Welcome to Lociro.
These Terms of Use (the “Terms”) form an agreement between you and Ashlee Heiston, an individual developer (“Lociro,” “we,” “us,” or “our”), regarding your download, installation, access to, or use of the Lociro mobile application, related websites, and services (collectively, the “Service”). Please read these Terms carefully, particularly the provisions concerning location sharing, place alerts, automatic renewal, disclaimers, limitations of liability, and dispute resolution.
By tapping “Agree,” creating or restoring an anonymous account, accepting a friend invitation, purchasing a membership, or otherwise using the Service, you acknowledge that you have read, understood, and agree to these Terms and the Lociro Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
1. The Service is intended for adults and is not directed to children. You must be at least 18 years old and have reached the legal age required to enter into these Terms where you live.
2. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. If we reasonably believe that you do not meet these eligibility requirements, we may restrict or terminate your use of the Service and handle related data as required by applicable law.
4. The Service is initially offered only in the United States. We may adjust availability based on legal, technical, or business considerations. A country or region is not a target market for the Service until we officially make the Service available there.
2. The Service
Lociro is an iOS location-sharing application that allows users to share location information after they voluntarily establish a friend relationship and grant the necessary permissions. Depending on your location, device permissions, app version, and purchase status, the Service may allow you to:
• Create and restore an anonymous account and set a nickname and avatar;
• Generate, share, or enter a Friend Code or invitation link;
• Share location with friends and view their shared location, sharing status, and last-updated time;
• Create places and geofences and receive arrival or departure alerts;
• View up to the most recent 30 days of location history generated while sharing was active;
• Pause or resume location sharing globally or for an individual friend;
• Remove friends and delete your account and associated data; and
• Purchase, manage, or restore automatically renewing memberships and non-consumable purchases.
The features and membership benefits actually available are those displayed in the App. We may reasonably improve, update, or modify the Service, subject to mandatory consumer protection laws.
3. Important Location-Sharing Rules
3.1 Location is shared only after a friend relationship is established
The Service does not support secret tracking through a phone number, hidden surveillance, bypassing device permissions, or locating a person who has not agreed to use the Service. Location sharing requires all of the following:
1. The users have established a friend relationship through a valid Friend Code or invitation link;
2. The user whose location is shared has granted the required device-level location permission;
3. That user’s global sharing setting and friend-specific sharing setting are both enabled; and
4. The device, network, and operating-system services can obtain and upload the location.
3.2 What happens when you share a Friend Code
When you generate or share a Friend Code or invitation link, anyone who has the valid code or link may be able to establish a friend relationship with you during the validity period and before the usage limit is reached, without an additional case-by-case approval from you. After a friend relationship is established, location sharing between the two users is enabled by default.
Share Friend Codes and invitation links only with people you know and trust. Do not post them on public websites, public social media, or anywhere you cannot control who receives them. You may revoke or regenerate a Friend Code in the App. Previous codes and links will expire according to the product rules.
3.3 What happens when you accept an invitation
When you tap “Add Friend” or accept an invitation, you agree to share location with that friend and acknowledge that the friend may create arrival or departure alerts for places associated with you. The Service may not separately notify you each time the friend later creates, edits, pauses, or deletes an individual place alert.
You can stop future location sharing or place events at any time by:
• Pausing all location sharing under “Me”;
• Pausing sharing only with that friend from the friends list or friend details;
• Removing that friend;
• Turning off or changing Lociro’s location permission in iOS Settings; or
• Deleting your account.
Pausing sharing does not ordinarily delete history lawfully created before the pause. That information is retained for the periods described in the Lociro Privacy Policy. After a friend is removed, both users immediately lose access through the former relationship to each other’s new locations and location history. Adding the same person again does not restore or combine history from the former relationship.
3.4 Location may not be real-time or precise
Location and alerts may be delayed, unavailable, or inaccurate because of operating-system scheduling, satellite signal, network conditions, battery level, device settings, background-execution restrictions, location accuracy, geofence determinations, or other factors. The App will use reasonable efforts to show the last-updated time and actual sharing status, but we do not guarantee a fixed update frequency or that arrival or departure alerts will always be timely, accurate, or delivered successfully.
4. The Service Is Not an Emergency or Safety Service
Lociro is not an emergency-response, alarm, missing-person, medical-monitoring, or personal-safety assurance service. You must not rely on it as the sole basis for deciding whether someone is safe or needs assistance.
If an emergency has occurred or may be occurring, immediately contact local police, emergency medical services, fire services, or another appropriate professional service, and contact the person directly by telephone, text message, or another reliable method. Do not delay seeking help while waiting for a location update or alert from the Service.
