Terms of Service – ListenSpark

These Terms of Service (“Terms”) govern your access to and use of the ListenSpark mobile application and related services (collectively, the “Service”), operated by Prodigy Designs (“we”, “our”, or “us”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Description of Service
ListenSpark allows users to:
- Discover and listen to publicly available podcasts
- Generate AI-powered podcast content from topics, web links, documents, or written text
- Save and access audio content for personal use
- Access premium features through subscription plans
The Service is intended for informational and entertainment purposes only.
2. Account Registration
2.1 Some features of the Service require you to sign in using your Apple or Google account.
2.2 You agree to provide accurate and up-to-date account information and are responsible for maintaining the confidentiality of your credentials.
2.3 You are responsible for all activities that occur under your account.
3. Subscriptions and Payment
3.1 ListenSpark offers auto-renewable subscription plans that provide access to premium features.
3.2 All subscription purchases and billing are handled securely by Apple through the App Store. We do not process or store your payment details.
3.3 Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.
3.4 Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
3.5 You can manage or cancel your subscription at any time by going to your Apple ID account settings on your device.
3.6 Subscription prices and available plans are displayed within the App Store at the time of purchase and may vary by region.
3.7 All payments are non-refundable to the maximum extent permitted by applicable law, except where required by Apple’s App Store policies.
4. User Content
4.1 You may upload or input content such as text, links, or documents into the Service to generate AI audio. You represent that you have the legal right to use and upload such content.
4.2 You retain ownership of your content. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to process and transform this content into audio solely for the purpose of providing the Service.
4.3 You are solely responsible for the legality and appropriateness of the content you provide.
5. Intellectual Property
5.1 The Service and its original features, functionality, and design are owned by Prodigy Designs and are protected by intellectual property laws.
5.2 The AI-generated audio content is provided for personal, non-commercial use only. All underlying AI models, algorithms, and transformation methods remain the property of Prodigy Designs.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe upon the rights of others, including intellectual property rights
- Upload harmful, illegal, defamatory, or offensive content
- Attempt to interfere with the integrity or security of the Service
- Access the Service through unauthorized means (e.g., scraping or reverse engineering)
7. Privacy
We respect your privacy. Please review our Privacy Policy (available in-app) to understand how we collect and handle your information.
8. Termination
8.1 We may suspend or terminate your access to the Service at any time, with or without cause or notice.
8.2 Upon termination, your right to use the Service will cease immediately.
9. Disclaimer & Limitation of Liability
9.1 The Service is provided “as is” without warranties of any kind. We do not guarantee the accuracy, completeness, or usefulness of AI-generated content.
9.2 To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
10. Modifications to the Service or Terms
10.1 We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.
10.2 We may update these Terms periodically. Continued use of the Service after such updates constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of Hong Kong SAR, without regard to conflict of laws principles.
