You are here: Home / Statistics / Region 10 Status of LGU Compliance to Memorandum Circular No. 2022-025 Dated March 02, 2022, With the Subject: ‘Dispensing, Selling, and Reselling of Pharmaceutical Products in Sari-Sari Stores and other Similar Retail Outlets’
This pertains to the aforementioned Memorandum Circular, which was issued to all Local Government Units (LGUs) and local operating units of the Philippine National Police (PNP) to enforce the regulations stipulated in RA 10918 concerning the dispensing, selling, or reselling of pharmaceutical products.
Among the obligations of the LGU is to enact an ordinance aligned with RA 10918, the aforementioned Memorandum Circular, and other relevant laws and directives within their territorial jurisdiction. This ordinance should, at the very least, impose penalties including the revocation of business permits or licenses for stores found by the LGU, the FDA, or the PNP to be dispensing, selling, or reselling pharmaceutical products without proper authorization.
In this connection, we respectfully present to you the statistical report on the compliance of LGUs in Region 10 with MC No. 2022-025. This report reflects the status as of April 30, 2024, in accordance with the following references:
1. Memorandum Circular No. 2022-025 dated March 02, 2022, titled: ‘Dispensing, Selling, and Reselling of Pharmaceutical Products in Sari-Sari Stores and other similar Retail outlets.’
2. Memorandum dated June 19, 2023, titled: ‘Submission of Reports Re: Monitoring of LGU Compliance with DILG Memorandum Circular No. 2022-025, or Dispensing, Selling, and Reselling of Pharmaceutical Products in Sari-Sari Stores and other similar Retail outlets.’
As of April 2024, it has been observed that only 12 out of 93 LGUs in Region 10, which accounts for approximately 12.9%, have enacted ordinances prohibiting the sale of medicines by sari-sari stores without FDA authorization. Specifically, these ordinances are present in the LGUs of Bukidnon and Misamis Oriental, with 8 and 4 LGUs respectively having such regulations in place.
Among these 12 LGU ordinances, only 9 include provisions for the revocation of business permits for violators.
