Terms of Use

These Terms of Use ("Terms") govern your use of the LinguaCap mobile application ("App") developed and operated by Baursaq ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using LinguaCap, you confirm that you are at least 13 years of age (or the minimum age of digital consent in your jurisdiction) and agree to comply with these Terms. If you do not agree, you must not use the App.

2. Description of Service

LinguaCap is a language-learning application that helps users improve their language skills by:

• Watching YouTube videos with interactive dual-language subtitles;

• Tapping words in subtitles to see translations, transcriptions, and examples;

• Saving vocabulary words and reviewing them with flashcards;

• Practicing listening comprehension through dictation exercises;

• Browsing educational web content in a foreign language.

The App uses YouTube content as a learning resource. LinguaCap does not host, modify, or redistribute YouTube videos. All video content is accessed through YouTube's standard web interface.

3. User Accounts

You may create an account using Apple Sign-In or Google Sign-In. You are responsible for maintaining the confidentiality of your account. You agree to provide accurate information and to not share your account credentials with third parties.

You may delete your account at any time from the Settings screen in the App. Account deletion is permanent and irreversible.

4. Subscriptions and Payments

LinguaCap offers a free tier with limited features and a premium subscription ("LinguaCap Pro") that provides unlimited access.

• Billing: Subscriptions are billed through Apple's In-App Purchase system. All payment processing is handled exclusively by Apple.

• Renewal: Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

• Cancellation: You may cancel your subscription at any time through your Apple ID settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period.

• Free Trials: If a free trial is offered, it converts to a paid subscription upon expiration unless cancelled beforehand.

• Refunds: Refund requests are handled by Apple in accordance with their refund policies.

We reserve the right to change subscription pricing. Price changes will be communicated in advance and will apply to the next billing cycle.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose;

• Attempt to reverse-engineer, decompile, or disassemble the App;

• Interfere with the operation of the App or its servers;

• Use automated tools or scripts to access the App;

• Circumvent the App's usage limits or security measures;

• Violate YouTube's Terms of Service while using the App.

6. Intellectual Property

All content, design, code, and trademarks within LinguaCap are the property of Baursaq or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

YouTube content is the property of its respective creators and is governed by YouTube's Terms of Service.

7. Third-Party Services

The App integrates with third-party services including:

• YouTube: Video content and subtitles;

• Supabase: Authentication and data synchronization;

• RevenueCat: Subscription management;

• AI Language Services: Translation and language detection.

Your use of these services is subject to their respective terms and conditions. We are not responsible for the availability or content of third-party services.

8. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee that:

• The App will be available at all times or free of errors;

• Translations or language processing results will be accurate;

• YouTube content or subtitles will always be available.

9. Limitation of Liability

To the maximum extent permitted by law, Baursaq shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claims under these Terms shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Account Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately. You may also delete your account at any time from the App's Settings.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the App or via email. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Kazakhstan. Disputes arising under these Terms shall be resolved in the courts of Astana, Kazakhstan.
