HOW TO SEND A LEGAL NOTICE?
INTRODUCTION
In today's world, a person needs to be involved in many transactions. Some of them are for huge monetary benefits. When such transactions take place in that situation a dispute arises. For such disputes, an individual or an organization needs to institute a suit against another entity or person on several different occasions. The various circumstances may include a customer complaint, a property dispute, a bounced cheque, a divorce, an eviction, and many others. However, it is crucial that you let the other party know that you intend to file a lawsuit against them. For such a reason or any other reason, a person or entity needs to send a legal notice through their respective lawyers.
MEANING OF LEGAL NOTICE
A literal meaning of a legal notice is a formal letter or document sent by any individual or organization in response to a complaint. The notification is sent to the recipient as a warning that the sender has some complaints that the recipient has not properly addressed, despite the recipient having had the time to address the issue. It's like the sender is giving the recipient one last heads-up that they are getting ready to file a lawsuit, and this is their last chance to do it right. Such legal notice can be sent for many reasons where it is necessary to be sent.
PRELEGAL NOTICE
Pre-legal notice means "before it becomes legal." This notice will be sent to the parties before any legal notice is sent to them. This is a kind of face-to-face communication between the parties. Legal notices warn of litigation, while pretrial notices act as legal notice warnings.
PURPOSE
The purpose of a legal notice is to inform the other party that legal action may be taken by the party sending the notice if the specified debt, liability, or obligation is not performed within a given time limit. For defendants, it may be their last chance before the trial begins.
The legal notice allows aggrieved parties to file complaints in a court-acceptable manner with the help of experienced attorneys so that the consequences are clear if the recipient fails to comply with the aforementioned conditions.
REASONS
You may give a person or organization legal notice for a variety of reasons. However, these are the most typical ones:
· Property-related disputes include those involving a mortgage, a builder's delayed possession delivery, a removable of any tenant, the partition of family property, etc.
· For unjustified decay, non-payment of wages, the employer's infringement of any employee rights, etc.
· Employees are given notice when they violate HR policies, commit acts of sexual harassment at work, quit their jobs without giving notice in writing, or break any other clauses in their employment contracts.
STATUTORY PROVISION
In civil matters, legal notices are usually filed. In criminal cases, no legal charges are filed because if a crime occurs, the state is the supreme power, and the case is filed against the person who committed the crime. However, if you want to bring a civil action against the government, you need to send a legal notice to the government for bringing a civil action against it.
Section 80 of the CPC 1908 provides that if anyone wishes to bring legal action against an officer for an act allegedly committed by that officer during his term of office, he shall give legal notice to that officer at the expiration of his 1908 term. stipulated to be sent in 2 months.
FILING OF A LEGAL NOTICE
A legal notice can be filed by any person who is sending it or by any lawyer. If a person takes the help of a lawyer for sending a legal notice then it should be typed on the letterhead of that lawyer. Such notice must contain all the important facts such as the cause of action, the name of both parties and their addresses. The sender must give reasonable time to the person to whom the notice is being sent for giving his reply to such notice. Legal notices are an important means of communication between parties. A well-crafted legal notice can help parties resolve disputes without cumbersome formal court proceedings, saving time and money.