5. Anonymous Accounts, Devices, and Security
1. When you first use the Service, it may automatically create an anonymous account and store an account-recovery credential in the iOS Keychain. An anonymous account may still be associated with location, friend relationships, purchase entitlements, and device information and therefore is not the same as deidentified or anonymous data.
2. You are responsible for reasonably safeguarding your device, system account, unlock credentials, Friend Codes, and invitation links and for activity conducted through your device and account, except where applicable law provides otherwise or the activity was not caused by your fault.
3. If your device is lost, stolen, or used without authorization, or if you suspect that your account has been compromised, promptly pause sharing and contact us using the details in Section 18.
4. Deleting the App does not automatically delete your account, cancel a subscription, or delete server-side data. Use the in-App “Delete Account” feature and separately manage subscriptions through Apple.
5. Because the anonymous account does not require a phone number or email address to sign in, we may need to verify a privacy request through the credential held on the device, purchase records, or other reasonable methods. If we cannot complete necessary verification, we may be unable to securely associate a request with a particular account.
6. User Content
1. You may submit a nickname, avatar, place name, and other content needed to use the Service (collectively, “User Content”). You retain the rights you lawfully hold in your User Content.
2. You grant us a non-exclusive, worldwide, royalty-free license, limited to what is necessary to operate, maintain, protect, and improve the Service, to store, process, copy, transmit, and display User Content to friends you designate. This license ends when the relevant content is deleted, except to the extent retention is required by law, delayed in backups, or reasonably necessary to resolve a dispute.
3. You represent that you have the right to submit your User Content and that it does not violate another person’s privacy, publicity, intellectual property, or other legal rights.
4. You may not impersonate another person using misleading identity information or submit content that is unlawful, infringing, threatening, hateful, sexually explicit, fraudulent, or contains malicious code.
7. Acceptable Use
You must not, and must not help another person to:
• Locate, track, monitor, or infer another person’s activity without valid consent;
• Use the Service for coercive control, intimate-partner violence, stalking, harassment, human trafficking, discrimination, or other conduct that threatens safety or privacy;
• Deceive a person into accepting an invitation, conceal the actual effect of location sharing or place alerts, or obtain, guess, enumerate, buy, or sell Friend Codes;
• Distribute a Friend Code publicly or disclose another person’s precise location, location history, or place events to a third party without permission;
• Circumvent or interfere with location permissions, sharing controls, user limits, paid entitlements, authentication, security controls, rate limits, or access controls;
• Use a bot, crawler, script, or other automated means to access, scrape, copy, or test the Service at scale;
• Reverse engineer, decompile, decode, or attempt to extract source code, except to the extent applicable law expressly permits;
• Upload malicious code, interfere with servers or networks, conduct a denial-of-service attack, probe for vulnerabilities, or conduct security testing without written authorization; or
• Violate any applicable law, court order, or third-party right.
If you believe the Service is being used for nonconsensual tracking, harassment, or other dangerous conduct, first take any steps necessary to protect your immediate safety and then contact us at 18101026917@163.com. In an emergency, contact local law enforcement or emergency services.
8. Free Features, Memberships, and Purchases
8.1 Types of products
The Service may offer:
• A weekly automatically renewing membership;
• An annual automatically renewing membership; and
• A non-consumable, one-time “Lifetime” entitlement.
The price, currency, promotional eligibility, billing period, benefits, and applicable taxes are those displayed on the App’s purchase screen and Apple’s purchase-confirmation interface at the time of purchase. Localized prices or introductory offers may differ by location, time, or user.
8.2 Automatic renewal
Weekly and annual memberships are automatically renewing subscriptions. Upon purchase confirmation, Apple will charge your Apple Account. Unless you turn off automatic renewal at least 24 hours before the end of the current subscription period, the subscription will ordinarily renew automatically, and Apple will charge the renewal price within 24 hours before the end of the current period.
You can view, change, or cancel a subscription in the subscriptions section of your Apple Account settings on iOS. Uninstalling the App, pausing location sharing, removing a friend, or deleting your Lociro account does not automatically cancel an Apple subscription.
8.3 Introductory offers, trials, and price changes
If you qualify for an introductory offer or trial, its duration and price and the standard renewal price that applies afterward will be shown before purchase. Unless you cancel in time, the subscription will automatically renew at the standard price displayed on the purchase screen after the offer or trial ends. Eligibility is determined by Apple and the applicable product rules.
