By downloading or using the app, you agree to these terms, which will apply to you automatically. Please read them carefully before using the app. You are not permitted to copy, modify, or otherwise alter the app, any part of the app, or our trademarks. You are also prohibited from attempting to extract the app's source code, translating it into other languages, or creating derivative versions. All rights, including trademarks, copyrights, database rights, and other intellectual property rights related to the app, remain with Mark Albert.
Mark Albert is dedicated to ensuring the app is as useful and efficient as possible. Therefore, we reserve the right to make changes to the app or introduce charges for its services at any time and for any reason. We will clearly communicate any charges and provide details about what you are paying for.
The app collects and processes personal data you provide to deliver its services. It is your responsibility to keep your phone and app access secure. We recommend not jailbreaking or rooting your phone, as this can remove software restrictions, make your device vulnerable to malware or viruses, compromise security features, and potentially cause the app to malfunction.
The app also uses third-party services that have their own Terms and Conditions.
We grant you a personal, worldwide, revocable, non-transferable, and non-exclusive license to access and use the app for personal, non-commercial purposes, in accordance with these Terms. This license is intended solely to enable you to enjoy the benefits of the software as outlined herein.
Under this license, you are prohibited from using the app or any of its materials, including but not limited to any parts of it, for commercial or promotional purposes without prior written consent from the Company. Specifically, you may not:
Copy or reproduce the software or any part of it, except as allowed under this license;
Sell, resell, rent, lease, loan, supply, distribute, redistribute, publish, or republish the software or any part of it;
Modify, alter, adapt, translate, edit, or create derivative works of the software or any part of it;
Reverse engineer, decompile, or disassemble the software or any part of it;
Copy, modify, transmit, distribute, publicly display, demonstrate, or create derivative works from any copyrighted materials, images, screenshots, trademarks, trade names, proprietary information, service marks, or other intellectual property found in the app.
This list is not exhaustive. The license does not grant you any transfer of intellectual property rights belonging to the Company.
You should be aware that there are certain responsibilities that Mark Albert will not assume. Some functions of the app require an active internet connection, which can be either Wi-Fi or provided by your mobile network. Mark Albert cannot be held responsible for any issues or reduced functionality of the app if you do not have access to Wi-Fi and have exhausted your data allowance.
If you use the app outside of a Wi-Fi area, your agreement with your mobile network provider will still apply. This means you may incur charges from your mobile provider for data usage while accessing the app, including any third-party fees. By using the app, you accept responsibility for any such charges, including roaming data charges if you use the app outside of your home region or country without disabling data roaming. If you are not the bill payer for the device on which you use the app, we assume you have obtained permission from the bill payer for app usage.
Similarly, Mark Albert cannot be held responsible for how you use the app. You need to ensure that your device remains charged. If your device runs out of battery and you cannot access the Service, Mark Albert will not be liable.
Regarding Mark Albert’s responsibility for your use of the app, please keep in mind that while we strive to keep the app updated and accurate, we rely on third parties to provide information. Mark Albert accepts no liability for any direct or indirect loss you may incur as a result of relying solely on the app's functionality.
We may update the app from time to time. The app is currently available on iOS, and requirements for system compatibility (including any additional platforms we may support) may change. You will need to download updates to continue using the app. Mark Albert does not guarantee that the app will always be updated to remain compatible with your device's iOS version. However, you agree to accept any updates when offered. We may also decide to discontinue the app and terminate access at any time without prior notice. Unless otherwise specified, upon termination (a) the rights and licenses granted to you under these terms will end; (b) you must stop using the app and, if necessary, delete it from your device.
