1. Acceptance of Terms
By downloading, accessing, or using LifeMy - the Ultimate Planner (hereinafter “LifeMy App”), you agree to abide by these terms and conditions (hereinafter "Terms and Conditions") as a binding agreement between user (hereinafter “You”) and Müge Kartal Sargan (hereinafter "We"). If you do not agree to these Terms, please do not use this App.
The LifeMy App is a software which is designed to help you to plan and track your daily tasks, long term goals, habits and budget.
The LifeMy App is available as a free version and also a commercial version, that is subject to charges (hereinafter "LifeMy Pro"). Only in LifeMy Pro all features of the LifeMy App are activated.
Our terms and conditions apply to all versions of the LifeMy App.
2. App Functions & License Grant
The exact scope of functions of the LifeMy App is described in the respective app store. We reserve the right to change the LifeMy App at any time in a way that is reasonable for You, e.g. to develop it further or improve its quality. This applies to technical and content-related developments.
Subject to these Terms and Conditions, we grant you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the LifeMy App for personal, non-commercial use. This license does not permit you to:
Rent, lease, lend, sell, redistribute, or sublicense the LifeMy App.
Copy, decompile, reverse-engineer, disassemble, attempt to derive the source code, modify, or create derivative works of the LifeMy App or any part of it.
3. App Usage and Data Collection
We may collect anonymous data regarding app performance and user interactions solely for the purpose of improving user experience, fixing bugs, and optimizing app performance. Any data collected will be anonymized and aggregated and will not include any personally identifiable information.
4. Privacy Policy
Your use of the LifeMy App is also governed by our Privacy Policy, which is available at https://sites.google.com/view/lifemyapp. The Privacy Policy explains how we collect, use, and share information when you use LifeMy App. By using the App, you agree to the terms of our Privacy Policy.
5. Subscriptions
The free version of LifeMy App may be downloaded from the respective app store. In LifeMy App, we offer different subscription and payment plans for the use of the LifeMy Pro version of the LifeMy App. Subscription periods and respective prices can be viewed in the LifeMy App. We may change the prices and trial periods any time. The changes will be published in LifeMy App.
All subscriptions must be paid in advance for the respective subscription period. Payments are processed via the respective app store or via the payment service provider integrated by us.
As soon as Your subscription period has reached its end, Your booking will be automatically extended by the initially booked subscription period and billed to You via the app store, unless You have canceled at the latest before the subscription expires.
You can cancel existing subscriptions at any time directly in your subscriptions under your apple id to the end of the selected subscription period.
LifeMy Pro version provides monthly and annually subscriptions. Based on your preference, the subscription fee will be wirhdrawn from your account. The prices of subscriptions defined in LifeMy App and we may change prices at any time.
Your subscription can't be cancelled after it is activated.
6. User Content and Responsibilities
You are responsible for any content (such as notes or tasks) that you create or store within the LifeMy App. We are not responsible for the loss of any content. We advise you to regularly back up your data.
7. Modifications and Updates
We reserve the right to update, modify, or discontinue the LifeMy App or any feature of the LifeMy App at any time. We may also update these Terms and Conditions from time to time. Continued use of the LifeMy App after an update signifies your acceptance of the new terms.
8. Termination
We may terminate or suspend your access to the LifeMy App without notice if we determine that you have violated these Terms and Conditions or if it is required by law. Upon termination, you must delete all copies of the LifeMy App.
9. Limitation of Liability
To the maximum extent permitted by law, we not liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the LifeMy App or inability to access the LifeMy App, even if we have been advised of the possibility of such damages.
9. Final Provisions
If You are a merchant or if You do not have a general place of jurisdiction in the Federal Republic of Germany, the place of jurisdiction for any disputes arising from the business relationship between us and You shall be, at our discretion, Frankfurt or Your place of residence. In such cases, the exclusive place of jurisdiction for legal action against us must be Frankfurt. Mandatory statutory provisions on exclusive places of jurisdiction shall remain unaffected by this provision.
The relations between us and You are subject exclusively to the law of the Federal Republic of Germany. The United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980 (CISG) shall not apply.
If any provision of the Terms and Conditions has been inadvertently omitted from the Terms and Conditions, the resulting gap shall be filled with such valid provision that most closely reflects what the parties would, in consideration of the commercial intent and purpose of the Terms and Conditions, have agreed upon, had they been aware of the omitted provision from the outset.