If a subscription price changes, we or Apple will give notice as required by applicable law and Apple’s rules. Where your consent is required, the subscription will not renew at the new price without that consent.
8.4 Cancellation, refunds, and restoration
1. Cancellation ordinarily takes effect at the end of the current paid period, and the applicable benefits remain available until then.
2. Apple processes purchases. Refund requests, eligibility, and outcomes are governed by Apple’s refund policies and applicable law. We cannot approve a refund that Apple is responsible for processing.
3. You may use “Restore Purchases” in the App to restore valid product entitlements associated with the current Apple Account. Restoring a purchase does not restore deleted friend relationships, places, history, or other data.
4. If a subscription expires or a purchase is refunded or reversed, the corresponding paid features may end. Privacy controls, including pausing sharing, removing friends, and deleting an account, remain available.
8.5 “Lifetime” entitlement
“Lifetime” means a non-consumable entitlement associated with a valid account and Apple purchase record for as long as we continue to offer this App and the applicable features. It is not a promise that the entitlement will last for your natural lifetime, that the Service will exist forever, or that it will include every future product or feature. Nothing in this provision excludes rights that cannot be waived under applicable law. If the Service is discontinued, we will address purchased entitlements as required by applicable law.
9. Third-Party Services
The Service relies, or may rely, on:
• Apple services and technologies, including the App Store, StoreKit, Apple Push Notification service (APNs), iOS Location Services, Keychain, system sharing, and Apple Maps/MapKit; and
• Amazon Web Services, Inc. (AWS) for cloud hosting, servers, databases, storage, content delivery, and security. Our primary storage region is US East (N. Virginia).
Third-party services may be governed by their own terms and privacy policies. Apple may independently process information necessary to provide mapping, search, and location capabilities under its Apple Maps, Location Services, and other applicable privacy notices. For more information, see the Lociro Privacy Policy and Apple Maps & Privacy (https://www.apple.com/legal/privacy/data/en/apple-maps/).
We do not control Apple Accounts, Apple payments, device-level permissions, communications networks, or other independent third-party services and are not responsible for their independent conduct, except where applicable law provides otherwise. The Lociro Privacy Policy describes third-party categories and practices relating to personal information. When we appoint a processor, we require safeguards appropriate to the relevant risk.
10. Intellectual Property and Limited License
1. The software, interfaces, brands, icons, images, text, algorithms, and other content in the Service are owned by us or our licensors and are protected by applicable law.
2. Subject to your compliance with these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to use the Service for personal, noncommercial purposes on compatible Apple devices that you own or control.
3. Except for the limited license expressly granted in these Terms, no intellectual property rights are transferred to you.
10.1 Apple App Store terms
If you obtained the App through the Apple App Store, you and we further acknowledge that:
1. These Terms are between you and us, not Apple. We, not Apple, are responsible for the App and its content. The license granted under these Terms is limited to use of the App on Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing, volume purchasing, or other mechanisms permitted by those Usage Rules.
2. We are responsible for maintenance and support required by applicable law or these Terms. Apple has no obligation to provide maintenance or support for the App.
3. If the App fails to conform to an applicable warranty that has not been validly disclaimed, you may notify Apple, and Apple may refund the purchase price, if any, paid for the App in accordance with its rules. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App. We are responsible under applicable law for any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty.
4. We, not Apple, are responsible for addressing claims by you or a third party relating to the App or your possession or use of it, including product-liability claims; claims that the App fails to comply with legal or regulatory requirements; and claims arising under consumer-protection, privacy, or similar laws.
5. If a third party claims that the App or your possession or use of it infringes that party’s intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of the claim as required by applicable law.
6. You represent and warrant that you are not located in a country or region subject to a U.S. government embargo or designated by the U.S. government as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties. This provision applies only to the extent permitted by applicable law and does not override mandatory law where you live.
7. When using the App, you must comply with applicable third-party terms, including the Apple Media Services Terms and Conditions and your wireless data-service agreement.
8. Apple and its subsidiaries are third-party beneficiaries of the provisions in these Terms relating to the App license. Upon your acceptance of these Terms, Apple has the right, and will be deemed to have accepted the right, to enforce those provisions against you as a third-party beneficiary.
11. Changes, Interruptions, and Termination
1. We will use reasonable efforts to keep the Service available, but it may be interrupted because of maintenance, upgrades, failures, security incidents, legal requirements, changes to third-party services, or events beyond our reasonable control.
2. To protect users, third parties, or the Service, or when we reasonably believe that you have violated these Terms, applicable law, or another person’s rights, we may issue a warning, limit features, revoke an invitation, suspend an account, or terminate an account. Where required by law, we will provide reasons and an opportunity to appeal.
