your high score

(c) Your country (derived from device locale)

(d) Your rank compared to other players

8.2 PUBLIC DISPLAY

By using leaderboards, you understand that your display name, score, and

country are visible to all other players. Do not use a display name that

reveals personal information you wish to keep private.

8.3 FRIEND FEATURES

You can connect with friends using friend codes:

(a) Share your unique friend code with people you know

(b) Add friends by entering their friend codes

(c) View friends' scores and progress

8.4 NO DIRECT COMMUNICATION

The App does not include chat, messaging, or direct communication features.

You cannot send messages to other players through the App.

8.5 FAIR PLAY

We reserve the right to remove users from leaderboards who:

(a) Use cheats or exploits to achieve unfair scores

(b) Have inappropriate or offensive usernames

(c) Violate these Terms of Use

9.0 PRIVACY AND DATA PROTECTION

9.1 PRIVACY POLICY

Our collection and use of your information is governed by our Privacy Policy,

available at [Privacy Policy URL]. By using the App, you agree to our Privacy

Policy.

9.2 MINIMAL DATA COLLECTION

We collect only minimal data necessary for the App to function. We do not

collect personal information such as your real name, email, or phone number.

9.3 CHILDREN'S PRIVACY

We comply with the Children's Online Privacy Protection Act (COPPA) and do

not knowingly collect personal information from children under 13. See our

Privacy Policy for details.

10.0 DISCLAIMERS AND WARRANTIES

10.1 "AS IS" SERVICE

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND,

EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

(a) IMPLIED WARRANTIES OF MERCHANTABILITY

(b) FITNESS FOR A PARTICULAR PURPOSE

(c) NON-INFRINGEMENT

(d) ACCURACY OR COMPLETENESS

10.2 NO GUARANTEE

We do not guarantee that:

(a) The App will be uninterrupted or error-free

(b) Defects will be corrected

(c) The App is free of viruses or harmful components

(d) Results from using the App will be accurate

(e) Your data will never be lost

10.3 THIRD-PARTY SERVICES

We are not responsible for third-party services, including but not limited to:

(a) Google AdMob advertising services

(b) App store platforms (Apple App Store, Google Play)

(c) Internet service providers

10.4 USE AT YOUR OWN RISK

You use the App at your own risk. You are responsible for any damage to your

device or loss of data that may result from using the App.

11.0 LIMITATION OF LIABILITY

11.1 LIMITATION

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEW VERSION LIMITED AND ITS OFFICERS,

DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

(a) Indirect, incidental, special, consequential, or punitive damages

(b) Loss of profits, data, use, goodwill, or other intangible losses

(c) Damages arising from your use or inability to use the App

(d) Damages arising from unauthorized access to your data

(e) Damages arising from third-party content or services

11.2 MAXIMUM LIABILITY

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US

IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN NEW ZEALAND DOLLARS

(NZD $10), WHICHEVER IS GREATER.

11.3 JURISDICTIONAL LIMITATIONS

Some jurisdictions do not allow the exclusion or limitation of certain

warranties or liabilities. In such jurisdictions, our liability shall be

limited to the maximum extent permitted by law.

12.0 INDEMNIFICATION

12.1 YOUR AGREEMENT TO INDEMNIFY

You agree to indemnify, defend, and hold harmless New Version Limited and

its officers, directors, employees, agents, and affiliates from any claims,

damages, losses, costs, and expenses (including reasonable legal fees)

arising from:

(a) Your use of the App

(b) Your violation of these Terms

(c) Your violation of any third-party rights

(d) Your display name or any content you create

(e) Any fraudulent or illegal activity by you

13.0 DISPUTE RESOLUTION

13.1 GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws

of New Zealand, without regard to conflict of law principles.

13.2 INFORMAL RESOLUTION

Before filing a formal legal claim, you agree to contact us at

mergejourney-support@newversion.tech to attempt informal resolution. We will

try to resolve disputes within 30 days.

13.3 JURISDICTION

Any legal proceedings arising from these Terms shall be brought exclusively

in the courts of New Zealand. You consent to the personal jurisdiction of

such courts.

13.4 CLASS ACTION WAIVER

TO THE EXTENT PERMITTED BY LAW, YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL

BASIS AND WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS-WIDE

ARBITRATION.

14.0 TERMINATION

14.1 YOUR RIGHT TO TERMINATE

You may stop using the App at any time by uninstalling it from your device.

To delete your cloud data, contact us at mergejourney-support@newversion.tech.

14.2 OUR RIGHT TO TERMINATE

We may suspend or terminate your access to the App at any time, with or

without cause, and with or without notice. Reasons for termination include:

(a) Violation of these Terms

(b) Fraudulent or illegal activity

(c) Conduct harmful to other users or to us

(d) Extended inactivity (more than 24 months)

(e) Discontinuation of the App

14.3 EFFECT OF TERMINATION

Upon termination:

(a) Your license to use the App ends immediately

(b) You must uninstall the App from your devices

(c) Your accumulated Gems are forfeited

(d) We may delete your data

14.4 SURVIVAL

The following sections survive termination: Intellectual Property Rights,

Disclaimers and Warranties, Limitation of Liability, Indemnification, and

Dispute Resolution.

15.0 GENERAL PROVISIONS

15.1 ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement

between you and New Version Limited regarding the App.

15.2 SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining

provisions shall continue in effect.

15.3 WAIVER

Our failure to enforce any right or provision of these Terms shall not

constitute a waiver of that right or provision.

15.4 ASSIGNMENT

You may not assign or transfer your rights under these Terms. We may assign

our rights to any affiliate or successor.

15.5 NO THIRD-PARTY BENEFICIARIES

These Terms do not create any third-party beneficiary rights.

15.6 HEADINGS

Section headings are for convenience only and do not affect interpretation.

15.7 LANGUAGE

These Terms are written in English. Any translations are for convenience only.

In case of conflict, the English version prevails.
