TERMS OF SERVICE
Math Learner: Kids Math Games

Please read these Terms of Service ("Terms") carefully before using Math Learner: Kids Math Games ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
The App is designed for children ages 3-10. If you are a parent or guardian, these Terms apply to your use and your child's use of the App.
1. ACCEPTANCE OF TERMS
By accessing or using the App, you confirm that:
- You are a parent, legal guardian, or authorized adult downloading the App on behalf of a child; or
- You have the consent of a parent or legal guardian to use the App.
Parents and guardians are responsible for monitoring and supervising their child's use of the App.
2. DESCRIPTION OF SERVICE
Math Learner: Kids Math Games is an educational mobile application that helps children ages 3-10 learn and practice math skills, including:
- Number recognition and writing
- Addition, subtraction, multiplication, and division
- Mixed math operations (Galaxy World)
- Daily quests, achievements, and learning rewards
The App is available in both a free version and a premium subscription version with additional features and content.
3. USER ACCOUNTS
The App does not require account creation, registration, or login. All progress and data are stored locally on your device. There are no usernames, passwords, or online profiles.
4. SUBSCRIPTIONS AND PURCHASES
A. Subscription Plans
The App offers optional premium subscriptions ("Math Pro") through Apple's App Store, which may include:
- Weekly subscription
- Yearly subscription
- Lifetime (one-time) purchase
Premium features include access to all math worlds, all levels, and an ad-free experience.
B. Billing and Payment
- All purchases are processed through your Apple ID account via the App Store.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
C. Managing Subscriptions
You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period. No refunds are provided for the unused portion of a subscription period.
D. Free Trial
If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. Any unused portion of a free trial is forfeited upon purchasing a subscription.
E. Refunds
Refund requests must be directed to Apple, as all transactions are processed through the App Store. We do not have the ability to process refunds directly. Visit https://reportaproblem.apple.com to request a refund from Apple.
5. VIRTUAL CURRENCY AND REWARDS
The App includes virtual currency ("Coins"), experience points ("XP"), badges, and other virtual rewards:
- Virtual items are earned through gameplay and have no real-world monetary value.
- Virtual items cannot be exchanged, transferred, sold, or redeemed for real money or goods.
- Virtual items are stored locally on your device and are not transferable between devices.
- We reserve the right to modify the virtual economy, including reward amounts and pricing, at any time.
6. ACCEPTABLE USE
You agree to use the App only for its intended educational purpose. You agree NOT to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Modify, adapt, translate, or create derivative works based on the App
- Remove, alter, or obscure any copyright, trademark, or proprietary notices
- Use the App for any commercial purpose without our written consent
- Attempt to interfere with or disrupt the App's functionality
- Use automated tools, bots, or scripts to interact with the App
- Redistribute, sublicense, or resell the App or any of its content
7. INTELLECTUAL PROPERTY
A. Ownership
All content in the App, including but not limited to text, graphics, images, animations, mascot characters, sounds, music, videos, user interface design, and educational content, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.
B. Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal device for personal, non-commercial, educational purposes, subject to these Terms.
C. Trademarks
"Math Learner: Kids Math Games" and associated logos, mascot characters, and visual designs are our trademarks or trade dress. You may not use them without our prior written permission.
8. PARENTAL CONTROLS
The App includes a Parental Gate feature that restricts access to certain areas, including:
- Parent Profile and settings
- Subscription and purchase screens
- App configuration options
The Parental Gate is designed to prevent young children from inadvertently accessing these features. Parents and guardians are ultimately responsible for supervising their child's device usage.
9. PRIVACY
Your privacy is important to us. Our collection and use of information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy for details on how we handle data.

- We collect minimal data (age and learning preferences only)
- All gameplay data is stored locally on your device
- We do not collect personal information from children
- We do not display advertisements
- We comply with COPPA and applicable privacy laws
10. DISCLAIMERS
A. Educational Content
The App is designed as a supplementary educational tool. It is not a replacement for formal education, professional tutoring, or school curriculum. We make no guarantees regarding specific educational outcomes or academic improvement.
B. "As Is" Provision
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
C. Device Compatibility
We strive to ensure the App works on supported devices and operating systems, but we do not guarantee compatibility with all devices, OS versions, or configurations.
11. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your violation of these Terms or misuse of the App.
13. TERMINATION
A. By You
You may stop using the App at any time by uninstalling it from your device. Active subscriptions must be cancelled separately through the App Store.
B. By Us
We reserve the right to discontinue, modify, or suspend the App or any features at any time, with or without notice. In the event the App is permanently discontinued, we will make reasonable efforts to provide advance notice.
14. CHANGES TO THESE TERMS
We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this document. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the App.
15. GOVERNING LAW AND DISPUTES
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the use of the App shall be resolved through good-faith negotiation. If negotiation is unsuccessful, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.
16. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
17. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App. These Terms supersede any prior agreements or understandings, whether written or oral, relating to the App.
