These Terms and Conditions ("Agreement") govern your use of the AI Chatbot App ("App") that uses APIs provided by ChatGPT. By accessing or using the App, you agree to be bound by this Agreement.
License
Subject to your compliance with this Agreement, ChatGPT grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.
Restrictions
You agree not to:
a. use the App for any unlawful purpose;
b. modify, adapt, or hack the App, or attempt to do so;
c. interfere with or disrupt the App or the servers or networks connected to the App;
d. circumvent, disable or otherwise interfere with security-related features of the App;
e. use the App to transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature;
f. use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine," or in any way reproduce or circumvent the navigational structure or presentation of the App;
g. use the App in any way that suggests that ChatGPT endorses or approves of your use of the App;
h. use the App in any way that infringes upon the intellectual property rights of others.
Ownership
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by ChatGPT, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. Indemnification
You agree to indemnify and hold harmless ChatGPT, its affiliates, and their respective officers, directors, employees, agents, successors, and assigns from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the App or your breach of this Agreement.
Termination
ChatGPT may terminate this Agreement at any time, with or without notice. Upon termination, you must immediately cease all use of the App.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflicts of law provisions.
Severability
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions will not be affected or impaired in any way, and the unenforceable provision will be replaced by a mutually acceptable provision that comes closest to the intention underlying the unenforceable provision.
Entire Agreement
This Agreement constitutes the entire agreement between you and ChatGPT regarding the use of the App and supersedes all prior agreements and understandings, whether written or oral, regarding such use.
By using the App, you agree to be bound by this Agreement. If you do not agree to all of the terms and conditions of this Agreement, do not use the App.
