Abstract:-
This article provides a simplified overview of the key features of the Indian Constitution, highlighting its democratic, inclusive, and progressive nature. The Indian Constitution, adopted on January 26, 1950, is a significant document that forms the backbone of India's legal and political system. It passes several salient features that reflect the core values and goals of indian country.
Introduction:-
The Indian Constitution is a special document that guides our country. It was made in 1950 and has important rules and principles. In simple words Indian Constitution is a special book of rules for our country.The Constitution guarantees fundamental rights, outlines the responsibilities of the government, and provides a framework for the functioning of various institutions. It is a testament to the democratic spirit and the vision of a progressive India.
The most Important feature of indian constitution :-
Preamble:- The Preamble of the Indian Constitution provides theobjectives of indian constitution. It includes justice, liberty, equality, and fraternity among the people of India. It declares India to be a sovereign, socialist, secular, and democratic republic.
Salient Features of Indian constitution:-
1. WrittenConstitution:-
The Indian Constitution is a written document that clearly defines the fundamental rights, directive principles, and the structure and functions of the government. This feature ensures clarity and transparency in our constitution.
2. FederalSystem:-
India follows a federal system of government, where power is shared between the central government and the state governments. The central government look out the important things of central level while state government handle local matters.Example:- The central government handles national issues like defence, and state governments manage local matters like education and healthcare.
FundamentalRights:- This feature is influenced from the Constitution of United States of America (Bill of Rights).The Indian Constitution guarantees fundamental rights to every citizen. These are basic rights that every person is entitled to take. For example:- the right to equality, freedom of speech, the right to practice any religion, and the right to protection of life and personal liberty.
Example:- You have the right to speak your mind freely and share your thoughts without fear.
3. IndependentJudiciary(Fair courts):-
India has an independent judiciary, which means that the courts are separate from the executive and legislative branches of the government. Judiciary also has the power to make judicial review and examine the actions of government. The Supreme Court has the power to protect citizens' rights.Example:- If someone has been treated unfairly, they can go to court to seek justice and protection of their rights.
4. DirectivePrinciplesofStatePolicy:
The Constitution provides Directive Principles of State Policy work toward achieving social and economic justice, promoting welfare programs, and ensuring the well-being of the citizens.
Example:- The government is directed to provide equal opportunities for education, promote the welfare of many sections, and protect the environment. The government aims to provide good education and healthcare for all citizens.
5. UniversalAdultSuffrage:-
Everyone who is 18 years old or more can vote in India. This is called universal adult suffrage. It means that we can choose our leaders by voting for them. This is very important right.Example:- In India, universal adult franchise is guaranteed by the Indian Constitution. The Constitution grants all citizens who are 18 years or older the right to vote.
6. SecularState:-
India is a secular country, which means that the state does not promote or favour any particular religion. It respects and protects the freedom of individuals to follow and practice their own religion.
Example:- The government does not promote or favour any particular religion, and all citizens have the right to practice and propagate their religion freely.
7. AmendmentProcess: -
Sometimes the Constitution needs to change with the times. But changing it is not easy. It requires a special process where many people need to agree on the changes and this process is called Amendment Process.Example: New laws added or modified to protect people's rights or address new challenges faced by the country.
8. PresidentandPrimeMinister (Parliamentary system) :- This feature is taken from the Constitution of United Kingdom ( British Constitution).
The President is the head of the country, representing it both within India and internationally. The Prime Minister is the head of the government, responsible for making important decisions and running the country.
Example:- The President greets foreign leaders and the Prime Minister leads the government to make policies for the benefit of the people.
9. SocialJusticeandReservation:-
The Constitution promotes fairness and equality by providing special opportunities for those who have been historically disadvantaged.
Example:- Seats in educational institutions and government jobs are reserved for certain groups to help them overcome past inequalities. ( SC and ST ).
Case laws:-
Case :-ManekaGandhiv. UnionofIndia (1978) This case provides the right to life and personal liberty under Article 21 . This case states that it includes the right to live with dignity.
Case:-MinervaMillsLtd. V. UnionofIndia (1980) In this case , held that the DPSPs are the soul of the Constitution, those laws violating them deemed to be unconstitutional.
Case:- KeshavanandaBharativ. StateofKerala (1973) This case stated that the basic structure of the Constitution can’t be amended because of protecting its integrity.
Case:-S.R. Bommaiv.UnionofIndia (1994) In this case , it was held that secularism is a basic feature of the Constitution, and the action which is contrary to the general principle would be unconstitutional.
