Please read these Terms of Use ("Terms," "Terms of Use") carefully before using the MedSnap mobile application (the "App") operated by Medsnap ("we," "us," or "our").
AGREEMENT TO TERMS
By downloading, installing, accessing, or using our App, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms, you may not access or use the App.
These Terms constitute a legally binding agreement between you and Medsnap. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
DESCRIPTION OF SERVICE
Medsnap is a mobile application that provides:
• AI-powered pill and medication identification from images
• Drug information and medication details
• Drug interaction checking
• AI health assistant for medication-related queries
• Medication reminder and tracking features
• Medication history management
The App uses artificial intelligence and third-party services to provide these features. We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without prior notice.

CRITICAL: THE APP IS FOR INFORMATIONAL PURPOSES ONLY AND IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
• Not Medical Advice: The information provided by the App, including medication identification, drug information, interaction checks, and health assistant responses, is for informational and educational purposes only. It is not intended to replace professional medical advice, diagnosis, or treatment.
• Consult Healthcare Professionals: Always seek the advice of your physician, pharmacist, or other qualified health provider with any questions you may have regarding a medical condition, medication, or treatment. Never disregard professional medical advice or delay in seeking it because of information provided by this App.
• Emergency Situations: In case of a medical emergency, contact your local emergency services immediately. Do not rely on this App for emergency medical situations.
• Accuracy Limitations: While we strive to provide accurate information, medication identification and drug information may not always be 100% accurate. The App uses AI technology that may make errors. Always verify medication information with a healthcare professional.
• No Doctor-Patient Relationship: Use of this App does not create a doctor-patient relationship between you and Medsnap or any healthcare provider.
• User Responsibility: You are solely responsible for decisions made based on information from the App. Medsnap is not responsible for any adverse effects, injuries, or health complications resulting from your use of the App or reliance on its information.
• Medication Administration: Do not take, stop taking, or change the dosage of any medication based solely on information from this App without consulting a healthcare professional.
ELIGIBILITY
• Age Requirement: You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App.
• Legal Capacity: You represent that you have the legal capacity to enter into these Terms and to use the App in accordance with all applicable laws and regulations.
• Prohibited Jurisdictions: You may not use the App if you are located in a jurisdiction where use of the App is prohibited by law.
USER ACCOUNTS AND RESPONSIBILITIES
• Account Security: You are responsible for maintaining the confidentiality of any account information and for all activities that occur under your account.
• Accurate Information: You agree to provide accurate, current, and complete information when using the App.
• Prohibited Activities: You agree not to:
- Use the App for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Transmit any viruses, malware, or harmful code
- Attempt to gain unauthorized access to the App or its systems
- Reverse engineer, decompile, or disassemble the App
- Use the App to harm, threaten, or harass others
- Upload false, misleading, or fraudulent information
- Use automated systems to access the App without permission
- Interfere with or disrupt the App's operation
• Content You Provide: You retain ownership of images and content you upload to the App. By uploading content, you grant us a license to use, process, and display that content as necessary to provide the App's services.
FREE CREDITS AND PREMIUM SUBSCRIPTIONS
• Free Credits: New users receive 1 free credits to try premium features. Each credit can be used for one pill identification, one health assistant query, or one drug interaction check. Free credits are provided at our discretion and may be modified or discontinued at any time.
• Premium Subscriptions: Premium subscriptions provide unlimited access to all App features. Subscriptions are available through Apple's App Store and are subject to Apple's terms and conditions.
• Subscription Terms:
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Subscription fees are charged to your Apple ID account
- You can manage subscriptions and turn off auto-renewal in your Apple ID account settings
- No refunds will be provided for any unused portion of a subscription period
• Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period.
• Price Changes: We reserve the right to change subscription prices at any time. Price changes will be communicated to you and will apply to subsequent subscription periods.
• Refunds: Refund requests must be submitted through Apple's App Store refund process. We are not responsible for processing refunds directly.
INTELLECTUAL PROPERTY
• Our Rights: The App, including its design, features, functionality, and content, is owned by Medsnap and protected by copyright, trademark, and other intellectual property laws.
• Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
• Restrictions: You may not:
- Copy, modify, or create derivative works of the App
- Remove any copyright, trademark, or proprietary notices
- Use the App for commercial purposes without our written permission
- Sell, rent, lease, or sublicense the App
• Third-Party Content: The App may include content, trademarks, or other materials owned by third parties. Use of such content is subject to the respective third party's terms and conditions.
DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF INFORMATION PROVIDED BY THE APP
• WARRANTIES THAT DEFECTS WILL BE CORRECTED
We do not warrant that the App will meet your requirements or that the operation of the App will be uninterrupted or error-free.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEDSNAP SHALL NOT BE LIABLE FOR:
• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP
• DAMAGES RESULTING FROM RELIANCE ON INFORMATION PROVIDED BY THE APP
• MEDICAL INJURIES, HEALTH COMPLICATIONS, OR ADVERSE EFFECTS RESULTING FROM USE OF THE APP
• ERRORS, INACCURACIES, OR OMISSIONS IN THE APP'S CONTENT OR FUNCTIONALITY
Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid to us in the twelve months preceding the claim, or $50, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Medsnap, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit or transmit through the App
• Your reliance on information provided by the App
TERMINATION
• By You: You may stop using the App at any time by uninstalling it from your device.
• By Us: We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.
• Effect of Termination: Upon termination, your right to use the App will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
• Data Retention: Upon termination, your locally stored data may be deleted. We are not responsible for any loss of data upon termination.
THIRD-PARTY SERVICES
The App uses third-party services, including:
• Google Gemini API (via AIProxy) for AI-powered features
• Apple App Store for subscriptions and payments
• Apple Push Notification Service for reminders
Your use of these third-party services is subject to their respective terms and conditions and privacy policies. We are not responsible for the practices of third-party services.
MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. We will notify you of any material changes by:
• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Providing notice through the App or via email
Your continued use of the App after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App.
GOVERNING LAW AND DISPUTE RESOLUTION
• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Medsnap operates, without regard to its conflict of law provisions.
• Dispute Resolution: Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration organization, except where prohibited by law.
• Class Action Waiver: You agree that any disputes will be resolved individually and not as part of a class action.
SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Medsnap regarding the use of the App and supersede all prior agreements and understandings.
WAIVER
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU ALSO ACKNOWLEDGE THAT YOU UNDERSTAND THE MEDICAL DISCLAIMER AND AGREE TO USE THE APP RESPONSIBLY AND IN CONSULTATION WITH HEALTHCARE PROFESSIONALS WHEN APPROPRIATE.