3. You may stop using the Service and delete your account in the App at any time. The effects of account deletion and applicable retention periods are described in the Lociro Privacy Policy. Deleting your account does not automatically cancel an Apple subscription.
4. If we plan to discontinue the Service or make a material adverse change to a core paid benefit, we will provide advance notice where reasonably practicable and address unperformed services, data export, and purchased entitlements as required by applicable law.
12. Disclaimers
To the maximum extent permitted by applicable law:
1. The Service is provided “as is” and “as available.” We do not warrant that location, routes, stays, distances, device status, or place alerts will always be accurate, complete, continuous, timely, or error-free.
2. The Service does not guarantee prevention of loss of contact, accidents, crime, personal injury, property damage, or any other event and does not replace your judgment, direct communication, or professional services.
3. Maps, addresses, routes, and place names may be provided through Apple services and are for reference only. Independently verify them before making an important decision.
4. We are not responsible for consequences caused by a user’s breach of these Terms, unauthorized disclosure of another person’s location, public distribution of a Friend Code, disabled permissions, or device or network failure, except to the extent we are responsible under applicable law.
Some jurisdictions do not permit the exclusion of certain warranties. These exclusions therefore apply only to the extent permitted by applicable law. Mandatory consumer rights are not affected.
13. Limitation of Liability
To the maximum extent permitted by applicable law, we and our affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Service.
Our total cumulative liability for all claims arising out of or relating to the Service will not exceed the greater of:
1. The amount you actually paid us for the Service during the 12 months before the event giving rise to the claim; or
2. USD $100, or the equivalent minimum amount that may lawfully be agreed where you live.
These limitations do not apply to liability arising from our fraud, willful misconduct, or gross negligence; liability for death or personal injury; or any other liability that cannot be limited or excluded under applicable law.
14. Indemnification
To the extent permitted by applicable law, if a third party brings a claim against us because of your unlawful use of the Service, infringement of another person’s rights, nonconsensual tracking or disclosure of location, or breach of these Terms, you agree to indemnify us for reasonable losses, liabilities, and expenses resulting from the claim. If you are a consumer, this provision does not require you to assume responsibility for a matter not caused by your fault and does not limit your statutory rights.
15. Governing Law and Dispute Resolution
1. These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-law principles.
2. If you use the Service as a consumer, this choice of law does not deprive you of any consumer protection or other statutory rights under the law of your usual place of residence that cannot be waived or limited by agreement.
3. If a dispute arises out of or relates to these Terms or the Service, you may first contact us at 18101026917@163.com. We will use reasonable efforts to resolve the matter informally within 30 days after receiving complete information about the complaint. This informal process does not prevent you from filing a complaint with a regulator, seeking emergency relief, or initiating a legal proceeding, and it does not suspend an applicable limitation period.
4. If the dispute is not resolved informally, either party may bring an action in a court of competent jurisdiction under applicable law, including, where appropriate, a state or federal court located in North Carolina. If you are a consumer, you may bring an action in a court having jurisdiction where you reside to the extent permitted by applicable law, and we will bring an action against a consumer only in a court permitted by mandatory law.
5. After a dispute arises, the parties may voluntarily agree to mediation, arbitration, or another form of alternative dispute resolution. These Terms do not require a consumer to submit to mandatory arbitration unless the parties expressly agree after the dispute arises.
16. Changes to These Terms
We may update these Terms because of changes to features, our business model, legal requirements, or security needs. Before a material change takes effect, we will provide notice through the App, by email if we have collected one, or by another reasonable means, and will update the date at the top. If applicable law requires renewed consent, we will obtain it.
Your continued use of the Service after an update takes effect constitutes acceptance of the updated Terms, except that continued use does not replace affirmative consent where the law requires it. If you do not agree, you may stop using the Service, cancel your subscription, and delete your account.
17. Miscellaneous
1. These Terms, the Lociro Privacy Policy, and the product terms displayed on the applicable purchase screen constitute the entire agreement between you and us concerning the Service. In case of a conflict, mandatory law controls; the Privacy Policy controls with respect to personal-information processing; and Apple’s purchase-confirmation interface controls with respect to the price and billing period of a particular purchase.
2. Our failure to exercise a right does not waive it. If a provision is found invalid, the remaining provisions remain effective, and the invalid provision will be interpreted, to the extent permitted by law, in the manner closest to its original purpose.
3. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, or transfer of assets, subject to applicable notice requirements and protection of your rights.
4. Headings are for convenience only and do not affect interpretation.
